HomeMy WebLinkAbout04-24-2006 Regular Meeting3823 STATE OF ALABAMA I--0190 n'��l�i:�:�11�1�d/1�l The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday. 24 April 2006. Present were Council President Robert C. Gentle, Councilmembers: Debbie W. Quinn, Cecil Christenberry, and Michael A. Ford; Mayor Timothy M. Kant, City Attorney Marion E. Wynne and City Clerk Geniece W. Johnson. Councilmember Daniel Stankoski was absent. There being a quorum present, Council President Gentle called the meeting to order. The Pledge of Allegiance was recited, and Rev. James Cook Minister at Fairhope United Methodist Church, gave the invocation. Councilmember Christenberry moved to approve minutes of the 10 April 2006, regular meeting. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Mayor's Comments and Staff Reports: • Barry Fulford, Building Official addressed the City Council stating that the City of Fairhope should review a potential ordinance to keep red clay out of Mobile Bay To prohibit building permits for construction which use clays; red clays; red soils and other materials, which may harm aquatic plants or marine life and discolor water or beaches, from being used in Flood zones, potential floodways, coastal frontage and waterways. Clays and red soils shall not be permitted for construction; including but not limited to roadways, driveways, foundations, bulkheads and fill in prohibited areas Suspended solids of clays, block out sunlight needed for aquatic plants and also settle in gills of fish. Most grasses of Mobile Bay thrive best in sandy bottoms. Settlements of clays produce mud flats that inhibit growth of aquatic plants. Red clay and soils are high in iron oxides and other metals. Natural bacteria thrive on this which draws oxygen from the water and smother aquatic habitats. AREA: • Southern most Police Jurisdiction boundary on the west side of Highway 1 or Flood Zone which ever is greater to Scenic Highway 98. • West side of Scenic Highway 98 or Flood Zone which ever is greater to Fairhope Ave. • All coastal Bluff areas and Flood Zones from Fairhope Ave to Northern most Police Jurisdiction. • Within Police Jurisdiction 100' outside the 100 year flood plane of all rivers, streams, creeks or tributaries. • Within Police Jurisdiction 50' beyond the outer boundary of all wetland. Delineations must be approved by appropriate agencies. All Construction must have Best Management Practices (BMP's) in place before land disturbance begins and maintained until all disturbances have been stabilized. City Council President Gentle stated that the Council should have a work session to work in this proposed ordinance. 3824 24 April 2006 • Dan McCrory, Water/Sewer Superintendent addressed the City Council to update the Montrose Sewer Project is moving along well. On Wednesday, April 19'h Daphne water line broke at about 12:00 a.m. After Fairhope Water/Sewer Department gain approval from ADEM to backfeed Daphne Utilities waster system to provide water to the Montrose resident for approximately 26 hours. Mr. McCrory also expressed that the following employees did a wonderful job in assisting Daphne with this crisis: Kevin Hempfleng, Curtis Cooper, Thomas Billadeau, William Stanczak, and John Keller. • Aaron Norris, Electric Department superintendent addressed the City Council to update the City Council on the Young Substation Project. The project is coming along well and the transformer has arrived. The new transformer should be up and running by the end of May for the summer peak. • Rose Fogarty and Nancy Wilson Accounting Department presented the following power point presentation: • Mayor Kant announced that Gregg Mimms has been hired as the City`s new Director of Planning. Mr. Mimms will started working with the City on May 8, 2006. • Mayor Kant announced that the Legislature has passed charging impact fees in the State of Alabama. Council President Gentle encourages Mayor Kant to move with staff to implement impact feed with in Fairhope. The City will work with the County on this ordinance. The City has 90 days before it can start charging impact fees. The fees must be spent within 2-years or the city will have to give back the fees collected. Mayor Kant presented the following Proclamation to Geniece W. Johnson, City Clerk proclaiming the week of April 30 through May 6, 2006 as Municipal Clerk's Week. Councilmember Quinn introduced in writing Ordinance No. 1300. An ordinance annexing property of Doug Harless, located at 9623 Gayfer Road Extension, Fairhope, Alabama. Contains 20.31 acres more or less. The Magnolias 46-02-10-000-056.000. In order to take immediate action Councilmember Christenberry moved for immediate consideration. Seconded by Councilmember Ford, motion for immediate consideration passed unanimously by the following voice votes: AYE -Quinn, Christenberry, and Gentle. NAY -none. Councilmember Quinn then moved for final adoption of Ordinance No. 1300. Seconded by Councilmember Christenberry, motion for final adoption passed unanimously by the following voice vote: AYE- Quinn, Christenberry, and Gentle. NAY -none. Mayor Kant stated that the City of Daphne voted not to participate in the tri-city watershed grant. If the City of Fairhope moved to participate in this grant the cost will be split between the City of Foley and the City of Fairhope. Councilmember Ford moved to decline the tri-city watershed grant. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. This item was continued from regular City Council meeting on April 10, 2006. Council President Gentle read the following report from the Fairhope Environmental Advisory Board: 3826 24 April 2006 To: The Mayor, Bob Gentle, and the Fairhope City Council From: Fairhope Environmental Advisory Board Date: April 19, 2006 What: Highlight summary of the info from us that you received about the to -city "STAG grant," discussed at the last City council meeting DAPHNE .LATE -BREAKING UPDATE: During the Daphne City Council meeting, Monday, April 17, 2006, the Daphne City Council members voted NOT to participate in the STAG grant. Reasons given: due to high costs with minimal returns. REGARDING FAIRHOPE: PROS, NEUTRAL, and CONS PROS: Possibility of Added Grant Money • This is not a certainty -just a possibility. If we do NOT participate in the grant, we will NOT jeopardize receiving any future grant money. NEUTRAL: Unified Storm Water Codes We can also do this as an offshoot of the programs by the consultant, Andy Reese, which will cost the City of Fairhope less than $3,500, and it does NOT require any in- kind services. • Therefore, we would not either gain or lose anything from this aspect of the grant. CONS: Work Plan Redundancy as to What Already Exists • Cara Stailman has detailed all of the redundancies between what this work plan is supposed to produce and what already exists. • HMR has further stated that the work plan cannot be changed. COSTS: With Daphne not participating in this grant, matching funds and the costs to Fairhope will INCREASE to $22,500 in cash and $225,000 for in -kind services. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. RESOLUTION NO.1286 MUNICIPAL WATER POLLUTION PREVENTION (MWPP) PROGRAM ATTACHMENT 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that Timothy M. Kant is hereby authorized to inform the Department of Environmental Management that the following actions were taken by the City Council of the City of Fairhope, Alabama. 1. Reviewed the MWPP Annual Report which is attached to the resolution. 2. Set forth the following actions and schedule necessary to maintain effluent requirement contained in the NPDES Permit, and to prevent the bypass and overflow of raw sewage within the collection system or at the treatment plant: No action was required to be taken by the City of Fairhope Passed this 24th Day of April , 2006 by an unanimous vote I, Geniece W. Geniece W. Johnson, City Clerk Date W 24 April 2006 City Council reviewed an application for a Restaurant Liquor License by Ronan McSharry, dba McSharry's Irish Pub, located at 68 N. Bancroft Street, Fairhope, Alabama. Councilmember Christenberry moved to approve the issuance of the license. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Mayor Kant addressed the City Council expressing that the City Treasurer needs the authorization to secure additional funds to address the shortfall of monies for the new Library Project. Mayor Kant further stated that the City will have a 7 to 8 million dollar library, but it will be very nice. If the City is going to move forward to finish the library the City Council needed to authorize a bridge loan of 2 million dollars. The City Council also needs to resolve the issue of how the City will pay back the 1" 1.5 million dollar for the new library project. Council President Gentle stated that this is a loan. The City has committed to only 3 million dollars; however, the city must cover what has already been voted on which is a shortfall of approximately $860,000.00. The Library Board is asking the City Council to borrow an additional 1.070 million in order to finish everything. Councilmember Christenberry stated that we are not building a library for 2006 or 2007, but we are building a library for the next 100 years. Councilmember Quinn moved to secure a line of credit of 2 million dollars to finish the library. Seconded by Councilmember Christenberry, motion passed by the following voice votes: AYE - Quinn, Christenberry, and Gentle. NAY -Ford. 3829 24 April 2006 Dick Charles addressed the City Council to present the following report of the Blue Water Committee: Blue Water Committee Report - Our assignment was to create a county -wide storm water management program. -Determine what constitutes a drainage problem, which has been done. -We have met with all mayors and the county commission to explain our proposal for developing an acceptable storm water program and a funding mechanism for the program. -The legislative delegation, consisting of Steve McMillan, Joe Faust and Senator Bradley Byrne, were also briefed on this program. -We have obtained commitments for grants of $25,000 from Mobile Bay NEP, Weeks Bay and Alabama Coastal Foundation, which should pay about one-half of estimated consulting costs. -Next step is to obtain final commitment from all municipalities and county that they will participate and pay their share of costs not covered by the grant. Summary of Storm Water Problem -Storm water regulations are different throughout the county. Older subdivisions have less effective regulations. Increasing population means more impervious surfaces and increasing amounts and velocity of storm water runoff. -With few exceptions, there are no enforceable requirements for maintaining detention ponds and conveyance systems. There are few, if any, maps that show existing storm water facilities. -The public does not yet recognize that storm water management is a utility, just like waste -water and potable water, and that utility fees will have to be charged to maintain this infrastructure. -Our state delegation must provide the legislation needed for Baldwin County storm water utilities to charge such fees. This legislation must be flexible to allow individual or groups of municipalities to form storm water utilities. Monthly utility fees would vary with lot size, amount of impervious surface, whether residential or commercial, etc. Also, individual towns should be able to choose whether they wish to participate in a utility. 24 April 2006 Proposed Program and Its Cost 3830 -We propose a series of one -day conferences, up to six, to review the alternatives for managing storm water within the county. The participants will decide how to implement the desired program. -Andy Reese, VP of AMEC Earth and Environmental, would guide and moderate the conferences. We believe that Mr. Reese's experience in several states, as well as Alabama, makes him qualified for this assignment. Consulting cost has been estimated at $40,000 to $60,000. -We propose that each municipality designate one person, plus an assistant and one alternate, to speak for it. This person should be a senior staff member who is able to make decisions for the municipality. -The county would also have delegates of a similar stature representing it. The Baldwin County delegation should also participate in order to be familiar with requirements. -Mr. Yeager, Director of Mobile Bay National Estuary Program, has provided us with a commitment letter for the $25,000 grant. The letter states that the grant is conditional on multi -city and county participation. He has also said that NEIP would be willing to and has the staff to contract directly with AMEC, which should remove possible political conflict and reduce our effort. -Costs not covered by the grant would be paid by the cities and county on a population basis. Fairhope's share would amount to only $3400, assuming the full $60,000 was required. Commissioner Bishop has promised his discretionary funds to pay the county's share. City Council Consideration -Blue Water Committee has drafted a letter from Mayor Kant to Baldwin County mayors and the county commission asking for their written approval of the program just described. Upon their approval, AMEC will schedule the first conference. The draft letter is available for your review. -The City Council should also consider the following: 1. Modify the Winn -Dixie retention pond to reduce downstream flooding on Cowpen Creek. 2. Retain professional engineer to modify Subdivision Regulations to better handle storm water runoff for commercial establishments. This person should also review runoff coefficients in use by today's engineers, which may be too liberal for Baldwin County, considering our rapid growth in the past several decades. 3. Complete south retention pond at high school to reduce downstream flooding. 4. Correct Tatumville Gully to reduce sediment and addition of rip -rap where needed. 5. Other recommendations on the Environmental Board's "to Do" list. 3831 24 April 2006 Councilmember Quinn moved to authorize Mayor Kant to write a letter to the Baldwin County mayors and the county commission asking for their written approval of the County -wide Storm Water Management Program, and to authorize the expenditure of $3,500.00 for this program. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. Councilmember Christenberry moved to reschedule the May 8th regular City Council Meeting to Thursday May 11, 2006, due to the Alabama League Conference.
