STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 27 October 2008.
Present were Council President Robert C. Gentle, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford, Mayor
Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Gentle called the meeting to
order. The invocation was given by Dr. Paul Fowler, Pastor of Eastern Shore
Presbyterian Church, and the Pledge of Allegiance was recited. Councilmember Ford
moved to approve minutes of the October 13, 2008, Regular City Council meeting
and the minutes of the October 14, 2008, Special City Council meeting. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote to approve
the minutes of the October 13, 2008, regular meeting. Motion approving the minutes
of the October 14, 2008, special meeting passed by the following voice votes: AYE —
Quinn, Christenberry, Ford and Gentle. NAY — None. ABSTAIN - Stankoski.
Sherry Sullivan made the following announcements:
• Veteran Day Parade will be held Saturday, November 8, 2008 and will begin
at the Fairhope Civic Center at 10:00 a.m.
• Flu Shots will be given on Thursday, November 13, 2008 from 10:00 a.m. to 6:00
p.m. at the James P. Nix Center - Open to the Public. The cost is $15 per shot or
bring your Medicare Card.
• City of Fairhope Annual Tree Lighting Celebration will be on Thursday, November
20, 2008 at 5:30 p.m., The Lights on at 6:00 p.m. - Downtown Fairhope.
• November 15, 2008 will be Round -up Day in Fairhope at the Fairhope Museum from
6:00 p.m. to 9:00 p.m. This is also National Amnesty Day for recycling.
Mayor's Comments and Staff Reports:
• Mayor Kant presented Council President Robert C. Gentle and
Councilmember Cecil Christenberry proclamations for their service on the
City Council for the past eight years. The City Council has accomplished a
great deal in these eight years. On behalf of everyone, we would like to thank
both of you. My hat is off to the two of you!

• Nancy Wilson, City Treasurer, presented a power point presentation on the
Cash Funds. Ms. Wilson stated that the City did receive $1,267,000 in
September for the property taxes from the County. The revenue is up which is
partly from the rate increase in the utilities and the hot months that were billed
previously. Council President Gentle explained to the media that the City
took out two lines of credit a few years ago. A two million line for the
General Obligation Warrants (GOW) and a two million line for the Utility
Revenue Warrants (URW). Mayor Kant mentioned he would be in the office
all day Friday if the Councilmembers and the newly elected Councilmembers
wanted to go over any budget items.
Joe Birindelli addressed the City Council and gave a brief history on Bob Fass
who was recommended as the Veteran of the Year. Mayor Kant presented Bob Fass
as City of Fairhope Veteran of the Year for 2008. The following is the press release
on the Bob Fass story:
Mr. Fass, a Fairhope resident, served in the Army from 1963 to 1975. He
served 3 1/2 tours in Vietnam plus tours in the Dominican Republic and
Nigeria. While in Vietnam, he served as a Green Beret with the Special
Forces Division. He retired as a Major due to medical injuries he suffered in
Vietnam. While in service, Mr. Fass received the Distinguished Service
Cross (the second highest award given, only second to the Medal of Honor),
the Silver Star, the Bronze Star of Valor and Four Purple Hearts. Bob's
service did no end after retirement. He has spent the past 20 years in
volunteer service to other veterans and is currently handling over 700 cases
for veterans who have filed disability claims from the VA. His selfless
service is helping veterans of World War II, Korea, Vietnam, Iraq, and
Afghanistan fight the VA bureaucracy to obtain the services these men and
women have earned serving our country.
Councilmember Christenberry addressed the City Council and recognized the
Carroll Place Centenarian residents who were inducted into the Alabama Senior
Citizens Hall of Fame. These four residents will also be recognized at our annual
Tree Lighting Celebration. They will flip the switch at the celebration which will be
held on November 20, 2008. The following are the inductees in to the Alabama
Senior Citizens Hall of Fame: Christine Bergen — 102, 011ie Staggs — 102, Bernice
O'Callahan — 101, and Ema Davis — 100.
Councilmember Stankoski introduced in writing, and moved for the adoption
of the following resolution, a resolution lifting the moratorium on annexations due to
the 2008 Municipal Election and Run -Off Election, and to allow annexations
concurrent with rezones to begin during the month of November 2008, and resume
regular quarterly scheduled annexations in January 2009. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.

RESOLUTION NO. 1468-08
MORATORIUM ON ANNEXATION
WHEREAS, The City of Fairhope currently conducts annexations on a quarterly basis: The
Second City Council meeting of January, April, July and October; and,
WHEREAS, It is required by law to have a clearance letter from the U. S. Department of
Justice, Civil Rights Division, Voting Section, Washington, DC on all annexations; and,
WHEREAS, A Municipal Election was held August 26, 2008, and a Run-off Election was
scheduled for October 7, 2008, if necessary.
WHEREAS, the City's regular scheduled annexation is July 28, 2008. There would not have
been ample time to receive the required clearance letter from the U.S. Department of Justice;
and,
THEREFORE, The City Clerk is requesting of the Governing Body of the City of Fairhope,
Alabama, to place a moratorium on annexations effective May 1, 2008 - January 1, 2009.
The City will conduct regular annexations on January 26, 2009.
BE IT FURTHER RESOLVED, That the City of Fairhope scheduled Run-off Election was
held on October 7, 2008 and the votes canvassed on October 14, 2008. Therefore I Lisa A.
Hanks, City Clerk of the City of Fairhope hereby requests that the moratorium placed on
annexations be lifted immediately, and allow annexations concurrent with rezones to begin
during the month of November 2008, and resume regular quarterly scheduled annexations in
January 2009.
This duly adopted Resolution shall be published once in the local Gulf Coast Newspaper.
Adopted and Approved this the 27th Day of October, 2008.

City Council reviewed an application for a Restaurant Liquor License by
Stephen Hamburg, President of Hamburg Enterprises, Inc. d/b/a Mateers on Church
Street located at 14 N. Church Street, Fairhope, Alabama. Councilmember
Christenberry moved to approve the issuance of the license. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
Karin Wilson from Page & Palette addressed the City Council requesting to
hold their annual Dancin' in the Streets, their first annual Runnin' in the Streets, to
serve alcohol at the Dancin in the Streets, and to waive the fees associated with the
closing of the streets. Sherry Sullivan, Director of Senior Services, stated that this is
a great fit for us. This will tie into the New Year's Eve celebration. Ms. Wilson
stated that they had made over $140,000 for Fairhope education and Outward Bound.
This event brings over 1,000 people to Fairhope. Ms. Wilson said she met with Lt.
Joe Petties and he suggested looking into the Sheriff's Department to help or a
security company for the event. She said they always pay for their security and
obtain an insurance rider for the event.
Assistant Police Chief Steve Griffis stated he was okay with her request, but the
Police Department has had numerous street closing events with free police on an
overtime rate. He said the department was over budget $76,000 and special events
totaled $64,000 of it. The run is the issue not the dance and celebration. The Chief of
Police is ultimately responsible for streets and intersections. Ms. Wilson stated the
run would be held mainly in the Fruit & Nut section and starts at 3:00 p.m.
Council President Gentle stated that New Year's Eve has so much going on that a run
will interfere with all the activities. Councilmember Quinn said almost all is
residential and I don't have a problem with it. All the funds go with schools and
outward bound. After further discussion, Councilmember Quinn moved to grant the
request of Karin Wilson, Page & Palette Foundation requesting permission to close
streets for Dancin' in the Streets prior to 5:00 p.m., hold their first annual Runnin' in
the Streets, serve alcohol at the Dancin' in the Streets, and waive the closing of the
streets fee. The Fairhope Police Department will oversee these events held in the
streets of the City of Fairhope. Seconded by Councilmember Stankoski, motion
passed unanimously by voice vote.
Councilmember Stankoski addressed the City Council and stated that in 2
weeks the New Council will change hands. Citizens are tired of the negativity and
want the Mayor and City Council to work together. We will have a new Council
President. The citizens of Fairhope want transparency. I am asking the Mayor and
Council to work for the good of the City of Fairhope. The next four years there will
be ups and downs. Change is coming and we need to adjust to it. Once a vote has
been taken and passed, accept it, and keep going for the good of Fairhope.

277/480 volt. Dan Ames, Purchasing Manager, explained that the specifications for
the bid were not met by the vendors. Seconded by Councilmember Stankoski, motion

Councilmember Stankoski moved to reject all bids for the Electric Department
on Bid No. 025-08 for various single phase padmount transformers and three phase
padmount transformers. Dan Ames, Purchasing Manager, explained that the
specifications for the bid were not met by the vendors. Seconded by Councilmember
Christenberry, motion passed unanimously by voice vote.

Councilmember Ford moved to authorize Dan Ames, Purchasing Manager, to
Purchase Transformers for the Electric Department. Mr. Ames said the cost is over
the $7,500.00 threshold requiring City Council approval. These items are used
normally and needed by the Utilities. We will get three quotes and the lowest
responsible bidder will get the purchase order. Seconded by Christenberry, motion
passed unanimously by voice vote.
Councilmember Quinn addressed the City Council and mentioned the NLC
was working with pharmaceutical companies for uninsured or under insured citizens.
They are offering a prescription card to be used at all major stores (pharmacies)
throughout the United States. She said you must be a citizen of a NLC city. Fairhope
is a member of the NLC.
There being no further business to come before the City Council, the meeting
was duly adjourned at 6:25 p.m.
