HomeMy WebLinkAbout11-10-2014 City Council Meeting Minutes STATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 6:00 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 10 November 2014. 6625 Present were Council President Jack Burrell, Councilmembers: Rich Mueller, Diana Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. There being a quorum present, Council President Burrell called the meeting to order. The invocation was given by City Attorney Wynne and the Pledge of Allegiance was recited. Council President Burrell stated there was a need to add an agenda item after Agenda Item Number 11; a request from Michael Graham, Executive Director with The Haven, requesting to hold their annual Mystic Mutts of Revelry Parade on Saturday, February 7, 2015 and to close streets (Morphy Avenue, S. School Street, Fairhope Avenue, and Bancroft Avenue); and use ofthe Fairhoper's Community Park between 12:00 p.m. to 3:00p.m. Councilmember Brewer moved to add on the above mentioned item not on the printed agenda. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Councilmember Brewer moved to approve minutes of the 27 October 2014, regular meeting; minutes of the 27 October 2014, work session; and minutes ofthe 27 October 2014, agenda meeting. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Mayor Kant addressed the City Council regarding the following items: 1) AMIC lawsuit has been settled and the City will receive $600,000.00 toward legal fees relating to coverage under the policy for the claims in the Dyas suit. Now, the Dyas lawsuit items are complete. 2) Thursday is the Lighting of Trees in downtown Fairhope beginning at 5:30p.m. 3) Next Friday is the Downtown Stroll; Saturday is Movie in the Street at 6:30 p.m.; and Sunday is our 55th Open House. On December 6, 2014 and December 13, 2014 Santa will be at the Fairhope Welcome Center. 6626 10 November 2014 The following individual addressed the City Council during Public Participation for Agenda Items: 1) Edward Wall, 100 D'Olive Boulevard in Daphne, addressed the City Council regarding Agenda Item Number 5, an ordinance regarding the request to rezone the property of Julius Wall from R-4 Low Density Multi-Family Residential District to R-2 Medium Density Single-Family Residential District. Mr. Wall was in favor of the rezone; and was there on behalf of Julius Wall who was hoping for this ordinance to be approved. Councilmember Mueller addressed the City Council by saying "Go Pirates" and reminded everyone of Friday night football. Councilmember Brewer addressed the City Council regarding the Fairhope Film Festival. She was impressed by the quality of the festival and films. Councilmember Brewer gave "kudos and a shout out" to the Committee. This was our second annual festival and a great event. Councilmember Ford addressed the City Council regarding Recycle Day; and the Round-up Day Play to be held on November 15,2014 at the Colony Cemetery. Councilmember Boone addressed the City Council and said "congratulations to our very own City Clerk Lisa Hanks for being voted in as President of the Alabama Association of Municipal Clerks and Administrators. He said it is a great honor representing the State-wide Clerks. Council President Burrell commented we should give her a round of applause. Councilmember Boone mentioned Mayor Kant swore City Clerk Hanks in at the ceremony. Council President Burrell addressed the City Council and announced on November 11, 2014 at 4:45p.m. a Veterans Ceremony will be held at Henry George Park. He also thanked Councilmember Ford (Army veteran) and Councilmember Mueller (Navy veteran) for their service. He also mentioned the Veterans Day Parade. Council President Burrell recognized the Cub Scouts in the audience from the Webelos Pack 47: William Oliver, Sloan Smith, Addison Parrish, Graham Wiggins, Ashton Rowland, Owen Brasher, Andrew Grooms, Braden and Ben. Also present was Boy Scout Hayes D'Olive who was working on his Eagle Scout. Councilmember Boone moved for final adoption of Ordinance No. 1524, an ordinance to rezone the property of Julius Wall from R-4 Low Density Multi-Family Residential District to R-2 Medium Density Single-Family Residential District. This property is generally located at the northwest comer of Grand Avenue and Bon Secour Avenue, Fairhope, Alabama. Parcel ID No. 05-46-03-37-0-003-046-000. (Introduced at the October 27, 2014 City Council Meeting). 6627 10 November 2014 Seconded by Councilmember Brewer, motion for final adoption passed by the following voice votes: AYE -Burrell, Mueller, Brewer, Ford, and Boone. NAY - None. Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution that the City of Fairhope (a local MPO member government) will contribute to the twenty percent (20%) local match requirement funding a traffic signal system technology enhancements study for corridors servicing the Eastern Shore with a cost not to exceed $2,047.00. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. RESOLUTION NO. 2294-14 A RESOLUTION OF THE FAIRHOPE CITY COUNCIL TO CONTRIBUTE TO THE TWENTY (20%) LOCAL MATCH REQUIREMENT FUNDING A TRAFFIC SIGNAL SYSTEM TECHNOLOGY ENHANCEMENTS STUDY FOR CORRIDORS SERVICING THE EASTERN SHORE WHEREAS, the City of Fairhope is a member of the Eastern Shore Metropolitan Planning Organization (MPO); and WHEREAS, population projections compiled by the MPO indicate that the population on the Eastern Shore is expected to increase approximately 21% by the year 2020 and approximately 67% by the year 2040; and WHEREAS, US Highway 98 and State Route 181, as the primary north-south corridors servicing the Eastern Shore, are frequently congested with heavy traffic; and WHEREAS, the Eastern Shore MPO Policy Board has authorized the Baldwin County Commission, as administrator of the Eastern Shore MPO, to hire a consultant to conduct a Traffic Signal System Technology Improvements study to determine whether adaptive or responsive traffic signal technology can be used to enhance the efficiency of the corridors along the Eastern Shore (see Exhibit A -ESMPO Resolution); and WHEREAS, Sain Associates Consulting Engineers has prepared a fee and scope to perform the signal study within MPO Smoothed Urban Area with said fee totaling $35,822 (see Exhibit B-Fee and Scope); and WHEREAS, eighty percent (80%) or $28,658 of the total fee will be paid with left over FY13 MPO Planning Funds and the remaining twenty percent (20%) or $7,164 must be paid with contributions from the local MPO member governments; and 6628 1 0 November 2014 WHEREAS, the MPO Policy Board agreed (see Exhibit A) to equitable contribution amounts from each member government to cover the cost of the required local match ($7,164) and said amounts have since been reduced to the following due to a negotiation reduction in the total fee: • Two-sevenths (2/7) or $2,04 7 from Baldwin County • Two-sevenths (2/7) or $2,047 from the City ofDaphne • Two-sevenths (2/7) or $2,047 from the City of Fairhope • One-seventh (1/7) or $1,023 from the City of Spanish Fort; and WHEREAS, the Baldwin County Highway Department will manage the project and invoice each member government in an amount not to exceed the amounts noted above; now NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, agrees to contribute toward the required local match for the Traffic Signal System Technology Improvements study in an amount not to exceed $2,047, as set forth above, and will pay said contribution upon receipt of invoice for same from the Baldwin County Highway Department. ADOPTED THIS 1OTH DAY OF NOVEMBER, 2014 ATTEST: Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution that the City of Fairhope has voted to purchase forty (40) VieVu Body Cameras for the Police Department and the requested items are available for direct procurement through the Houston-Galveston Area Council ("H- GAC") Contract. The cost is $30,420.00. Seconded by Councilmember Boone, motion passed unanimously by voice vote. 6629 10 November 2014 RESOLUTION NO. 2295-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to purchase forty (40) VieVu Body Cameras for the Police Department and the requested items are available for direct procurement through the Houston-Galveston Area Council ("H-GAC") Contract. The cost is $30,420.00. Attest: ~4/LL ~s:Mc City Clerk Councilmember Boone introduced in writing, and moved for the adoption of the following resolution, a resolution that certain items are declared surplus and the Mayor and City Treasurer are hereby authorized and directed to dispose of personal property owned by the City of Fairhope by receiving bids and being sold to the highest bidder; except for the Police Department vests which will be donated to Ten- Four Ministries for the "Armor of God Project." Seconded by Councilmember Ford, motion passed unanimously by voice vote. Council President Burrell requested that a letter of waiver from the Ten-Four Ministries be a requirement and put in the resolution. RESOLUTION NO. 2296-14 WHEREAS, the City of Fairhope, Alabama, has certain items of personal property which are no longer needed for public or municipal purposes; and WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorizes the municipal governing body to dispose of unneeded personal property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION 1. That the following personal property owned by the City of Fairhope, Alabama, is not needed for public or municipal purposes, and hereby declared surplus: [SEE ATTACHED LIST OF EQUIPMENT] 6630 10 November 2014 SECTION 2. That the Mayor and City Treasurer are hereby authorized and directed to dispose of the personal property owned by the City of Fairhope, Alabama, described in Section 1, above, by receiving bids for such property; except for Item 21. All such property shall be sold to the highest bidder, provided, however, that the City Council shall have the authority to reject all bids when, in its opinion, it deems the bids to be less than adequate consideration for the personal property. Item 21 -Police Department Vests which will be donated to Ten-Four Ministries for the "Armor of God Project." Councilmember Brewer moved to grant the request of the Eastern Shore Optimist Club requesting permission to use the City property behind the Fairhope Public Library from November 24, 2014 through December 20, 2014; and for the Fairhope Utility Department to have the cables for the Christmas trees in place by November 24, 2014. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Councilmember Boone moved to approve the recommendation of the Street and Traffic Control Committee for the following item: •!• Requesting from the City Council authorization to place two speed calming devices on Morphy A venue to help with traffic, especially near the parks. The recommended type would slow traffic to 15 mile per hour. Seconded by Councilmember Brewer, motion passed unanimously by voice vote. Councilmember Brewer moved to grant the request of Michael Graham, Executive Director with The Haven, requesting to hold their annual Mystic Mutts of Revelry Parade on Saturday, February 7, 2015 and to close streets (Morphy Avenue, S. School Street, Fairhope Avenue, and Bancroft Avenue); and use of the Fairhoper's Community Park between 12:00 p.m. to 3:00 p.m. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. 6634 10 November 2014 Councilmember Brewer moved to adjourn the meeting.
