The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street; Fairhope, Alabama 36532, on
Monday, 10 July 2006.
Present were Council President Robert C. Gentle, Councilmembers: Debbie W.
Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford; Mayor Timothy M.
Kant, City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was
absent.
There being a quorum present, Council President Gentle called the meeting to
order. The Pledge of Allegiance was recited, and Geniece W. Johnson, City Clerk, gave
the invocation. Councilmember Stankoski moved to approve minutes of the June 26,
2006, regular meeting. Seconded by Councilmember Christenberry, motion passed by
the following votes: AYE -Quinn, Stankoski, Christenberry, and Ford. NAY -none.
ABSTAIN -Gentle
Mayor's Comments and Staff Reports:
• Mayor Kant thanked everyone for coming out to attend the award presentation ceremony for the 1156
Military Police Company. The 1156 Military Police received a Presidential Unit Citation and A Valorous
Unit Award for their service in Iraq as part of Operation Iraqi Freedom. This event was held on Saturday,
July 8, 2006, at the Fairhope High School Gymnasium.
• Mayor Kant stated that a proposed Smoking Ordinance has been given to the City Council to review and
offer feedback. This ordinance may be on the next regular City Council agenda.
• Mayor Kant stated that re -appointment of Ed Brinson will be pulled from the agenda until the moratorium is
over. Mr. Brinson and all other appointees will remain on the Planning and Zoning Commission until the
moratorium is lifted.
• Gregg Mims Planning Director addressed the City Council to explain the Moratorium Projects:
1. Traffic: Hire a consultant to complete a transportation plan for the City of Fairhope and the
Planning Jurisdiction. The consultant will provide assistance with county and state traffic
engineering issues. The consultant will review the city's current development standards. A
representative of the City Council should be appointed to work with the staff and the consultant to
provide communication back to the full City Council.
2. Drainage: Hire a consultant to review the drainage areas within the City of Fairhope and the
Planning Jurisdiction. The study should include a review of drainage areas, wetlands and a review
of the subdivision regulations. A representative of the City Council should be appointed to work
with the staff and the consultant to provide communication back to the full City Council.
3. Baldwin County Issues: The Mayor, the planning staff and other city representatives will be tasked
with resolving ongoing conflicts with Baldwin County relative to regulatory and jurisdictional
issues. A representative of the City Council should be appointed to work with staff to provide
communication back to the full City Council.

4. Comprehensive Plan: The Planning Commission will meet July 17, 2006 to consider amendments
to the Comp. Plan. If approved by the Planning Commission the City Council will hold a public
hearing on the plan amendments in September. A representative of the City Council should be
appointed to work with staff to provide communication back to the full City Council.
5. Impact Fee Ordinance: The Planning Staff and Mr. Chris Gill of Hand/Arendall and other city
officials will develop a draft Impact Fee Ordinance. A representative of the City Council should be
appointed to work with staff to provide communication back to the full City Council.
Council President Gentle appointed the following Councilmember to work with each moratorium projects,
each Councilmember is to work with Mr. Mims and report back to the City Council:
Traffic — Councilmember Stankoski
Drainage — Councilmember Christenberry
Baldwin County Issues — Council President Gentle
Comprehensive Plan — Councilmember Quinn
Impact Fee Ordinance — Councilmember Ford

A Public Hearing was held as advertised on a proposed ordinance to amend the
Zoning Ordinance No. 1253. Councilmember Quinn introduced in writing Ordinance
No. 1305. The Planning & Zoning Commission recommended approval of this
ordinance.
Council President Gentle called on Gregg Mims to explain the ordinance and opened the
Public Hearing at 5:55 p.m.
Jack Rousso a resident at 134 Club Drive Quail Creek addressed the City Council
requesting that the traffic situation for the proposed property be looked into. The public
hearing was closed at 5:56 p.m.
An ordinance to zone the property of Montrose Properties Inc to R-2 Medium Density
Single Family Residential District concurrent with annexation into the City of Fairhope.
This property is generally located South of Windmill Road and West of Thompson Hall
Road, Fairhope, Alabama. Parcel A contains 12.0 acres more or less 05-46-05-22-0-000-
001.674. Parcel B contains 12.62 acres more or less 05-46-05-22-0-000-001.687. In
order to take immediate action Councilmember Christenberry moved for immediate
consideration. Seconded by Councilmember Quinn, motion passed for immediate
consideration passed unanimously by the following votes: AYE -Quinn, Stankoski,
Christenberry, Ford and Gentle. Councilmember Christenberry moved for final adoption
of Ordinance No. 1305. Seconded by Councilmember Quinn, motion for final adoption
passed unanimously by the following votes: AYE -Quinn, Stankoski, Christenberry,
Ford, and Gentle. NAY -none
A Public Hearing was held as advertised on a proposed ordinance to amend the
Zoning Ordinance No. 1253. Councilmember Stankoski introduced in writing Ordinance
No. 1306. The Planning & Zoning Commission recommended approval of this
ordinance. No one present was opposed to the amendment. An ordinance to
re -zone the property of Fairhope Single Tax Corporation, and Montrose Properties, Inc
from R-6 Manufactured Home District to R-2 Medium Density Single Family Residential
District. Subject to ISO being worked out and drainage for eight (8) lots be included in
overall land plan. This property is located South of Morphy Avenue and West of
Thompson Hall Road, Fairhope, Alabama. Parcel numbers 05-46-05-22-0-000-001.602
and 05-46-05-15-0-000-003.554. In order to take immediate action Councilmember
Christenberry moved for immediate consideration. Seconded by Councilmember
Stankoski, motion passed for immediate consideration passed unanimously by the
following votes: AYE -Quinn, Stankoski, Christenberry, Ford, and Gentle. NAY -none.

A Public Hearing was held as advertised on a proposed ordinance to amend the
Zoning Ordinance No. 1253. Councilmember Quinn introduced in writing Ordinance
No. 1307. The Planning & Zoning Commission recommended approval of this
ordinance. No one present was opposed to the amendment. An ordinance to
Request to re -zone the property of Cecil P. Bush, Donna M. Bush, and Robert E. Bush,
III (Parcel behind the Eastern Shore American Legion), from B-3a Tourist Resort
Lodging District to R-5 High Density Dwelling Residential District. This property is
located at 700 Mobile Street, Fairhope, Alabama. Parcel # 46-03-37-0-012-002.000. In
order to take immediate action Councilmember Quinn moved for immediate
consideration. Seconded by Councilmember Christenberry, motion passed for immediate
consideration passed unanimously by the following votes: AYE -Quinn, Stankoski,
Christenberry, and Gentle. NAY -none. ABSTAIN -Ford. Councilmember Quinn
moved for final adoption of Ordinance No. 1307. Seconded by Councilmember
Christenberry, motion for final adoption passed unanimously by the following votes:

A Public Hearing was held as advertised on a proposed ordinance to amend the
Zoning Ordinance No. 1253. Councilmember Christenberry introduced in writing
Ordinance No. 1308. The Planning & Zoning Commission recommended approval of
this ordinance. No one present was opposed to the amendment. An ordinance to
re -zone the property of Fairfield Financial LLC, amending the current Planned Unit
Development (PUD). This property is located at the Northeast corner of Twin Beech
Road and Boothe Road, Fairhope, Alabama, Fairfield Subdivision Phase VI, Fairhope,
Alabama. In order to take immediate action Councilmember Stankoski moved for
immediate consideration. Seconded by Councilmember Christenberry, motion passed for
immediate consideration passed unanimously by the following votes: AYE -Quinn,
Stankoski, Christenberry, Ford, and Gentle. NAY -none. Councilmember Christenberry
moved for final adoption of Ordinance No. 1308. Seconded by Councilmember Quinn,
motion for final adoption passed unanimously by the following votes: AYE -Quinn,
Stankoski, Christenberry, Ford, and Gentle. NAY -none.
Councilmember Ford introduced in writing a proposed ordinance to amend
Ordinance No. 1047 the Towing and Recovery Rotation Ordinance. Geniece W. Johnson
City Clerk addressed the City Council requesting that staff have more time to go over this
ordinance, and make some rate comparison for towing services. This ordinance will
layover until the next regular City Council meeting.
Councilmember Quinn introduced in writing, and moved for the adoption of the
following resolution, a resolution accepting the public streets, public right-of-way, and all
of Fairhope's public utilities within Woodlawn Phase I Subdivision for maintenance.
Seconded by Councilmember Christenberry, motion passed unanimously by voice vote.

RESOULTION NO. 1297-06
WHEREAS, the Owners of Woodlawn Subdivision desire to have all public streets and
public right-of-ways dedicated on the plat filed for record in the Probate Records of
Baldwin County, Alabama, on Slide 2263D, 2263E, 2263F, and all Fairhope public
utilities located in public right-of-ways accepted for maintenance by the City of Fairhope,
Alabama, and;
WHEREAS, the City of Fairhope, Alabama, has received notice from the engineers of
the project that the design and capacity of the public improvements have been designed in
conformance with City requirements as indicated on the recorded plat, and;
WHEREAS, the Public Works Director has indicated that the improvements meet City
requirements, and;
WHEREAS, the City of Fairhope, Alabama, is not and in no manner will be responsible
for the maintenance of common areas in the subdivision as indicated on the recorded plat,
and;
WHEREAS, the City of Fairhope, Alabama, has received from the owners of Woodlawn
Subdivision maintenance bonds for the public improvements constructed for a period of 2
years, and;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA that the public improvements indicated herein for
Woodlawn Subdivision are hereby accepted for public maintenance subject to the bond
posted.

Margaret Dumas a resident of 352 Patlynn Drive addressed the City Council
requesting the construction of permeable surface sidewalk on south Patlynn Drive,
Weston Fairwood Boulevard to Fairhope Middle School. Mayor Kant stated that several
streets in this area are being looked at. Mrs. Dumas thanked the City Council for their
consideration in this matter.

Councilmember Ford moved to approve the Public Works Project to construct
restrooms for new stadium at Volanta Ball Park. The total cost of the restroom will be
$31,200.00. Seconded by Councilmember Stankoski, motion passed unanimously by
voice vote.

Daphne, Alabama for fencing at Quail Creek Golf Course. Seconded by Councilmember

Councilmember Ford moved to accept the low bid of Southeastern Data, Tucker,
Georgia for Electronic Metering. Seconded by Councilmember Quinn, motion passed
unanimously by voice vote. This purchase will be paid for by the three utilities.
Councilmember Christenberry moved to pay bills as presented. Seconded by
Councilmember Ford, motion passed unanimously by voice vote. At the next regular
City Council meeting the Council will consider changing the way the City pays its bills.

Mayor Kant asked the Council President if they could go into Executive Session
to discuss an anticipated litigation regarding a building permit. City Attorney Marion E.
Wynne presented to Council President Gentle in writing declaring to go into Executive
Session to discuss an anticipated litigation regarding a building permit.
Council President read/announced to the audience that the City Council will rise from
this meeting to go into Executive Session to discuss anticipated litigation regarding a
building permit and will return to the dais to close the City Council meeting in
approximately 15 minutes.
At 6:26 p.m. Mayor Kant, all Councilmembers and the City Attorney exited the dais.
At 6:38 p.m. Mayor Kant, all Councilmembers and the City Attorney returned to the dais.
There being no further business to come before the City Council the meeting was
duly adjourned at 6:41p.m. Lj
