The Recreation Board of the City of Fairhope met Wednesday, February 15 , 2012 , at 5:15 p.m.
at the Recreation Center located at 803 North Greeno Road.
Present were: Vann Saltz, Sherry Sullivan, Bob Keyser, Tom Kuhl, Jenny Douglass, Michelle
Smith, Derek Thomas and City Councilman Mike Ford . City Executive Assistant Gayle Fogarty
took the minutes at the meeting. Absentees were : Erik Cortinas and John Baker. Guests : Ron
Havard and Joe Hiti (residents of Summer Lake).
Chainnan Vann Saltz called the meeting to order. The minutes from the meeting on· Wednesday,
January 18, 2012 were reviewed and approved by 1st motion by Bob Keyser, and 2nd motioned
by Michelle Smith and unanimously carried.
Old
Business -Tom Kuhl gave an update on the Flag Football League idea that James Woodruff
presented to the group on January 18. Tom attempted contacting him several times to
find out the status of the league, but has not received a response . There was also
review and discussion of the "how to create a league" form that Michelle Smith and
Gayle Fogarty updated . There was a motion 1st by Bob Keyser and 2nd motioned by
Michelle Smith to approve the applications based on providing The City of Fairhope
Parks & Recreation Facilities Use Agreement and Resolution No . 1775-11 to league
organizers and unanimously carried .
Bob Keyser gave an update on the Manley Road Park, regarding a buffer from the
road to meet city and county building codes. He also estimated 8 full size fields and
750 parking spots should fit on the land available , the fields should ran North to
South and lights will shine East & West.
The estimated start date for construction is October 2012 . $60 ,000 has been allocated
for the project is for Engineering and Grading. There was explanation of the purpose
of the committee for the guests that attended the meeting.
Sherry Sullivan gave an update on animal ordinances in city parks . She provided
research from the city clerk's office-regarding if other cities in the state had
ordinances in place to keep pets out of parks. Research found that Gardendale,
Alabama an ordinance is in place that states no animals are permitted on playing
surfaces and have to be on a leash and under cont;rol. Currently, to Sherry's
knowledge the City of Fairhope doesn 't have an ordinance such as this . The leash
law can be enforced currently , but nothing else is in place to keep pets off the
playing fields . There was discussion among the committee as to their thoughts on
pets on the playing fields . Tom suggested that an ordinance be passed by the city
council that would require pets to be on a leash and not allowed on the sports fields.
The committee agreed .
Sherry will contact City Clerk Lisa Hanks to work on creating an ordinance to
present to the Fairhope City Council. The motion was made to submit an ordinance
to the City Council to read-"Pets have to be on a leash and are not allowed on the

city playing fields. If the law/ordinance is broken you notify the person breaking the
law, if they do not take action to remove their pet from the sports field, the Fairhope
Police Department will be contacted." 1st motion by Bob Keyser, and 2nd motioned
by Derek Thomas and unanimously carried.
Tom reported that he will work on getting a report, so the committee can have an
idea of where the budget stands, as the group will need to discuss plans for the
impact fund by June.
Park Update-Once weather permits, the project will be completed and will come in on budget of
$15,000, which will include top soil, equipment rental, irrigation, sod, etc. Bob
added that the city has purchased (2) two 8x 24 goals and BLAST purchased (2) two
more sets of goals for a total of (3) sets and will be used at the first high school
tournament on Friday, February 16, 2012 . (44) Forty Four Varsity high school
soccer teams will be in town participating in the tournament. The soccer fields in
Fairhope that are being used for this tournament include Volanta, Founders,
Barnwell, and Fairhope High School.
Report from
Bob added that Adam Winegarden was selected as Fairhope High School Football
Coach and Athletic Director; he will begin work on February 27, 2012. He is from
Hillcrest High School in Tuscaloosa, AL.
Tom Kuhl-Tom stated that the dugouts are being rebuilt and the work is estimated to be
completed by February 18, 2012 .

Tom stated that the tennis courts are still under the Rec Center umbrella and did
not have an update on the status of the free tennis clinics that were discussed at the
February 15, 2012 meeting. He also mentioned that he is still working on
maintaining a constant temperature at the pool .
Tom reported that the Rec Center is having issues with repairs needed on
equipment, obtaining parts for the machines are not a problem, but quick response
time from the repainnan is the delay.
Councilrnember Mike Ford recognized Tom and his staff for the City of Fairhope
being named as one of Ninety-One Fields Honored with the 2011 Fields of
Excellence Award . Councilmember Ford also noted that Tom was recognized
on February 13, 2012 at the City Council Meeting. See attached .
Bob gave an updated on Spring Soccer, he stated that registration is closed and
teams have been formed. Opening day is March 17. About 300 participants this
year, field updates have not affected registration numbers.
Vann updated the group on Dixie Youth Baseball; the teams are formed and ready to
being practicing. The OZONE state tournament will be held in Fairhope this year.
The tournament teams have been updated from a 12 to 16. AU the games will be
broadcasted live on a webcast by a company called Jock Jive . This will give
exposure to Fairhope . Sherry added that the tournament is seeking host families.
There being no further business, on motion to adjourn by 1st Derek Thomas, 2nd by Bob Keyser
and unanimously carried, the meeting was duly adjourned at 6:05 p.m.
The next scheduled meeting will be held Wednesday , March 21, 2012 .
City of Fairhope RECREATION DEPARTMENT:
PROCESS/REQUIREMENTS TO FORM NEW SPORTS LEAGUE
1. Request and complete COF 'Formation of League' application .
2. Must be an established organization and have a quorum (minimum 3) of named board members.
3. Organization must be 'not for profit', have written by-laws, show financial responsibility (accounting
ledger), and have a written 'mission statement' or 'purpose statement'.
4. Organization must show proof of liability insurance (min. $1,000,000 value. Include with application)
upon formation and each year thereafter by Jan. 31 st
•
5. Submit completed application to Recreation Director/Tom Kuhl for review.
6. Recreation Director (or appointed committee member) will present to Recreation Board for discussion
and approval.
7. If approved by Recreation Board for consideration, prospective organization will meet with Recreation
Board by Invitation for a formal presentation and discussion.
8. Following formal presentation Recreation Board will vote to recommend or decline, and forward to
Recreation Director for final approval.

INDEMNITY AND HOLD HARMLESS AGREEMENT
In consideration of the pennission granted to me by the City of Fairhope to use the sidewalks and/or strcc1S, I hereby indemnify and
hold harmless the City of Fairhope, its agents, servants and employees from any and all claims and causes of action that may arise
from injlll')' to me or third parties using the sidewalks and/or streets who are injured or suffer property damage that is in any way
caused by my use of the sidewalks and/or streets. This indemnity and hold hannJess agreement is given to the City of Fairhope to
protect the City and its agents, servants and employees from cost of defense and claims for injuries and damages that may be caused
either directly or indirectly by my use of the sidewalks and/or streets.

Facilities Use Agreement
This agreement is made between ______________ (USER)

The "USER" agrees to comply with the following terms and conditions:

OIBER REQUIREMENTS
I. The USER will reimburse the COF for any and all damages caused to the facilities and/or the
equipment therein.
2. The USER assumes all responsibility and liability for the requested use and agrees to defend,
indemnify and hold The City of Fairhope and its agents harmless from any and all loss, damage
~r injury to any person or property arising from use of the facilities.
3. The USER agrees to obtain, at its own expense, public liability insurance in the sum of not
less than One Million Dollars ($1,000,000) and property damage insurance in the amount of not
less than One Million Dollars ($1,000,000). The USER will provide the COF with proof of such
insurance at the time of entering into this agreement, and will ensure that COF is named as an
additional insured.
4. The parties agree that the USER, its agents and employees are not agents or employees of
COF. The USER will be solely responsible and will assume full responsibility for the actions and
omissions of its agents and employees when using COF equipment or on its property. As an
independent contractor, USER is solely responsible for worker's compensation coverage of its
employees.
5. The USER will be solely responsible to provide adequate supervision of the activities
conducted in COF facilities.
6. The USER will comply with all applicable state laws and COP rules and ordinances.

RESOLUTION NO. 1775-11
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the City Council hereby proposes the following fees associated with rental of
the City of Fairhope Recreation Parks:
$50.00 per field per day
$300.00 fee per event per day to cover maintenance and personnel
$500.00 for use of W. C. Majors Field
$100.00 clean-up fee.
Any additional clean-up fees or damage fees may be assessed by the Parks and Recreation
Director if necessary.

Ninety-One Fields Honored With 2011 Fields of
Excellence® Award

Pioneer Athletics has announced the winners of their 2011 Fields of Excellence® awards . From a
pool of over 250 applicants, Pioneer selected 91 athletic fields. Of these winners , two will be
honored with a scholarship to giw to a deser-Jng student. The scholarship recipients will be
announced on Monday, February 27, 2012.
Pioneer understands that excellence in athletic field maintenance goes unrecognized and often ,
unappreciated. The fields of Excellence® award program honors outstanding athletic fields and the
hard working field crews who diligently maintain them . Toe Fields of Excellence® award program
was established in 1998 and has honored hundreds of fields since its creation.
Faced with tightened budgets and being asked to do more with less , the field crews of these
schools and organizations exemplified team work and dedication in 2011 . All 91 fields displayed a
commitment to excellence. Each recipient will be awarded a certificate of recognition and a fhlkl.§
of Excellence® banner. The winning athletic fields are:
