The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 24 March 2008.
Present were Council President Robert C. Gentle, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford, Mayor
Timothy M. Kant, City Attorney Marion E. Wynne, and Assistant City Clerk Lisa A.
Hanks. City Clerk Geniece W. Johnson was absent.
There being a quorum present, Council President Gentle called the meeting to
order. The invocation was given by Arthur Bosarge, Assistant Director of Public
Works, and the Pledge of Allegiance was recited. Councilmember Stankoski moved
to approve minutes of the March 6, 2008, regular meeting as amended. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.
Sherry Sullivan made the following announcements:
• The State of the City Address will be March 30, 2008 at 2:00 p.m. at the
Fairhope Civic Center.
• The City of Fairhope Museum of History will open on Saturday, April 5,
2008.
Mayor's Comments and Staff Reports:
Mayor Kant announced that William "Buddy" Richmond passed away this
weekend. Mr. Richmond was appointed to the City's Planning & Zoning
Commission in July 1987 and was replaced in December 1999. Mayor Kant
stated that Mr. Richmond actually did most of the drawings for the City of
Fairhope and the Civic Center was one of his first. Mayor Kant asked for a
moment of silence for William "Buddy" Richmond.
• Mayor Kant addressed the City Council regarding the following two items:
1. The billboard case has been settled and the City of Fairhope prevailed.
Mayor Kant asked for the Declaratory Judgment to be included in the
minutes. The following is the Declaratory Judgment in favor of the

Declaratory Judgment, answer of Defendant, testimony and
evidence, and arguments of Counsel. Upon consideration
thereof, it is,
ORDERED, ADJUDGED and DECREED, by the Court as follows:
I. Pursuant to State Law and local Ordinance, the
City of Fairhope has the right to prohibit the proposed
billboard at the proposed location.
2. The Defendant, Bill Salter Advertising, Inc. is
hereby enjoined from installing the proposed billboard at
the proposed location.
3. If the Defendant has already installed the
billboard, the Defendant is hereby ordered to remove the

2. A letter was sent to the Alabama Department of Transportation
regarding the concerns at the intersection of U. S. Highway 98 and
Veterans Drive. Mayor Kant read the last paragraph of the Alabama
Department of Transportation's response letter and asked for the letter
to be included in the minutes. The following is the letter from the

This is the requested response clarifying the Alabama Department of Transportation's position on future
modifications to the U.S. 98 Intersection with Veterans Drive (formally know as Section Street). As you
know, the City has requested a traffic signal at this location over the past 10 -15 years. In November of
2005, the City requested alternatives to signalization be explored for this intersection. During the next few
months, many options were presented and reviewed. In December of 2006, the City requested that
ALDOT assist in funding a project to re-route the northbound traffic on Veterans Drive to U.S. 98/AL104
Intersections. ALDOT viewed this project as the best option to improve safety and reduce congestion
along this section of U.S. 98. ALDOT agreed to participate in the funding of the work at U.S. 98/AL104
Intersections with the understanding that this project would eliminate the need for a traffic signal at U.S.
98Neterans Drive Intersections.
Recently, we were made aware of the City's previous commitment to install a traffic signal at U.S.
98/Veterans Drive Intersection upon the development of Village North which is an approved planned unit
development. ALDOT's position has not changed. We still support the current City project to re-route the
northbound Veterans Drive traffic, because it is the safest option for current traffic patterns along this
section of U.S. 98. In the future, if the conditions change and the City and/or the Developer propose an
additional project to modify these intersections further, we would evaluate those requests once received.
If the future proposed project improves the safety and capacity along U.S.98, we would grant a permit to
the City and/or Developer to make those Improvements at that time.

the following PowerPoint presentation no action was taken by City Council.
Ms. Fogarty mentioned the annual financial report being larger this year
because the City of Fairhope is submitting the Comprehensive Annual
Financial Report to the Governmental Finance Officers Association of the
United States for a certificate of achievement in financial reporting.

Council President Gentle asked with the property tax issue, what percent have we
collected? Ms. Fogarty replied there is still $1.6 million to collect. Ms. Wilson said
$2.3 million has been collected so far. Council President Gentle said we budgeted
$3.9 million, so we are out approximately twenty-five percent.
Councilmember Quinn commented on the February finances and questioned the water
and sewer expenses. Ms. Wilson replied she used available cash to pay expenses in
the other departments and cash was not there for water and sewer. Councilmember
Quinn also mentioned the salaries under the sanitation department have gone up
considerably and asked Ms. Wilson to look into it. Ms Fogarty said one reason for
the increase in salaries could be we had three pay periods in February instead of two.
Councilmember Ford also asked why the water and sewer fund expense increased.
Ms. Fogarty replied I can get you the specifics. Councilmember Stankoski stated
once again the proverbial question is; what do we have in the bank? Ms. Fogarty said

at this time I am turning it over to Ms. Wilson who replied the cash in bank is
$6,510,700.00. Ms. Wilson said she met with the State of Alabama Revenue
Commissioner and staff, while in Montgomery, regarding the property tax issue.
They told me it was coming to a close, but didn't say when. Council President Gentle
asked what if we do not receive the $1.6 million. Ms. Wilson said she used cash that
came in to pay off lines of credit, in order to get us in a better situation. In our
reserves, we put $604,000.00 in January, $237,000.00 in February, and so far
$205,000.00 in March. We paid the fuel cost for January and February out of cash.
We will close on the $1.3 million GOW loan tomorrow.
Councilmember Quinn addressed the City Council and Mayor Kant regarding the
public records issue. She saw the newspaper article on the new information request
policy and mentioned she never received the policy changes or heard about the
changes. Then, she brought up the City Council packets and wanting the press to get
a copy. She mentioned the reporters would be better prepared to write their stories if
they had the information prior to and during the City Council meetings.
Councilmember Quinn asked Mayor Kant for his opinion on the two issues.
Mayor Kant stated he told the City Clerk's office to stop charging citizens for
information requests. This is just a temporary policy until the Council decides to
change it. As for the City Council packets, the Council needs to decide what to do.
Council President Gentle said I don't have any problem with the press receiving the
packets, but things are in draft form, just like tonight we changed the minutes.
Agenda packets are apt to be changed. There was one instance where the packets
were given out, items were to be voted on and then were not. The article was written
based on the items being voted on by the City Council.
Councilmember Stankoski stated he does not oppose the agenda and may not like to
release letters from individuals unless we get their permission. We could give the
packets and remove the letters. Councilmember Christenberry said he has no
problem with giving out the packets and wants the press to get information to write
their story. Councilmember Ford agrees the public should get everything, but not put
their letters out there. If someone wanted to write a letter to the Council, it would be
wide open for the press. This individual may not want their letter being everybody's
business and would be reluctant to write it.
Mayor Kant mentioned all ordinances will be on-line soon. Hopefully by the time the
new website is up and running.
Mike Odom, reporter for the Fairhope Courier, addressed the City Council regarding
public records. He said records are public that are submitted to a municipality. There
is some dispute by the Alabama League of Municipalities that items are draft until
adopted. What do you feel about the letters being public records, City Attorney
Wynne? Wynne replied I cannot shoot from the top of my head. I knew there was

some controversy with the reporters and the Alabama League. I don't know how to
answer that at this time. Mr. Odom said items that are not voted on, I feel, are public
records. Councilmember Ford said that if someone wrote me a letter with his opinion
in it, it was not public record. Mr. Odom told the City Council that Mobile and
Daphne have their agenda packets on-line. Councilmember Quinn stated that we
should find out what other cities do regarding press packets. I give my packet to the
press because I do not need it. Council President Gentle commented to the press; we
give all information we can to help you write a better story.
The following proclamation was presented by Jennifer Fidler, Public Works
Director, Proclaiming April 22, 2008 as Earth Day. Ms. Fidler recognized the
members of the Earth Day Committee: Gary Gover, Steve Robinson, Carol Adams -
Davis, Eleanore, Scott, Suzie Spies, Jacque Dunnam, Tanys Waldron, Judy Benton,
Maria Spies, April Westervelt, David Spies, and Jeanine Normand.

Dennis Sherrin with Hartman, Blackmon, and Kilgore addressed the City
Council and gave a brief summary of the Comprehensive Annual Financial Report for
fiscal year ending September 30, 2007. A copy of the Comprehensive Annual
Financial Report for fiscal year ending September 30, 2007 shall be spread upon the
minutes of the City of Fairhope (under a separate cover). Dennis Sherrin announced
that the City received the highest level of opinion; an unqualified statement. Mr.
Sherrin thanked all City employees for their help and participation.
Councilmember Ford asked, bottom line, are we in good shape? Mr. Sherrin replied
things are thin, but good. Council President Gentle commented you touched on debt
on the governmental side, what is our debt limit and also on proprietary funds? Mr.
Sherrin replied for 2007 the legal debt limit is $44 million and our legal debt margin
is $26 million. Councilmember Stankoski stated bottom line we are in good shape,
but it appears we continue to borrow. What do you see? And, what is our trend? Mr.
Sherrin replied the City needs to continue managing expenses. Lines have crossed
and have been offset by borrowing. Expenses have grown over the years. The City
must continue to evaluate appropriations and have a grasp on the horizon. This can
affect the City if you operate on a thin margin.
Councilmember Quinn commented you talked about a long-term financial plan and
we don't have one. Mr. Sherrin replied you need a 3, 5, and 7 year plan. Council
President stated we looked into a strategic plan and it came from the Governmental
Structure Committee. After further discussion Councilmember Ford moved to accept
the Comprehensive Annual Financial Report. Seconded by Councilmember
Stankoski, motion passed unanimously by voice vote.
A Public Hearing was held as advertised on a proposed ordinance to adopt
new building, mechanical, plumbing, fuel and gas, fire and electric codes.
Councilmember Quinn introduced in writing Ordinance No. 1356. Chris Gill, City
Attorney from Hand Arendall, discussed the legal aspects of the codes which are
permitted by statutory law. Barry Fulford, Building Official, stated the City of
Fairhope is about the only city that has not adopted these codes. He said, "I wish for
the Council to pass this tonight."
Council President Gentle opened the Public Hearing at 6:39 p.m. No one present
opposed the proposed ordinance, the Public Hearing closed at 6:40 p.m.

In order to take immediate action Councilmember Quinn moved for immediate
consideration. Seconded by Councilmember Stankoski, motion for immediate
consideration passed unanimously by the following votes: AYE - Quinn, Stankoski,
Christenberry, Ford, and Gentle. NAY- None. Councilmember Quinn then moved
for final adoption of Ordinance No. 1356. Seconded by Councilmember
Christenberry, motion for final adoption passed unanimously by the following votes:
AYE - Quinn, Stankoski, Christenberry, Ford, and Gentle. NAY- None.
Councilmember Ford introduced in writing Ordinance No. 1357, an ordinance
establishing the City of Fairhope Museum Advisory Board. Councilmember Ford
discussed the ordinance and read his recommendations for the board with their
qualifications. In order to take immediate action, Councilmember Christenberry
moved for immediate consideration. Seconded by Councilmember Stankoski, motion
for immediate consideration passed unanimously by the following votes: AYE -
Quinn, Stankoski, Christenberry, Ford, and Gentle. NAY- None. Councilmember

Council President Gentle stated that Don Gordon Construction was hired as
the construction manager at risk for the new Fairhope Recreation Center and solicited
bids for the project. He asked; does the City enter into a contract with Don Gordon
Construction? City Attorney Wynne said that Mr. Gordon must follow the bid law
and get bids on the Fairhope Recreation Center just like any other City project.

Center in the amount of $332,969.00. Seconded by Councilmember Christenberry,
motion passed unanimously by voice vote. This purchase will be funded by the 2007
GOW.
