NOTICE AND CALL OF SPECIAL MEETING
Notice is hereby given of a special meeting of the City Council of the City
of Fairhope, Alabama, to be held at the Fairhope Municipal Complex on Friday,
10 February 2006, at 10:00 a.m., for the purpose to:
• Report on Baldwin EMC Court Case

CONSENT TO HOLDING OF MEETING
The undersigned member of the City Council of the City of Fairhope,
Alabama, do hereby acknowledge service of the Notice and Call of Special
Meeting hereinabout set forth and do hereby consent to the holding of such
meeting as such time in such place for the purpose set forth therein.

The City Council, City of Fairhope, met in Special City Council meeting at
10:00 a.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Friday, 10 February.
Present were Council President Robert C. Gentle, Councilmembers: Daniel
Stankoski, Cecil Christenberry, and Michael A. Ford; Mayor Timothy M. Kant and
City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson.
Councilmember Debbie W. Quinn and Councilmember Ford were absent.
There being a quorum present, Council President Gentle called the meeting to
order.
Council President Gentle read a written notice from Mayor Kant requesting on
behalf of Caine O'Rear, City of Fairhope attorney with Hand Arendall, that the
Fairhope City Council go into executive session to hear a report on the Baldwin EMC
case. Councilmember Stankoski moved to rise from the City Council Chambers to go
into executive session to hear a report on the Baldwin EMC court case. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.
Council President Gentle announced that the Executive Session may last
approximately 30 minutes to an hour, and exited to go into executive session at 10:02
a.m.
At 10:06 a.m. the City Council, Mayor Kant and City Attorney Marion E. Wynne,
and Councilmember Ford returned to the dais. Council President Gentle stated that
the City Attorney must declare that the City Council go into Executive Session to
clarify things. Mrs. Johnson stated that to go into Executive Session may be in
writing or stated orally.
City Attorney, Marion Wynne, stated that he declare the City Council to go
into Executive Session. Councilmember Stankoski moved to rise from the City
Council Chambers to go into executive session to hear a report on the Baldwin EMC
court case. Seconded by Councilmember Ford, motion passed unanimously by voice
vote.
Council President Gentle announced that the Executive Session may last
approximately 30 minutes to an hour, and exited to go into executive session at 10:08
a.m.

At 10:46 a.m. the City Council, Mayor Kant, City Attorney Mr. Wynne, and Caine
O'rear, City Attorney with Hand Arendall, returned to the Council Chambers and
resumed the special City Council meeting.
Councilmember Ford moved to authorize Mayor Kant to proceed with the settlement
plan on the Baldwin EMC Court Case. Seconded by Councilmember Christenberry,
motion passed unanimously by voice vote.
There being no further business to comeF
re the City Council the meeting
was duly adjourned at 10:47 a.m.
