COUNTY OF BALDWIN )(
The City Council met in a Work Session at 4:30p.m.,
Delchamps Room, 161 North Section Street,
Fairhope, Alabama 36532, on Monday, 10 November 2014.
Present were Council President Jack Burrell, Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford (arrived at 5:00p.m.), and Kevin Boone, Mayor Timothy
M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
Council President Burrell called the meeting to order at 4:36p.m.
The following topics were discussed:
• Jane Finger and Molly Peterson addressed the City Council regarding the
application for a "Walk Friendly Community Designation" for the City of
Fairhope. Fifty Cities and Towns have already achieved this designation. Walk
Friendly Communities is a national recognition program that encourages cities
and towns across the United States to prioritize support for safe walking
environments. The consensus of the City Council and Mayor was to go forward
with the application and it would be a great opportunity for the City.
• Councilmember Boone said the Personnel Board would be meeting on Friday.
• Councilmember Mueller commented we should be hearing from Auburn on the
Environmental Study soon. He mentioned a solar farm was being suggested by
citizens.
• Councilmember Brewer stated the Educational Advisory Committee met last
week; and the Request for Proposals has gone out. There will be checkpoints
throughout the year; and tracking will be better. She said the deadline for the
RFPs to be in is December 1, 2014.
• Mayor Kant announced that on December 17, 2014 three presentations for the
Manley Road Soccer Complex Project Construction Manager will be presented;
and a notice for the public meeting will be sent out. He also mentioned the
Recreation Board will discuss tennis court rules and procedures.
• Councilmember Ford mentioned Recycle Day and for everyone to bring items
needing to be recycled.
• Council President Burrell mentioned the Industrial Development Board and two
companies were interested in Fairhope. He said the Airport Authority has not
met yet, but will meet next week. The Sister Cities Committee has a
recommendation for a City in Norway. He mentioned a shuttle for downtown
and showed a picture of an eight passenger street legal electric car with a cost of
$9,000.00. Mayor Kant said we are checking into the legality of using
volunteers, need to be ADA compliant; and he explained the Parking Authority
and the need to have one.

• City Attorney Wynne briefly updated the City Council on the AMIC lawsuit and
said it had been settled. The case was going to trial today, but AMIC agreed to
settle. He said AMIC will pay $600,000.00 towards legal fees to the City of
Fairhope. This was a contract dispute of legal fees. The only other ongoing case
under AMIC at this time is the Breland case.
• Dan McCrory, Water and Sewer Superintendent, addressed the City Council
regarding an update on the Wastewater Treatment Plant Upgrades. Melinda
Immel, Tim Patton, and Brian Peacock with Volkert, Inc. were here to give a
Power Point Presentation on the progress. Ms. Immel presented the "Fairhope
Wastewater Treatment Plant Upgrades (Water Reclamation Facility)
Construction Update" to the City Council. (A copy of the Power Point
Presentation is on file in the City Clerk's office)
• Jonathan Smith, Planning Director, addressed the City Council and said the
report for the Comprehensive Plan should be in by early 2015.
There being no further business to come before the City Council, the meeting was
duly adjourned at 5:31 p.m.
