The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Wednesday, March 16, 2005.
Present were Council President Robert C. Gentle, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford; Mayor
Timothy M. Kant and City Clerk/Treasurer Geniece W. Johnson. City Attorney
Marion E. Wynne was absent.
There being a quorum present, Council President Gentle called the meeting to
order. The Pledge of Allegiance was recited, and Councilmember Christenberry,
gave the invocation. Councilmember Quinn moved to approve minutes of the 28
February 2005, regular meeting. Seconded by Councilmember Christenberry, motion
passed unanimously.
Earl Jackson, President of the Mobile Opera, introduced Lauren Zoghby. Ms.
Zoghby sang God Bless America; afterwards Mayor Kant presented the following
Proclamation to Lauren Zoghby.

LAUREN ZOGHBY DAY
WHEREAS, LAUREN ZOGHBY, THE DAUGHTER OF LISA AND MICHAEL
ZOGHBY, WAS RAISED IN FAIRHOPE, ALABAMA, AND GRADUATED FROM
FAIRHOPE HIGH SCHOOL IN 1997, WITH MANY HONORS THEN WENT ON TO
GRADUATE FROM THE UNIVERSITY OF SOUTH ALABAMA WITH A
BACHELOR'S DEGREE IN VOCAL PERFORMANCE, REPRESENTING THE
UNIVERSITY AS MISS UNIVERSITY OF SOUTH ALABAMA IN THE MISS
ALABAMA PAGEANT, WINNING THE TALENT PRIZE FOR HER VOCAL
PERFORMANCE, AND NOW LAUREN IS CURRENTLY CONTINUING HER
MUSICAL AND VOCAL STUDIES AT THE UNIVERSITY OF HOUSTON AND IS A
CANDIDATE FOR THE ESTEEMED DEGREE OF DOCTOR OF MUSICAL
ARTS IN VOCAL PERFORMANCE; AND
WHEREAS, LAUREN HAS APPEARED IN NUMEROUS PRODUCTIONS WITH
MOBILE OPERA, BOTH AS A MEMBER OF THE CHORAL ENSEMBLE AND AS A
FEATURED SOLOIST AND IS CURRENTLY PREPARING FOR PERFORMANCES AS
ZERLINA IN MOBILE OPERA'S PRODUCTIONS OF WOLFGANG AMADEUS
MOZART'S DON GIOVANNI WITH PERFORMANCES ON MARCH 17 AND 19, 2005;
AND

WHEREAS, LAUREN HAS SERVED AS A GOOD -WILL AMBASSADOR FOR THE
CITY OF FAIRHOPE AND THE STATE OF ALABAMA AND SHE HAS SHARED HER
MUSICAL AND VOCAL TALENTS WITH CHILDREN AND ADULTS THROUGHOUT
OUR COMMUNITY WITH HER NUMEROUS PERFORMANCES IN SCHOOLS,
COMMUNITIES AND ASSISTED LIVING CENTERS; AND AS A PARTICIPANT IN
NATIONALLY RECOGNIZED OPERA TRAINING PROGRAMS AT DES MOINES
METRO OPERA AND CHAUTAUQUA OPERA.
NOW THEREFORE, I, TIMOTHY M. KANT, AS MAYOR DO HEREBY PROCLAIM
MARCH 16, 2005, AS LAUREN ZOGHBY DAY IN FAIRHOPE AND ASK OUR
CITIZENS TO JOIN WITH ME IN RECOGNITION OF THE TALENTS AND
ACCOMPLISHMENTS OF THIS VALUED FAIRHOPE NATIVE.
Mayor's Comments and Staff Reports:
Christopher Baker introduced Summer Woodson as the new addition to the Building
Department, as Planning and Building Assistant.
Earl Blackmon with Hartman, Blackmon, and Kilgore addressed the City
Council and gave a brief report of the 2003-2004 Audit. A copy of the 2003-2004
Audit shall be spread upon the minutes of the City of Fairhope (under a separate
cover). Earl Blackmon announced that the City received the highest level of opinion
and unqualified statement, and Mr. Blackmon thanked all City employees for their
help and participation. Councilmember Ford moved to accept the audit. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.
Councilmember Quinn introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Kant to execute a grant to
receive a handicap accessible van for Senior Citizen Transportation for the James P.
Nix Center. Seconded by Councilmember Ford, motion passed unanimously by voice
vote. The payment for the van will come out of General Operating.
RESOLUTION NO. 1097-05
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA,
that authorize Mayor Kant to execute a grant to receive a handicap accessible van for Senior
Citizen Transportation for the James P. Nix. The base price for the van is $33,341. The City
of Fairhope will be responsible for paying 20% ($7,476.80) of the base price of the grant.
The 20% payment will come out of General Operating Fund.

Councilmember Christenberry introduced in writing, and moved for the
adoption of the following resolution, a resolution authorizing Mayor Kant to execute an
agreement between the City of Fairhope and U. S. Department of Agriculture NRCS for the
Emergency Watershed Protection Program, 2004 - Hurricane Ivan. The total estimated cost
is $311,250.00, $249,000.00 100% of construction cost and $62,250.00 of in -kind
services. Seconded by Councilmember Quinn, motion passed unanimously by voice
vote.
RESOLUTION NO. 1098-05
WHEREAS, under the provisions of Section 216 of Public Law 81-516, Emergency Watershed Protection
Program, and Title IV of the Agricultural Credit Act of 1978, Public law 95-334, NRCS is authorized to assist the
Sponsor in relieving hazards created by natural disasters that cause a sudden impairment of a watershed; and,
WHEREAS, the Sponsor and NRCS agree to a plan which provides for restoration of certain works of
improvement referenced in Section A.
NOW THEREFORE, in consideration of the premises and of the several promises to be faithfully performed by
the parties hereto as set forth, the Sponsor and NRCS do hereby agree as follows:
A. IT IS AGREED that the following described work is to be constructed at a total estimated cost of
$311,250.00. $249,000.00 100% of construction cost and $62,250.00 of in -kind services.

NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that Mayor Kant is hereby authorized to execute an agreement between the City of Fairhope and the United
States Department of Agriculture Natural Resources Conservation Service for an Emergency Watershed
protection program, 2004- Hurricane Ivan - $249,000.00 (100%) of construction cost and 62,250.00 in -kind
services.

The City Council addressed a resolution to accept the public streets, public
right-of-way, and all public utilities within Falls Creek for maintenance. Aaron
Norris, Electric Superintendent, addressed the City Council with concerns that it has
been a 33-year policy to have the developer to install streetlights in subdivisions, and
if the subdivisions are outside the city limits then the Homeowners Association would
install the street lights in subdivisions. However, for the pass year Mr. Norris has
experienced problems with this unwritten policy.
Christopher Baker explained that the Planning and Zoning Commission will be
amending the subdivision regulations at the April 4, 2005 meeting to address this
unwritten policy. Councilmember Christenberry and Councilmember Ford
questioned why is this a problem if this has been a 40-year policy? Councilmember
Stankoski expressed that this policy should be formalized in the form of an ordinance.
Councilmember Quinn moved to table this resolution for the next two weeks.
Seconded by Councilmember Christenberry, motion passed unanimously by voice
vote.
Councilmember Quinn introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Kant to execute a contract
between the City of Fairhope and Baldwin County Commission to accept the offer of
the County's GIS services to the City of Fairhope. These services are available to the
City free of charge through an EPA grant entitled the Baldwin County Wetland and
Watershed Protection Program. Seconded by Councilmember Stankoski, motion
passed unanimously by voice vote.
RESOLUTION NO. 1099-05
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that Timothy M. Kant is hereby authorized to execute a contract between The City of
Fairhope and Baldwin County Commission. This contract will allow the City of
Fairhope to receive GIS (Graphic Information System) services at no charge through
an EPA grant entitled the Baldwin County Wetland and Watershed Protection
Program.

Councilmember Stankoski moved to Update Fairhope Police Reserve Unit by
deleting: Trent Scott and by adding Jesse Arturo Villa. Seconded by Councilmember
Ford, motion passed unanimously by voice vote.
Councilmember Ford moved to make the following re-
appointments/appointment to the Board of Adjustment:
• Re -appoint Louis Agee — 3 year term
• Appoint Kathy Slagle to replace Bernie Fogarty — 3 year term
Seconded by Councilmember Christenberry, motion passed unanimously by voice
vote.
Councilmember Quinn moved to appoint Gary Moore to the Planning and
Zoning Commission to replace Larry Green (resigned). Seconded by Councilmember
Christenberry, motion passed unanimously by voice vote. This term will end June
2006.
Hannah Trice, Malory Chambers, and Emily Jones with the Eastern Shore
Chamber of Commerce Youth Leadership Program addressed the City Council
requesting a speed bump on Bishop Road near the intersection of Bishop Road and
Gayfer Avenue. This request was turned over to the Street Committee to study and
report back to the City Council.
Councilmember Christenberry moved to pay bills as presented. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
Hop Allen addressed the City Council requesting that the Mayors of Baldwin
County help to not allow the insurance companies to cancel coverage in this area due
to the recent storm, Hurricane Ivan.
There being no further business to come be e the City Council the meeting
was duly adjourned at 6:25 p.m.
