HomeMy WebLinkAbout07-12-2010 Regular Meeting5412 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 6:00 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 12 July 2010. Present were Council President Lonnie L. Mixon, Councilmembers: Debbie W. Quinn, Daniel Stankoski, Michael A. Ford, and Rick Kingrea, Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. There being a quorum present, Council President Mixon called the meeting to order. The invocation was given by Councilmember Dan Stankoski and the Pledge of Allegiance was recited. Council President Mixon asked if there were any corrections to the minutes from the 28 June 2010, regular meeting. He then stated if there are no corrections, the minutes stand approved as written. Councilmember Kingrea addressed the City Council regarding "Where Do We Stand" with the following issues: 1) Nichols Street Deck. City Attorney Wynne stated that neighbors to the North and South have fled a lawsuit and halted the construction. A Temporary Restraining Order has enjoined the City of Fairhope to not move forward and a hearing has been set for July 22, 2010 around 9:00 a.m. 2) Painting beds with luminary paint. Jennifer Fidler said that she has found the glisten for the flower beds and will do a trial paint on Magnolia. If this does not work correctly, the beds will be painted white. 3) Public Park at Perdido and North Mobile previously mentioned by Mr. Valentim and signage. Ms. Fidler stated that signs have been placed as requested. 4) Councilmember Ford mentioned speed limit sign between Gayfer and Fairwood on Patlynn Street. 5) The second share of BP Money use was questioned. Mayor Kant replied that we had received an additional $500,000 for protecting our coastline. Ken Eslava wants to keep it in check until we actually have oil present and then we would use smaller skimmers for our shoreline. The money must be spent by August. 5413 12 July 2010 Mayor Kant addressed the City Council and presented Barbara Davis, a/k/a "The Tomato Lady," with a Proclamation, proclaiming August 12, 2010, Barbara Davis Day. Sherry Sullivan also mentioned an event to be held in her honor being coordinated by several downtown merchants at the Community Park. This event will be Thursday on August 12, 2010 from 5:00 p.m. to 8:00 p.m. where they will be selling barbecue plates and desserts; and pre -tickets will be sold. There is also a Facebook Page to help our "Tomato Lady" out in Fairhope. Mayor Kant addressed the City Council on the following items: 1) The Fourth of July Celebration was an excellent program this year. This was one of the largest crowds in years. One firefighter was injured during the fireworks display. The cost of $7,500 for our fireworks celebration was mentioned compared to other Cities spending around $20,000 to $30,000. 2) Commended Chief Bill Press and his department on how they handled the murder of Young Street. They were able to get the man to surrender with no one else being injured. He once again thanked the Police Department. Councilmember Quinn reminded everyone to come out and vote for the State and the County. She reiterated it is very important for everyone to vote. Councilmember Stankoski briefly discussed the Open Forum held on July 6, 2010 for the Noise Ordinance and issues. There were approximately 25 people in attendance including Councilmember Kingrea and City Attorney Wynne. We had a very lively discussion from both sides of the aisle. Council President Mixon announced an Alarm Ordinance Committee will be organized. He stated that if you want to be on this Committee please contact Chief Press, Lisa Hanks, or myself (Council Liaison). City Administrator Gregg Mims addressed the City Council and mentioned there were three items that needed to be considered and voted on tonight: 1) approval to hire a part-time position for the Purchasing Department which has become vacant and is a budgeted item; 2) resolution to award the bid for the Fairhope Municipal Stadium Upgrade; and 3) resolution authorizing May Kant to include the Fairhope Municipal Stadium Upgrade in the GOW 2007. Councilmember Stankoski moved to address the following items not on the printed agenda. Seconded by Councilmember Kingrea, motion passed unanimously by voice vote. 5414 12 July 2010 Councilmember Quinn moved to authorize the hiring of a part-time position for the Purchasing Department. The motion was seconded by Councilmember Stankoski. Councilmember Kingrea questioned the hiring and asked if we could wait until the next fiscal year. Mr. Mims explained this department is short-handed and we do not need to wait. He also mentioned if we could wait, this would not have been brought to the City Council. After further discussion, the motion passed unanimously by voice vote. Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Timothy M. Kant to include the Fairhope Municipal Stadium Upgrade in the Bond Issue 2007. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. RESOLUTION NO.1669-10 WHEREAS, the City of Fairhope issued General Obligation Warrants, Series 2007 in May 2007 for certain recreational projects; and WHEREAS, the following projects shall be included in the Bond Issue 2007: • Fairhope Municipal Stadium Upgrade -------- $150,450.00 NOW BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to include the Fairhope Municipal Stadium Upgrade in the Bond Issue 2007. DULY ADOPTED THIS 12TH DAY OF JULY, 2010 Attest isa A. anks, City Clerk 5415 12 July 2010 Councilmember Stankoski introduced in writing, and moved for the adoption of the following resolution, a resolution to Award Bid for the Fairhope Municipal Stadium Upgrade (Bid No. 026-10). The motion was seconded by Councilmember Quinn. Councilmember Kingrea questioned the use of house movers for this project. Matt with Volkert, Inc. addressed the City Council regarding Ducky Johnson House Movers, Inc. and stated he also questioned this company. The technique was discussed in detail and the cost was less than other bidders because the company used house moving equipment which forgoes the crane rental. Matt said Volkert would be monitoring the work for this project. After further discussion, the motion passed unanimously by voice vote. RESOLUTION NO.1670-10 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [ 1 ] That the City of Fairhope did request, receive, and open emergency bids for the Fairhope Municipal Stadium Upgrade (Bid Number 026-10) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama. [2] At the appointed time and place, the following bids were opened and tabulated as follows: Please see attached Bid Tabulation for the Fairhope Municipal Stadium Upgrade [3] After evaluating the bid proposals with the bid specifications, Ducky Johnson House Movers, Inc., with the total bid proposal of $107,450.00, is now awarded the bid for the Fairhope Municipal Stadium Upgrade for the City of Fairhope. PurChW" Mapes — Mayor Kant addressed the City Council and presented a plaque to Charles Johnson for his 12 years of dedicated service on the Personnel Board. 5417 12 July 2010 Councilmember Stankoski introduced in writing, and moved for a resolution setting forth Fee Waivers of Organizations at the Fairhope Civic Center, the James P. Nix Center, and Streets and Parks. The motion was seconded by Councilmember Ford. Councilmember Stankoski stated this was done looking at partial cost cutting and having the same policy for all organizations. This will eliminate picking and choosing which organization will be approved for fee waivers. Everyone will know what the policy is before requesting the waiver. Councilmember Quinn said her issue with the resolution is the wording "Fairhope based and gives back to Fairhope based organizations. She commented other organizations help the County and we need to put more thought into this part. Councilmember Quinn moved to amend the resolution by changing the wording in paragraph one to "Organizations must show proof of their 5016 and proceeds must benefit a Fairhope based organization or organizations." City Attorney Wynne stated it might be better to say citizens instead of organization or organizations. Councilmember Quinn restated the motion to "Organizations must show proof of their 501 c3 and proceeds must benefit Fairhope citizens." The motion was seconded by Councilmember Kingrea. Councilmember Ford questioned the Fairhope based and the all proceeds part of the resolution. Councilmember Quinn replied we should not beat up on 501c3s. After further discussion and need for more work on wording for the resolution, this item was tabled until the next regular City Council meeting. Councilmember Quinn introduced in writing, and moved for the adoption of the following resolution, a resolution to Award RFP for a CAD/RMS System for the Fairhope Police Department (Bid No. 019-10). Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. 5418 12 July 2010 RESOLUTION NO. 1671-10 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope did request, receive, and open RFPs for a CAD/RMS System for the Fairhope Police Department (Bid Number 019-10) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. Dan Ames, Purchasing Manager, explained why only one bid was being presented and that in fact three bids were received. This was the only bid which was complete and followed our required bid specifications. Ames, Purchasing Manager Councilmember Quinn moved to grant the request of Michael Graham, Executive Director of The Haven, requesting permission the use and waiver of fees associated with the Fairhope Civic Center on September 23, 2010 from 6:00 p.m. to 9:00 p.m. to host an informational meeting for the humane society. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. 5422 12 July 2010 Councilmember Kingrea moved to grant the request of Stan Grubin, Co -Chair for the Christmas Parade Committee, requesting permission to change the date of the Fairhope Christmas Parade to Saturday, December 4, 2010. The motion was seconded by Councilmember Ford. Councilmember Quinn stated that this was talked about years ago and decided this has been on the first Friday since the 1960s. Everybody knew it was the first Friday. After talking with downtown merchants and parents, Mayor Kant said the reason he recommended the change was to keep more activity downtown and help parents with not having to rush to get their children to the parade at the last minute. This will be better for the families. After further discussion, motion passed by the following voice votes: AYE — Stankoski, Mixon, Ford, and Kingrea. NAY - Quinn. A citizen questioned if the Fairhope Municipal Stadium would be ready for the football season. City Administrator Mims replied yes it would be ready. Ron Allen, 435 Liberty Street, addressed the City Council and stated he has come to a number of Council meetings and this was the most informative meeting he has attended. The Council President did an excellent job explaining the resolutions and what would be voted on; and the Council comments were very good. Mr. Allen stated he just wanted to commend the Council.
