The City Council, City of Fairhope, met in Special Session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532, on
Monday, 29 September 2014.

Present were Council President Jack Burrell, Councilmembers: Diana Brewer,
Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City Attorney Marion
E. Wynne, and City Clerk Lisa A. Hanks. Councilmember Rich Mueller was absent.
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Councilmember Ford and the Pledge of
Allegiance was recited.
Council President Burrell addressed the City Council and explained the
proposed ordinances relating to the budget and accounts for the Sales and Use Tax
funds. He explained that there are no General Obligation Warrants mature enough to
prepay, so we are going to prepay principal debt for the Utilities.
Councilmember Brewer introduced in writing Ordinance No. 1520, an
ordinance to repeal and replace Ordinance No. 1384 and Ordinance No. 1459, an
ordinance allocating the funds collected from the City of Fairhope's Sales and Use
Tax. In order to take immediate action, Councilmember Boone moved for immediate
consideration. Seconded by Councilmember Brewer, motion for immediate
consideration passed unanimously by the following voice votes: AYE -Burrell,
Brewer, Ford, and Boone. NAY -None. Councilmember Brewer then moved for
fmal adoption of Ordinance No. 1520. Seconded by Councilmember Boone, motion
for final adoption passed by the following voice votes: AYE-Burrell, Brewer, Ford,
and Boone. NAY -None.
Councilmember Boone introduced in writing Ordinance No. 1521, an
ordinance to amend Ordinance No. 1385 known as the City of Fairhope's Sales and
Use Tax Ordinance; and to repeal Ordinance No. 1460, Section 6. Use of Proceeds.
In order to take immediate action, Councilmember Brewer moved for immediate
consideration. Seconded by Councilmember Boone, motion for immediate
consideration passed unanimously by the following voice votes: AYE -Burrell,
Brewer, Ford, and Boone. NAY -None. Councilmember Boone then moved for
fmal adoption of Ordinance No. 1521. Seconded by Councilmember Brewer, motion
for final adoption passed by the following voice votes: AYE-Burrell, Brewer, Ford,
and Boone. NAY -None.

Councilmember Ford introduced in writing , and moved for the adoption of the
following resolution, a resolution stating pursuant to Ordinance No . 1426 the City
Treasurer is the custodian of all funds of the City of Fairhope. It is hereby established
that all placement, use , and investment of City funds will be at the sole discretion of
the City Treasurer in accordance with all laws and governmental standards pertaining
to public funds. Seconded by Councilmember Boone, motion passed unanimously by
voice vote.
RESOLUTION NO. 2268-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, pursuant to Ordinance No. 1426 the City Treasurer is the
custodian of all funds of the City of Fairhope . It is hereby established that all
placement, use , and investment of City funds will be at the sole discretion of the City
Treasurer in accordance with all laws and governmental standards pertaining to
public funds . The City Treasurer will keep the Chairman of the Finance Committee
apprised of all banking activities and report to the City Council as required.

Finance Director Jill Cabaniss addressed the City Council and gave a Power
Point Presentation titled "City of Fairhope: Proposed Budget for Fiscal Year October
1, 2014 through September 30 , 2015." The following are the Budget Highlights as
presented:

BUDGET HIGHLIGHTS
• 2% cost of living pay increase for employees
• $1.3 million of the sales tax revenue wiJI be used for capital
projects
• Capital expenditures in the general fund are $1,795,260
• Capital Fund expenditures are $5.6 million-projects include $2
million soccer complex and $1 mi Ilion for soccer lights. Other
expenditures include road projects, tennis courts and an
1rrigation system for the golf course.
• City Public Utilities w111 have capital upgrades of $4,501,550-
includcs $2.2 million to finish the sewer plant upgrades with
$1.2 million to purchase vehicles and equipment.
• Payment for debt reduction for the City will be $4,854,000-
includes additional payment of $2 million for utility debt

Council President Burrell stated this budget was discussed at length; not only with
individual conferences with Mayor Kant , but in a City Council Budget meeting. He
thanked Mayor Kant, the City Councilmember, Ms. Cabaniss and her staff, and Ms.
Wilson for their work on the budget.
Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution that the proposed Budget presented and
reviewed the 29th day of September 2014, be hereby approved and adopted for the
FY 2014-2015. Seconded by Councilmember Boone, motion passed unanimously by
voice vote.

RESOLUTION NO. 2269-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the proposed Budget presented and reviewed the 29th day of September 2014,
be hereby approved and adopted for the FY 2014-2015; and
BE IT FURTHER RESOLVED that the Annual Salaries of City Personnel shall be as shown on
a list entitled Annual Salaries of All City Personnel and said list filed in the Office of the City
Treasurer; and
BE IT FURTHER RESOLVED that any cost of living or merit raises adopted in the Budget will
become effective on October 1, 2014; and
BE IT FURTHER RESOLVED that Mayor Timothy M. Kant is hereby authorized to fill all
positions that have been approved and budgeted as needed; and
BE IT FURTHER RESOLVED that the City Council hereby authorizes additional debt
principal payments for the Utilities in the amount totaling $2,000,000.00 for the FY 2014-2015 by
reducing transfers from the Utilities to the General Fund; and to offset the reduction of transfers
from the Utilities, the portion of the Sales and Use Tax revenue that is restricted in the General
Fund Debt Pre-payment Account can be used for General Fund operations up to the
$2,000,000.00 reduction; and
BE IT FURTHER RESOLVED that each Full Time employee shall receive a One Time Pay
Increase for the period 1 December 2013 through 30 November 2014; each qualifying employee
shall receive $20.00 per month of employment. To qualify, an employee must be a Full-Time
Employee during this period. An employee hired on or before the fifteenth (15th) day of a month
will be given credit for the full month; an employee hired on or after the sixteenth (16th) day of a
month will not be given credit for that month. In order to receive this One Time Pay Increase, an
employee must be employed on the 30th ofNovember.
For the same time period, and hiring rule each qualifying Part-time employee shall receive the
following: First year - $ 25.00; Second year - $ 50.00; Third year - $ 75.00; and Fourth year -
$100.00
The maximum amount for Part-time employees is $100.00.
This One-Time Pay Increase will be awarded on Friday, 5 December 2014.

Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was duly adjourned at 6:06 p.m.
