HomeMy WebLinkAbout02-14-2005 Regular MeetingSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 14 February 2005. Present were Council President Robert C. Gentle, Councilmembers: Debbie W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford; Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one was absent. There being a quorum present, Council President Gentle called the meeting to order. The Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the invocation. Councilmember Stankoski moved to approve minutes of the 24 January 2005, regular meeting. Seconded by Councilmember Christenberry, motion passed unanimously. Mayor's Comments and Staff Reports: Police Chief, Christopher Browning introduced to the Mayor and City Council the Police Department's three new officers: Eugene Maye, Trent Scott, and David Hall. Water/Sewer Superintendent Dan McCrory addressed the Mayor and City Council to explain the installation of Phase I for Montrose's sewer system. This sewer line system will be a pressure system and will be installed on the bayside of Main Street and stop at South Winding Brook Road. The estimated cost for Phase I, including the installation of a lift station, is estimated at $162,000.00. Mr. McCrory stated that there are approximately 450 potential customers in the Montrose area. Public Works Superintendent Jennifer Fidler addressed the Mayor and City Council to explain that the current rate of $7.80 charged for garbage does not cover the cost of providing this service. Ms. Fidler stated that in order to breakeven for the garbage services provided, the City would have to charge an additional $2.80. Ms. Fidler is excited to soon be using an automated truck for a portion of the City's pickups. Using the automated truck system will decrease the City's labor cost and hopefully reduce injuries. Ms. Fidler also addressed the Mayor and City Council to report on the City's Waste Management Status. The current short-term life expectancy for the City's landfill is one year. The current long-term life expectancy for the City' landfill is two years. Councilmember Christenberry, Chairperson of the Harbor Board, and Bob Pope, leasee of the Yardarm Restaurant and Marina, addressed the Mayor and City Council to request that the City Council look at a new proposed corporate lease for the Yardarm Restaurant and Marina. Due to the damage caused by the recent Hurricane Ivan, this is an opportunity to improve the facility. Council President Gentle stated that this item will be sent back to the Harbor Board, and the City Council will have a work session on this topic. A work session will be scheduled within the next ten days. 3490 14 February 2005 Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution accepting the public streets, public right-of-way, and all public utilities within Sandy Ford Phase III for maintenance. Seconded by Councilmember Quinn, motion passed unanimously by voice vote. Resolution No.1091-05 WHEREAS, the Owners of Sandy Ford Phase III desire to have all public streets and public rights -of -way dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama on Slides S-2195B and S-2195C, and all Fairhope public utilities located in public rights -of -ways accepted for maintenance by the City of Fairhope, Alabama, and; WHEREAS, the City of Fairhope, Alabama has received notice from the engineers of the project that the design and capacity of the public improvements have been designed in conformance with City requirements as indicated on the recorded plat, and; WHEREAS, the General Superintendent has indicated that the improvements meet City requirements, and; WHEREAS, the City of Fairhope, Alabama is not and in no manner will be responsible for the maintenance of common areas in the subdivision as indicated on the recorded plat, and; WHEREAS, the City of Fairhope, Alabama has received from the owners of Sandy Ford Phase III maintenance bonds for the public improvements constructed for a period of 2 years from the date of the approval of this Resolution, and; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the public improvements indicated herein for Sandy Ford Phase 3 are hereby accepted for public maintenance subject to the bond posted. Johnson, Cit lerkdreasurer 14 February 2005 Councilmember Quinn moved to authorize Aaron Norris, Electric Superintendent, to work out an easement and lease with Bellsouth Telecommunications, Inc. at Quail Creek Subdivision. Seconded by Councilmember Ford, motion passed unanimously by voice vote. City Council reviewed an application for a Restaurant Liquor License by Ralph R. Moody (Randy), dba Randy's, located at 19270 Scenic Highway 98, Fairhope, Alabama (Formerly Original Last Nacho). Councilmember Quinn moved to approve the issuance of the license. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. Councilmember Ford moved to approve Change order #3 by Esfeller Construction Company, Inc. at the H.L. "Sonny" Callahan Airport, Fairhope, Alabama, for an additional electrical junction box in fill area increasing the contract by $2,507.00. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. Councilmember Ford moved to approve the following re -appointments to the Recreation Board: Charlie Langham, Jim Godfrey, and Hank Mullins. The term shall be from May 2005 to May 2010. Seconded by Councilmember Quinn, motion passed unanimously by voice vote. Councilmember Ford moved to pay bills as presented. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. Councilmember Quinn moved to address an item not on the printed agenda. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Councilmember Quinn moved to finance the Montrose Sewer Project Phase I only by using the balance of the monies left in URW-1999 and by using monies from the URW-2002 for the balance due for phase I.
