The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Councikhamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 14 April 2008.
Present were Council President Robert C. Gentle, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford, Mayor
Timothy M. Kant, City Attorney Marion E. Wynne, and Assistant City Clerk Lisa A.
Hanks. City Clerk Geniece W. Johnson was absent.
There being a quorum present, Council President Gentle called the meeting to
order. The invocation was given by Associate Pastor Jeff Ingram, of First Baptist
Church, and the Pledge of Allegiance was recited. Councilmember Quinn
moved to approve minutes of the March 24, 2008, regular meeting. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.
Council President Gentle made the following announcements:
• Community Blood Drive with Life South Community Blood. Services will be
held Wednesday, April 30, 2008 at the Nix Center from 9:00 a.m. to 5:00 p.m.
Mayor's Comments and Staff Reports:
• Mayor Kant announced the appointment of Frain Faust Slade to the Planning
& Zoning Commission to serve a six -year term thereby filling the vacancy per
the resignation of Ed Brinson. This term will run. until April 2014.
• Jennifer Fidler, Director of Public Works, addressed the City Council and
presented a status report on the following items:
(1) Public Improvements on North Section from Bayou to Oak: The median
project was part of the Gorriian Schaffer traffic study presented to the City of
Fairhope in March 2007. The objective was to slow traffic down through
Fairhope. There is no curbing which will allow water to flow without backing
up. The total cost is $2,200.00 with the trees being donated.
(2) Highway 104 .from Veterans Drive to Greeno Road will be closed
tomorrow to traffic. We will Begin with the intersection improvements at
Highway 104 and Greeno Road. Councilm ,tuber Quinn asked if the residents
were notified of the clo..ure. Ms. Fidler replied yes.

(3) The parking garage construction will start on Monday, April 21, 2008.
The following is a letter that was sent to the downtown merchants:
Dear Downtown Merchant:
On Monday, April 21, the parking area behind Fairhope Hardware will close for
construction of the parking deck. Next week, Officer Heidi Loftis with the Fairhope
Police Department will stop by the merchants in the affected area (Fairhope Avenue
and Church Street) to give them a map of some designated merchant parking areas,
a parking pass and a map of the additional 75 parking spaces that have been added
in downtown Fairhope since February. The City plans to designate parking on the
grassy area behind the library for merchants and each merchant in the affected area
will receive one parking decal that will allow them or their employee designee to park
in any space in downtown without violating the 2 hour parking limits. These decals
will be numbered and recorded but merchants can pass them around among
employees. These decals will not be effective after the parking deck opens.
After April 215t, the two hour parking limit will be enforced from 10 a.m. to 3 p.m.
where signs are posted. This will not only affect the merchants adjacent to the
parking area but all businesses, their employees and customers. Please
communicate with your employees and let them know that enforcement will begin on
Monday, April 21st. Ticketing and enforcing tickets for everyone is the only way to
make this effort successful. Any questions regarding parking tickets should be
directed to the Officers Heidi Loftis, Craig Sawyer or Jimmy Davis with the Fairhope
Police Department.
For your information, the new parking deck will provide an additional 100 parking
spaces and hopefully will be open in time for the holiday shopping season. Please be
patient as they begin construction and do not hesitate to call me, Alex or Heidi if you
have any questions or concerns. Also, please share this information with anyone who
may not have email. Also, if Heidi does not stop by next week with your decal, please
give Alex a call by Friday and she will communicate with Heidi.

The downtown parking issue will not affect services to businesses. The
foundation will take approximately forty-five weeks and the construction
approximately four weeks. Councilmember Quinn asked Ms. Fidler to look
into the angled parking further South behind Greers on Bancroft.
Councilmember Ford asked are you going to give out complimentary passes
for a few weeks. Chief Comalander replied warnings will be issued.
(4) Centennial Trees: We have received $4,650.00 in donations for the
Fairhope Centennial Tree Program. This is just $350.00 short of our
$5,000.00 goal. At the end of April, the last trees will be planted.

Councilmember Quinn addressed the City Council regarding the press packet
issue. She suggested either putting packets on-line or giving a packet to the press.
Larger cities are on-line with their agenda and packets and I consider Fairhope as a
large city. Councilmember Christenberry stated that if he received a letter, it is my
call as to whether or not it should go public. Councilmember Quinn stated that City
Attorney Marion E. Wynne was looking into the letter issue as what was considered
public record or confidential information. City Attorney Wynne commented that he
did not have an answer for the letters tonight. Council President asked City Attorney
Wynne to draft a document regarding the press packets and public availability prior to
City Council meetings for their review. Councilmember Quinn announced that Lisa
Hanks, Assistant City Clerk, had prepared a report regarding press packets and how
other cities handle these documents.
A Public Hearing was held as advertised on a proposed ordinance to amend
the Zoning Ordinance No. 1253. Councilmember Christenberry introduced an
ordinance to zone the property of Herbert and Ruth Pierce from B-4 Office and
Professional District to B-3b Tourist Resort Commercial Service District. The
Planning & Zoning Commission recommended denial of this ordinance. This
property is generally located at 19182 Greeno Road, Fairhope, Alabama.
Gregg Mims, Planning Director, explained the proposed ordinance:
STAFF INTERPRETATION:
The subject property is zoned B-4 (Office and Professional District) and the applicant would
like to rezone to B-3b (Tourist Resort Commercial Service District). There is currently a
single-family residence on the property; the applicant would like to use the property for a
health food store.
North and east of the subject property there is land utilized as a cemetery. South lies single-
family residences and there is vacant land in the County to the west.
The B-4 zoning district "is intended to provide opportunity for business establishments of a
professional nature and is restricted to offices and businesses, which provide specific
corporate functions or professional services to the general public" (Article III, Section A. 14).
Retail operations such as a health food store are not a permitted in the B-4 zoning district.
The proposed zoning (B-3b) "is intended for a range of commercial and resort residential
uses as appropriate locations to serve the needs of tourists" (Article III, Section A. 13).
Due to the location and abundance of vacant properties along Greeno Road that would allow
for the proposed use (health food store), staff is unable to support rezoning the subject
property. In addition, staff believes the existing B-4 zoning is appropriate for this location and
that there was not an error in the original zoning designation.
The property is bordered to the north and east by R-A (Residential / Agriculture District).
West is Greeno Road and un-zoned County land, and south is zoned B-4 (Office and
Professional District).

PLANNING COMMISSION RECOMMENDATION:
On January 7, 2008 the Planning Commission unanimously recommended denial of the B4
to B-3b rezoning request.

Council President Gentle opened the Public Hearing at 5:44 p.m.
1. Steve Dunnam of Arnold & Associates, 753 Nichols Avenue, who is the agent
for Herbert and Ruth Pierce, addressed the City Council in support of
rezoning their property. Herbert and Ruth want to sell their property and it
would be beneficial to prospective owners if it was rezoned to B3b. Their
property is surrounded by retail or close by it. Common sense comes into
play regarding this rezone request. This is a good location and a new structure
is to be built in the near future.
2. Herbert Pierce, owner of 19182 Greeno Road, addressed the City Council and
stated that it was very important to sell this property. I have lived in this
house for 26 years and would not sell this property if it would be detrimental
to the City of Fairhope. The people are very nice who want to buy property.
3. Lynorra Ash Harden, owner of Fairhope Health Foods and prospective buyer
of property, addressed the City Council in support of the rezoning. She has
been in the health food industry for 30 years. We have a small business, well
established, and survived over 33 years. The parking and demand for the
community brought us to Fairhope.
4. Henry Harden, prospective buyer, addressed the City Council in support of the
rezoning. We found a piece of property and the right price. We would like an
opportunity to have a little piece of this community.
5. Vince Valentim, 203 Perdido Avenue, a resident of Fairhope, addressed the
City Council stating that he was surprised that Planning & Zoning denied this
request. Mr. Valentim stated that he was always told lets go South. This
business would not be out of place. Please give them what they want.
6. Hop Allen, a resident of Fairhope, addressed the City Council asking about
the rezoning request from B4 to B3b. He asked; what does tourist have to do
with business. I don't understand the zoning request! Mr. Mims replied that
he would answer this question along with others regarding this matter.

The Public Hearing closed at 5:55 p.m.
Mr. Mims stated that in general commercial zoning anything would go. There would
not be many restrictions as what you could put or build in this category. In 133b
zoning, it is more restrictive for what you could build. Councilmember Ford asked
Mr. Mims, "What is your problem?" Mr. Mims replied I don't have a problem. I
think Planning & Zoning was concerned with the domino effect. The City of
Fairhope needs to control land use. We need to set a policy on what you are going to
zone.
Council President Gentle stated he voted against the rezone on the Planning & Zoning
Commission. He asked about the North Greeno and South Greeno overlay and
inquired where do we stand on this? Mr. Mims replied that an overlay would be a
massive project. You cannot do it overnight. We would need a series of meetings
with all property owners. Planning & Zoning is making an effort to hold the line.
Councilmember Ford asked; have you received any complaints from any of the
neighbors. Mr. Mims replied no.
Councilmember Christenberry stated an overlay district is great, but in the real world
there would be issues. This rezone fits the property here. That area of Greeno Road
is business. I think this is a perfect fit and thank the Pierces for tightening this up as a
133b zoning category.
Council President Gentle asked, "How did you get 1347 Ruth Pierce answered it was
an office in a flat house and this is what we were told it needed to be zoned.
Councilmember Quinn asked; what else can go in 133b. Mr. Mims replied the
following: office, grocery store, general merchandise, motel, hotel, indoor recreation,
personal storage, recreational vehicle park, restaurant, bar, etc.
In order to take immediate action Councilmember Ford moved for immediate
consideration. Seconded by Councilmember Christenberry, motion for immediate
consideration failed for lack of a unanimous vote. This ordinance will layover for
final adoption at the next regular City Council meeting.
Councilmember Christenberry introduced in writing, and moved for the
adoption of the following resolution, a resolution authorizing Mayor Kant to sign the
Municipal Water Pollution Prevention Program (MWPP) Report for 2007.
Councilmember Quinn inquired about the smoke testing and camera program. Mayor
Kant stated these tests are performed once a month. This includes maintenance and
checking. Seconded by Councilmember Stankoski, motion passed unanimously by
voice vote.

RESOLUTION NO. 1444-08
MUNICIPAL WATER POLLUTION PREVENTION (MWPP) PROGRAM
ATTACHMENT 1
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized
to inform the Department of Environmental Management that the following
actions were taken by the City Council of the City of Fairhope, Alabama.
1. Reviewed the MWPP Annual Report which is attached to the
resolution.
2. Set forth the following actions and schedule necessary to
maintain effluent requirement contained in the NPDES
Permit, and to prevent the bypass and overflow of raw
sewage within the collection system or at the treatment plant:
No action was required to be taken by the City of Fairhope.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that Mayor Timothy M. Kant and Nancy Wilson, Treasurer, are authorized to renew the
Utilities line of credit with RBC Centura Bank in the amount of Two Million Dollars
($2,000,000.00) for summer utility bills and will be repaid in fall as customer utility
payments are received.

Councilmember Christenberry introduced in writing, and moved for the

letter to Auburn University President Dr. Jay Gogue supporting the Gulf Coast
Substation and the approximate 800 acres, located at 8301 State Highway 104, as
open space and agricultural research, requesting to continue the close working
relationship, and to discuss any other incentives and agreements between Auburn
University and the City of Fairhope that insures the continued operation of and
designation of the Substation property as an open public space. Councilmember
Christenberry thanked Mayor Kant for the resolution and letter of support regarding
this substation. He continued by reading the resolution in its entirety. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.

RESOLUTION NO. 1446-08
WHEREAS, the Auburn University Gulf Coast Substation, located at 8301 State Highway 104, was
established in 1930, as one of the five original "sub" agricultural experiment stations of the Main
Alabama Agricultural Experiment Station at Auburn University; and
WHEREAS, the original 725 acres of the Substation were donated by local agencies, and the research
center was established as part of a 1927 Act by the Alabama Legislature; and
WHEREAS, the Gulf Coast Substation currently has 75 research projects underway and hundreds of
important agricultural research projects have been conducted since 1930; and
WHEREAS, the City of Fairhope has enjoyed its relationship with Auburn University and considers
the approximate 800 acres to be important to the land use mix in the Fairhope Community;
WHEREAS, the City of Fairhope congratulates Auburn University on 78 years of research conducted
at the substation;
THEREFORE LET IT BE RESOLVED, that the City of Fairhope supports the continued use of the
Gulf Coast Substation and the approximately 800 acres as open space and agricultural research; that
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA,

Councilmember Ford moved to update Fairhope Police Reserve Roster by
adding Wayne Robinson. Seconded by Councilmember Christenberry, motion passed
unanimously by voice vote.
Councilmember Stankoski moved to appoint Savan W. Wilson to the
Personnel Board. This term will end April 2013. Seconded by Councilmember
Christenberry, motion passed unanimously by voice vote.

Councilmember Ford stated the Museum Advisory Board will specify in their By-
laws that at least one member would be from Fairhope Single Tax Corporation.
Seconded by Councilmember Quinn, motion passed unanimously by voice vote.
Councilmember Quinn mentioned that in a previous City Council meeting she
reported that a little boy was hit by a float at Mardi Gras in Prichard. Since the
incident, she has met with several of our Mardi Gras organizations regarding the need
for more barricades for safety reasons. Tonight, she told the City Council that both
ladies organizations have pledged $500 a year for three years to fund more barricades
for the city's use. The men's organization has not let me know anything as of this
date.
Councilmember Quinn moved to grant the request of Page & Palette
requesting permission to close De La Mare from 3:30 p.m. until 10:00 p.m. on April
30, 2008 for Joyce Meyer's book signing. Seconded by Councilmember
Christenberry, motion passed unanimously by voice vote.
Councilmember Quinn moved to grant the request of the Eastern Shore
Chamber of Commerce requesting permission to block streets for their annual Arts
and Crafts Festival on March 20, 21, and 22, 2009. Seconded by Councilmember

Christenberry, motion passed unanimously by voice vote. Jay Hasting, Director of
Tourism for the Eastern Shore Chamber of Commerce, presented the City of Fairhope
with a framed 56t' Annual Arts and Crafts Festival print.
Mr. McKeown addressed the City Council requesting to extend Liberty Street
170 feet in order to access his property and stated that Liberty Street stops
approximately 300 feet before Big Head Gulley. Mr. McKeown also stated that he
would pay for the extension and maintain the road. Joe Sledge, 19550 Liberty Road,
addressed the City Council stating that the blacktop goes down almost 30 feet from
Big Head Gulley, not 300 feet. Mr. McKeown reassured the City Council that the
street stopped 300 feet before Big Head Gulley. Mr. Sledge asked Mr. McKeown,
"Are you going across the gulley?" Mr. McKeown replied no.
After further discussion, Councilmember Ford moved to grant the request of Carl and
Marilyn McKeown requesting permission to extend Liberty Street approximately 170
feet from where it now ends just south of Fig Street. Seconded by Councilmember
Stankoski, motion passed unanimously by voice vote.
City Attorney Wynne informed the City Council that the only reason this
request from the Fairhope Veterans Memorial Committee has come before them is
due to our new ordinance which specifically requires alcohol being served on the city
streets must be presented to the City Council for approval. After further discussion,
Councilmember Ford moved to grant the request of Joe Birindelli, Co -Chairman of
the Fairhope Veterans Memorial Committee requesting permission to serve beer and
wine at a block party in downtown Fairhope, the first of several fundraising efforts
for the construction of the Fairhope Veterans Memorial. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.
Councilmember Stankoski said that the Fairhope Veterans Memorial is a fine work of
art.
Councilmember Christenberry moved to grant the request of Christopher
Baker from Hutchinson, Moore & Rauch, LLC requesting the easement which
provides dedicated access to Founder's Square be named Bernhardt Lane. Mr. Baker
mentioned that Baldwin County 911 Addressing has requested that the access to
Founder's Square be named. Seconded by Councilmember Stankoski, motion passed
unanimously by voice vote.
Councilmember Quinn began the discussion on strategic planning. She said at
the last regular City Council meeting our auditor stated we needed a long term
financial plan. The Governmental Structure Committee also stated the need for a
strategic plan. The following pages are from the Governmental Structure
Committee's report regarding strategic planning: their findings, conclusions, and
recommendations:

Strategic Planning
Strategic Planning — Findings
The City does not have a Strategic Plan, commonly understood to be a five-year look
forward including financial projections. However, each utility department has a long-
term plan, focused primarily on capital projects and system betterments.
Based upon interviews with financial/accounting professionals, the largest financial threat
to the City is a series of well intentioned but capital -intensive infrastructure
improvements approved individually without respect for the long-term impact on the
City's financial structure.
Although each city official seems to have in mind long-term strategic or financial goals,
none of these goals are communicated in writing to other officials.
A review of small cities around the country finds many similar to Fairhope, with little
formal long-range planning. But a growing number of progressive cities have strategic
plans that include vibrant community involvement components. The planning models
vary widely.
Strategic Planning — Conclusions
LACK OF A FIVE YEAR STRATEGIC AND FINANCIAL PLAN IS THE LARGEST
RISK FACTOR AFFECTING THE FUTURE FINANCIAL INTEGRITY OF THE
CITY OF FAIRHOPE AND ITS UTILITIES.
Communications difficulties between the mayor and council have been frequently
connected with financial issues, often extending beyond the current budget cycle, and
often related to status of available of cash.
The annual budgeting process and the strategic planning process should be linked. The
annual budget each year should be the implementation of the first year of the current five-
year strategic plan, after which the strategic plan should be updated for one additional
year.
The three most relevant practices of the GFOA to the situation in Fairhope are:
• Recommended Budget Practices of the National Advisory Council on State and
Local Budgeting (NACSLB)(1998). Key characteristics of the budget process
include incorporating a long-term perspective and establishing linkages to broad
organizational goals.
• Recommended Practice: Budgeting_for Results and Outcomes 2007). Four
"essential provisions of effective budgeting are (1) set broad goals to guide
decisions, (2) develop strategies and financial policies, (3) design a budget
supportive of strategies and goals and (4) focus on the necessity of continually
evaluating a government's success at achieving the goals that it has set for itself

(i.e., performance).
Recommended Budget Practice on the Establishment of Strategic Plans (2005).
GFOA recommends that all governmental entities use some form of strategic
planning to provide a long termperspective for .service delivery and budgeting,
thus establishing logical links between authorized spending and broad
organizational goals. They identify thirteen key steps common to all strategic
planning processes.
Strategic Planning — Recommendations
6. Initiate a Strategic Planning Process, using a consultant if necessary to get
started. Follow Government Finance Officers Association (GFOA) "Best
Practice Guidelines. A key element of the GFOA "Recommended Practices"
is the necessary interrelationship between budgeting and long-term financial
and strategic planning.
7. Initiate all large requests for capital through the Strategic Planning Process,
and defer all large requests until a 36-mouth financial projection is done.
8. Implementation of a strategic planning process can be done in phases, done in
small pieces that individually will not overwhelm city staff and elected officials.
Even at that, a consultant will likely be required for at least the first few cycles to
assist with development of the process and plan.

Council President Gentle gave a "what if' scenario if the City of Fairhope had to go
to a paid Fire Department instead of a volunteer Fire Department at this moment in
time. The city would not be prepared for this or any other large expenditure. The
next administration that comes in will inherit things we did not do or should have
done.
Councilmember Quinn said we need to appoint an ad hoc committee to give us an
outline to what we need to do to move forward.
Councilmember Stankoski stated earlier on the agenda we approved a $2,000,000.00
line of credit. The city has been using a line of credit when cash from utility
customers is delayed. We have been doing this for years. I suggest a five-year
strategic plan is our game plan and go for it. If you have an outline and syllabus, you
can go forward.
Councilmember Christenberry stated we need a four or five-year plan. We need to
start forming some type of plan.
Councilmember Ford stated we have been borrowing money for years, not just since
2000. A strategic plan is a good idea; just not set in stone, like the comprehensive
plan. I am all for it as long as it is not written in stone, has flexibility, and we are not
going outside to hire.
Councilmember Quinn told the City Council she had talked with Chuck Zunk and
Dick Kwapil to serve on the committee. She suggested that the committee have two
members from the Governmental Structure Committee, two members from SCORE,
and any Councilmember who would like to serve. Council President Gentle asked to
be on this committee.
Chuck Zunk, 59 White Avenue, addressed the City Council and reassured
Councilmember Ford that this ad hoc committee is not to write the plan, just give
guidance and structure. It would be very inappropriate to actually write the plan.
Every year you come back and refresh the plan. You push out the plan five years
forward. You never hide behind the plan.
After further discussion, Councilmember Quinn moved to appoint an ad hoc
committee to look into the strategic planning process with two members from the
Governmental Structure Committee, two members from SCORE, and any
Councilmember who would like to serve. Seconded by Councilmember. Stankoski,
motion passed unanimously by voice vote.

Mayor Kant commented that the City of Fairhope needed help with large capital
expenditures. Council President Gentle said this is a process for the City in order to
protect it. Councilmember Stankoski said the plan is to say let's look a little bit
behind us and see how we can catch up before moving further along.
Councilmember Quinn moved to accept the low bid of Lazzari Truck Repair,
Inc. provided all specifications are met, for repairs to Garbage Truck No. 544.
Seconded by Councilmember Christenberry, motion passed unanimously by voice
vote. This purchase will be funded by General Operating Funds — repair &
maintenance.
Councilmember Christenberry moved to accept the State of Alabama Bid
Number T193A including specifications determined by the Fairhope Gas Department,
for a 2008 F350 Ford Truck — Gas Service Truck - in the amount of $20,461.27.
Seconded by Councilmember Stankoski, motion passed unanimously by voice vote.
This purchase will be funded by Gas Operating Funds.
Councilmember Christenberry moved to pay bills as presented. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was duly adjourned at 7:07 p.m.
