Present were Council President Robert C. Gentle, Councilmembers: Debbie W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford, Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. There being a quorum present, Council President Gentle called the meeting to order. The invocation was given by Reverend Joseph Bullington, pastor of Fairhope United Methodist Church and the Pledge of Allegiance was recited. Councilmember Stankoski moved to approve minutes of the June 23, 2008, regular meeting. Seconded by Councilmember Ford, motion passed by the following voice vote: AYE — Stankoski, Christenberry, Ford, and Gentle. NAY — none. ABSTAIN - Quinn. Sherry Sullivan made the following announcements: • Fourth of July Celebration and Fire Works — The City of Fairhope thanked the Fairhope Volunteer Fire Department for all of their hard work. • The Fairhope Outdoor Market last day will be Thursday evening, July 17th, from 4:00 p.m. to 6:00 p.m., Downtown Fairhope on Church Street. Mayor's Comments and Staff Reports: • Nancy Milford, City Planner, addressed the City Council and discussed the options for Scenic Highway 98 and Nelson Road. Ms. Milford asked for a recommendation from the City Council as to whether to pursue grants to purchase the land from David Ryan for a City Park. David Ryan has property located at the comer of Scenic Highway 98 and i CPA Nelson Road. He has offered to sell his property to the City of Fairhope for the purposes of a City Park. Mr. Ryan has expressed his willingness to sell this site to the City of Fairhope with the assurances the site will be 1) a perpetually maintained City park. -Y C.M.O. There possibility that three grants can be solicited for potential funding for the purchase and development of the site as a park. These grants are as follows: CMO ♦ Land, Water, Conservation Fund: 50150 match; Maximum $100,000; can k.c.M.o. be used for acquisition and development, September 2, 2008 final submittal ^► date ♦ Recreational Trails Program: 80/20 match, Maximum $125,000, can be used for acquisition and development, September 2, 2008 final submittal date. ;� ♦ 306A Public Access Improvement Grant Application for public access !" work: 50/50 Match; Maximum $25,000. To use the above -listed grants for property acquisition, the property could not w Mac j ; be purchased prior to the Grant Awards. The most likely option would be for Staff to pursue these grants in phases and explore the best use of these grants on this particular site. The City Council could also utilize the Park and *�1•. Recreation Impact Fee. Staff would like to know if this is a direction the Council would like to pursue. iY` ! Ms. Milford replied it is possible, but the Alabama Department of Economic and Community Affairs (ADECA) grants should be prepared in phases. Mayor Kant stated a study was done regarding protecting our wetlands and this possible purchase would fall into this privy. Councilmember Ford asked; when will we know if we have the grant. Ms. Milford replied that the money is not as predictable as before. It used to be only one month and now it is around six months. Councilmember Christenberry asked if Mr. Ryan was willing to work with us. Mr. Ryan replied yes. Council President said; "I think it is a good idea to move forward." Councilmember Quinn stated she will be meeting with ADECA and will find out when monies will be available. Council President Gentle introduced in writing Ordinance No. 1366, an ordinance setting compensation for absentee election manager. In order to take immediate action, Councilmember Quinn moved for immediate consideration. Seconded by Councilmember Stankoski, motion for immediate consideration passed unanimously by the following votes: AYE - Quinn, Stankoski, Christenberry, Ford and Gentle. NAY - none. Councilmember Quinn then moved for final adoption of Ordinance No. 1366. Seconded by Councilmember Christenberry, motion for final adoption passed unanimously by the following votes: AYE - Quinn, Stankoski, Christenberry, Ford and Gentle. NAY - none. Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution to present an application to the Alabama Department of Transportation (ALDOT) for the Transportation Enhancement (TE) Projects for FY2009 for grant assistance with the Greeno Road Side Improvements. Seconded by Councilmember Quinn, motion passed by the following votes: AYE — Quinn, Stankoski, Ford, and Gentle. Councilmember Christenberry recused himself. 4615 14 July 2008 RESOLUTION NO. 1453-08 WHEREAS, The City of Fairhope proposes to construct sidewalks along Greeno Road (U.S. Highway 98) to be used for pedestrian traffic adjacent to a main thoroughfare through the City of Fairhope. The project will begin near the intersection of U. S. 98 and Southland Boulevard, run north from a residential area and connecting Fairhope High School into the most commercially driven area of the city, and terminating at the Spring Run Road intersection. The sidewalk will be constructed along the east side of Greeno and will run parallel with the road inside State right -of —way; and WHEREAS, The City of Fairhope intends to present an application to the Alabama Department of Transportation (ALDOT) for the Transportation Enhancement (TE) Projects for FY 2009 for grant assistance on the Greeno Road Side Improvements; and WHEREAS, said programs are limited to funding a maximum of eighty percent (80%) of the proposed project costs, which are estimated at $450,000.00 which will be use used to develop the land consisting of a six (6) foot sidewalk which will serve as an organizational transportation control device; and NOW THEREFORE, BE IT RESOLVED that the City of Fairhope holds in reserve twenty percent (20%) of the proposed projected cost for the purpose of matching the Transportation Enhancement (TE) Projects for FY 2009 grant assistance; and BE IT FURTHER RESOLVED, that in the event a grant is awarded, the City of Fairhope understands that it will sign assurances to comply with all of the applicable Federal and State laws, rules and regulations. Councilmember Quinn stated the mission statement is a vast umbrella for the City. Mayor Kant told the City Council that the mission statement the FEAB wants to add on to was created by the city managers for the annual budget. Council President Gentle told the FEAB that the City Council will take it under advisement. Councilmember Stankoski asked; how much will it cost to correct the Winn Dixie Detention Pond. Ken Eslava, Assistant Public Works Director, replied between two hundred thousand and three hundred thousand. Bobby and Debra Green addressed the City Council regarding the Greeno Road Median Project and Green Nurseries and Landscape Design, Inc. Mrs. Green gave letters from the medical community to Council President Gentle. The following letters from Dr. Hermecz and Dr. Dearing were requested by Mrs. Green to be included in the minutes: TO: Mayor Tim Kant The Fairhope City Council FROM: Vernon L. Hermecz, M.D. RE: Greeno Road obstacles DATE: July 13, 2008 As an Emergency Room Physician with 30 years of experience, I have seen the results of multiple types of injury and the pain that it causes to both patients and their loved ones. Some health issues come by no fault of their own. Others can be directly related to neglecting their bodies, or injuries can come at the hands of others. There is an old adage that says that prevention is the best medicine. Sadly, the City of Fairhope is not only neglecting to prevent potential serious injury, it is actually inviting it in the front door. The planting of trees in most cases is a noble cause and environmentally wise. However, the insertion of trees in the middle of Greeno Road is absolutely and completely counter to all rules of safety. Vehicles traveling at even moderate speeds run the risk of collision, and passengers are substantially more liable to experience serious bodily harm if such an impact should occur. Considering the frequency of rainfall in this area, the increase in traffic on Highway 98 in recent years, and the addition of more businesses on the north corridor into the city this plan needs to be reconsidered. There are already enough accidents, the victims of which come into our Emergency Room for care. Some of these end in tragedy. Many a tree has been removed from roadways all across the country in order to remove dangerous obstacles from the path of automobiles. In Fairhope, we have made a conscious choice to actually add these dangers to one of the busiest roads in Baldwin County, a decision that should be repealed immediately. The patients I see in the Emergency Room with injuries resulting from car accidents are frequently related to alcohol or illicit substances while traveling at high rates of speed. The trees will not slow these people down. The average driver traveling at ten or fifteen mph over the speed limit is not the problem. Whether drivers are following the posted speed limits or not, hitting a tree could increase the likelihood of serious injury. Most of the accident victims I see are from situation where people have stopped in the roadway at lights or to make turns and are struck from behind. This planting actually limits the space where drivers can move to make their turns or avoid a collision. 4619 14 July 2008 In addition to the obstacles these trees will create for the average traveler, the problem is exponentially increased for large vehicles, particularly emergency vehicles such as ambulances and fire trucks which must maneuver around cars that pull to the sides of the road in order to allow them to pass. This serious situation already exists on North Section Street with the center tree plantings. And for bicyclists? The trees will put a squeeze on the road space much like the misguided addition of flower beds jutting into the downtown streets forcing bicyclists to veer into the traffic lanes. As a native of Fairhope, it is a pleasure to see the City make an effort at beautification. But the taxpayers have enough flowers to water and replant already. The extra cost of this "beautification project' is objectionable. The idea of explaining it as a forced method of speed reduction is ill-advised and foolish and will ultimately be ineffective. Fairhope is beautiful as it is, and needs no more flower beds, nor do the taxpayers. The benefit of this tree project is doubtful at best, exposes the citizens to needless danger and the City to needless liability. Mayor of Fairbopo 4620 14 July 2008 Mrs. Green said Dr. John Rodriguez Feo requested her to relay the following comment; indicating he has contacted numerous Councilmembers, City Attorney Wynne, and others expressing his opposition to the Greeno Road Project. Mr. Green stated that Green Nurseries has been in business since 1932. He briefly went over access to the nursery and said from the South access is not possible. Mrs. Green said she spoke with Gregg Mims, Director of Planning and Volkert & Associates at the April 30, 2007 meeting and expressed concerns of the access. She stated they were told there would be opportunities to give their opinions. She mentioned that the "thank yous" were not for the access, but for the e-mails from Mr. Mims. Mrs. Green told the City Council that Volkert & Associates and ALDOT said there were no objections from anyone. Mrs. Green said, "You are putting us out of business." The following are the documents requested by Mrs. Green to be included in the minutes: 4621 14 July 2008 July 14, 2008 Honorable Council President Honorable Council Members: RE: Greeno Improvements Project Green Nurseries and Landscape Design, Inc. Honorable Council: We own and operate Green Nurseries and Landscape Design, Inc., 415 N. Green Road, Fairhope, Alabama. The project plan, presented to us on July 11, 2008, and indicated as the Final Plan, includes the omission of our business access point. Our objections were stated and submitted in writing. However, we were completely unaware of our access point omission until May 26, 2008, after this Honorable Council awarded the project bid to Summitt Industries. Therefore, through this document, we hereby respectfully request the return of our Green Nurseries and Landscape Design, Inc. access point. The facts and rationale for same are as follow: 1. In 1995, negotiations, during the widening of Greeno Road, Bobby Green, Green Nurseries and Landscape Design, Inc., and representatives of ALDOT, agreed the nature of our agricultural business required a "Commercial Access" for larger vehicles. This is what ALDOT installed. ALDOT Contact: Mr. C. A. Robinson, Jr., ALDOT Mobile Division, Right -of -Way Engineer 2. April 30, 2007, the City of Fairhope presented an informal "Public Involvement Meeting" regarding the Greeno Road Improvements, held in the City of Fairhope Council Chambers. 3. We attended this meeting, and were informed through a form letter forwarded by the City of Fairbope. (Attachment #1) 4. Upon review of the plan, we became aware of the omissions of both our access points at the Green Nurseries location as well as into our residential area, Live Oak, had been completely omitted. S. During this Informational Meeting, we voiced our concerns over the omission of the access points and submitted them in writing through a form provided and left with meeting representatives. 6. Greg Mims, and Volkert representatives stated the plan as presented was only the "initial architectural rendering", there would be alterations, our concerns would be addressed and considered, and we would be afforded opportunities for additional input and to attend future meetings. 4622 14 July 2008 July 14, 2008 Fairhope City Council Page 2 of 4 Green Nurseries and Landscape Design, Inc. Access Point/ Greeno Median Improvements 7. On May 3, 2007, a letter including a comment form outlining our specific concerns regarding the access omissions and expectations of future meetings was hand delivered to the office of Mr. Gregg Mims. (We have been informed through a 7/7/08 request for public information there is no record of these documents). (Attachment #2) 8. We were never made aware of ANY additional opportunities for public input or to attend meetings. 9. On May 24, 2007, during a Traffic Committee Meeting, the omission to the access point closure at Live Oak was discussed. With the exception of April 30, 2007, the access point at Green Nurseries was never discussed or mentioned in any respect during neither any meetings with the City nor any other Traffic Committee Meetings until June, 2008, instigated by us. (This access omission relative to LIVE OAK, in addition to a redesign of the curb, as suggested by Mr. Mims, served as OPTIONS for consideration towards our efforts in preserving a residential community from commercial encroachment.) (Attachment #3). 10. May 26, 2008 it was discovered, without any notification or contact from Fairhope City Personnel, Volkert Engineering or ALDOT, OUR GREEN NURSERIES AND LANDSCAPE DESIGN, INC. ACCESS POINT HAD BEEN COMPLETELY OMITTED. THE DISCOVERY WAS MADE DURING COUNCIL MEETING DISCUSSIONS AFTER THE BID WAS AWARDED. 11. May 27, 2008, through July 11, 2008, in attempts to determine exactly how our access points had been omitted, without our knowledge, Mayor Kant, Council Members, and ALDOT were contacted through multiple emails and/or phone calls and/or office visits. 12. Mayor Kant has not replied to a single email nor has he returned eight telephone calls. After three attempts to see him personally, he has never been available in his office. 13. May 30, 2008 Debra had a conference call with Gregg Mims and Ken Eslava. Gregg's "planning" rationale was understood; however, it was made very clear to both he and Mr. Eslava our business could not operate without an access as we were a farm entity, inclusive of large equipment, trucks with trailers and 18 wheeled vehicles. (Attachment #4) 14. An email in annreciation of Mr. Mims time was forwarded; however, never was it implied we agreed to the loss the loss of the business access. June 2, 2008 Volkert Engineering and ALDOT advised they had assurances from the City of Fairbope we had absolutely no opposition to the loss of our access points. 16. June 2, 2008, Nick Amberger, ALDOT Mobile Division, further elaborated and advised had ALDOT been aware of our opposition and concerns, they would have been seriously considered and addressed. ALDOT further advised the access closure was a decision made by the City of Fairbope and can be returned at their request. 17. Information provided to ALDOT by the City of Fairbope does not include any documents related to our objections, comments or concerns over the omission of our access points. (Attachment #5) 18. Information provided ALDOT by Volkert Engineering indicates no additional closing of the median "after the first meeting", but only additional openings were added at the request of public or the ALDOT's 9'" division. (Attachment #6). 19. June 9, 2008, we attended a Traffic Committee meeting; we addressed this issue, without resolution. 20. June 24, 2008, median construction begins. ALDOT/Volkert could not advise rationale for construction beginning in what appeared to be "mid section". 21. June 26, 2008, Councilman Stankoski advises July 14, 2008 Council Agenda placement towards resolution of access loss. 22. July 7, 2008, requested July 14, 2008 Council Agenda Placement and request for public records/information including how and when any and all meetings relative to the Greeno Median Project were announced, advertised or otherwise promoted for public attendance including documentation for same. (Attachment #7) 23. July 7, 2008, we advised Council President Gentle of agenda placement request. We further advised we were extremely concerned construction would continue along our business prior to July 14. Verbal assurances were given by Mr. Gentle the City would hold off until after the July 14, 2008 Council Meeting. 24. July 89 2008 construction begins in front of Green Nurseries and Landscape Design. Council President Gentle requested construction to stop, and move further north. Mayor utilizes executive privilege to countermand the request. 25. July 11, 2008 City provided information relative to request for public records/information, including final plan. This happens already, often In the late afternoon when Greeno southbound traffic backs up at the Greeno/Gayfer traffic right, cars cut to the right and fly down Live Oak/Maple only hoping to make the turn to the right or left at Gayfer faster. In the mornings, 7:30 — B:OOam traffic on Gayfer heading east who get stuck at light like to cut to the left on Maple and fly up to Live Oak and hope to turn left (Northbound) before the light turns. The median would eliminate the morning culprits which makes me very happy. The curb cut would be very much appreciated and would show those of us living in and around all these changes that the city council/traffic committee does wish to protect our neighborhoods. Having Just the median will only encourage the southbound traffic to him right onto Live Oak/Maple in order to beat the longer traffic light at Greeno/Gayfer. it's a perception thing. Bob Gentle recommended denial of creating a cul de sac and Cecil Christenberry agreed. Bobby Green provided a letter dated November 7, 2007 requesting placement of "No Through Street," "15 MPWSlow Children at Play," or "No Construction Vehicle Traffic" signs be considered. Jennifer Fidler advised a "No Construction Vehicle" sign would be placed on Maple. Jennifer Fidler advised the "greening of Greeno Road" project is on -going. This project may alleviate some of the traffic concerns as a median will be put on Greeno Road at Live Oak restricting some flow of traffic to Live Oak. This area will be referred to City Planning. After discussion, it was the recommendation of the Committee to request the police department do a third traffic survey at Live Oak and Maple with emphasis on school being in session and early morning and afternoon traffic. In 2001, the Greeno Road Project began regarding the concerns of what Greeno Road looked like and the main issue was pedestrian improvements. Jamie Lyles from Volkert & Associates addressed the City Council and began by stating there were several meetings with the City and ALDOT. Modifications would not be approved by ALDOT. This would change the whole plan and would not meet ALDOT's specifications. Mr. Lyles said they avoided the most populated business district with this plan. Councilmember Christenberry stated we cannot make a decision, but could go back to ALDOT and ask. Councilmember Stankoski asked; what is the standard road cut. Mr. Lyles replied 200 plus feet. Councilmember Ford asked; "are you saying there is no hope for the Green? Is there some way to work this out? Do you have access to your property from Dyer Road?" Mrs. Green replied no. City Attorney Marion E. Wynne asked; what are the specific specifications? Mr. Lyles said a road cut would not be approved because of two other intersections — Dyer and Gayfer. Councilmember Ford asked if there is another entrance at Dyer Road and questioned where the trucks turned around now. Mr. Green replied that trees would have to be removed and the road is not paved. Council President Gentle asked; how many trucks do you have a week? Mrs. Green said our primary access is U. S. 98. Mr. Green replied two to three per week, but other times of the year sometimes two a day. He told the City Council "if entrance is left open, it would be a continuance to Hoyle. Our entrance is so close to Hoyle, it could have been left alone." Councilmember Ford asked; how far away is your property to Dyer Road? Mr. Green replied 260 feet. Mrs. Green stated you all are talking about solutions that would cost a great deal of money. Mayor Kant said it is either some or none for the medians. Councilmember Christenberry stated that if we chose to put that out, then we would be heroes. It makes me feel guilty. Mayor Kant said we need to look at the better good for the community. We have gone through the whole process and have the approval of the Governor. Councilmember Ford stated that he was told that only a rural road could have a median and not in urban areas. Mr. Mims mentioned that the Highway 181 median project was approved. When you get closer to Fairhope Avenue, you just hold your breath. Councilmember Ford said you are cutting people off; we made a mistake. Councilmember Quinn asked what does this do to the rest of the plan if we leave a road cut for the Greens. Mayor Kant replied you would have to do the same thing for Vision Bank. I think we should complete the median project and see how it goes. 14 July 2008 Councilmember Stankoski said he agreed with Councilmembers Ford and Christenberry. He stated that this is the first time I have seen this document objecting to the median and have a problem with Mrs. Green not saying anything until a couple of weeks ago. Mr. Mims stated he had conversations at length with Debra Green and received a memo from her, dated May 30, 2007, regarding good buffers and green space saying the median made her feel secure. We held a meeting for Bones & Babies and referred to the Greeno Road Median Project. Concerns were with commercial traffic. Mrs. Green said we are not trying to regulate traffic. Councilmember Quinn moved to stop the project at Green Nurseries, continue project North of Dyer Road, and schedule a meeting with City Staff, ALDOT, several City Councilmembers, and the Greens to try and find a resolution to the median issue. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Councilmember Christenberry asked what happens if ALDOT says no. City Attorney Wynne stated for the city's sake let's move quickly; "If we are messing with the way they are doing the job, there may be financial obligations to the companies." Council President Gentle asked Mr. Eslava; do you think they would be receptive to moving? Mr. Eslava replied he didn't think there would be a problem since they were willing to do the same on Friday. Larry Stejskal, 217 Simon Street, Fairhope, Alabama, asked to be heard by the City Council. He requested the City Council to not have meetings that citizens cannot attend, like at 8:00 a.m. He said to please schedule when we can attend. City Attorney Wynne told the City Council, "time is of the essence, so have the meeting as soon as possible."
