The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 24 January 2005.
Present were Council President Robert C. Gentle, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Cecil Christenberry, and Michael A. Ford; Mayor
Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk/Treasurer
Geniece W. Johnson. No one was absent.
There being a quorum present, Council President Gentle called the meeting to
order. The Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent,
gave the invocation. Councilmember Quinn moved to approve minutes of the 10
January 2005, regular meeting. Seconded by Councilmember Stankoski, motion
passed unanimously.
Jennifer Fidler, Public Works Director, Tom Ellis, Chairperson of the Tree
Committee, and Jackie Frodsham, member of Tree Committee, presented the
following Arbor Day Proclamation.
PROCLAMATION
ARBOR DAY
WHEREAS, TREES ARE RECOGNIZED AS A VALID ASSET PROVIDING A MORE HEALTHFUL AND
BEAUTIFUL ENVIRONMENT IN WHICH TO LIVE; AND
WHEREAS, THEY PROVIDE OXYGEN, SHADE, AESTHETICS AND A PRICELESS
PSYCHOLOGICAL COUNTERPOINT TO THE MAN-MADE URBAN SETTING.
WHEREAS, TREES ARE ECONOMICALLY BENEFICIAL IN ATTRACTING NEW INDUSTRY,
RESIDENTS, AND VISITORS; AND
WHEREAS, WHEN GROWN IN THE RIGHT PLACE AND OF THE PROPER VARIETIES, THEY
ENHANCE THE VALUE AND MARKETABILITY OF PROPERTY, AND PROMOTE THE STABILITY OF
DESIRABLE NEIGHBORHOODS.
NOW THEREFORE, I, TIMOTHY M. KANT, AS MAYOR OF THE CITY OF FAIRHOPE DO HEREBY
PROCLAIM TUESDAY, FEBRUARY 19, 2005, AS ARBOR DAY IN THE CITY OF FAIRHOPE,
RECOGNIZING THE IMPORTANCE OF TREES IN OUR ENVIRONMENT AND THE RESPONSIBILITY
WE HAVE TO MAINTAIN AS MANY NATURAL TREES AS POSSIBLE FOR GENERATIONS TO COME
AS WELL AS IMPLEMENTING WHEN WE CAN.

FURTHER, BE IT RESOLVED THAT I URGE ALL OUR CITIZENS TO DO THEIR PART IN MAKING
OUR ENVIRONMENT POLLUTION FREE THEREBY IMPROVING THE ECONOMIC AND CULTURAL
CLIMATE OF THE COMMUNITY AND GROWING AND MAINTAINING TREES ON THEIR PROPERTY
WHEN THEY CAN.

Ms. Karen Moore, with Baldwin County Electric Membership Corporation,
presented Mayor Timothy M. Kant with their annual business license check. The
check in the amount of $70,458.26 represents a percentage of BCEMC's business
revenues within the City Limits of Fairhope and represents a percentage of BCEMC's
business revenues in the police jurisdiction.
Mayor's Comments and Staff Reports:
• Mayor Kant stated to make clear that if there is a short fall on the library project he
did not know where the additional monies would come from. Mayor Kant also stated
that as we move forward with the library project all monies raised for this project
should be deposited with the city treasurer to help with paying the bills and Tommy
Long will be the City's overseer of this project.
• Mayor Kant stated that there has been a lot of concern about the rumor that there
would be a charge for the annual Arts and Crafts Show.
• Mayor Kant reported that there would be a meeting held by the State Highway
Department of Transportation to go over the plans for State Highway 181 (Formerly
County Road 27). This meeting will take place Tuesday, January 25, 2005, at 5:00
p.m.
• Mayor Kant will have the Chief of Police to ascertain from the District Attorney why
gas prices in Fairhope are higher then the surrounding areas. The City does not have
a gas tax and the prices are still higher.
• Christopher Browning, Chief of Police, reported that it is Mardi Gras time. All
parade routes will be the same. The Chief expressed that good deeds come back to
you. The City of Fairhope assisted the City of Gulf Shores Police Officers after
Hurricane Ivan and now the City of Gulf Shores Police Officers will assist Fairhope
Officers with Mardi Gras parades.
• Rose Forgarty, Finance Director, gave a financial report for the Month of December
2004. No City Council action was required nor taken.

Councilmember Quinn moved to award the base bid for the Library Project to
JF Pate and Associates, Mobile, Alabama, in the amount of $ $3,969,000.00,
provided that all specifications are met. Seconded by Councilmember Christenberry,
motion passed unanimously by voice vote. The City will look at awarding Phase I, H,
and IV revised as soon as practical.
City Council reviewed an application for a Beer/Wine Off -Premises License
by Paul Moore, dba Bay Shores Market, located at 9990 Fairhope Avenue, Fairhope,
Alabama. Councilmember Ford moved to approve the issuance of the license.
Seconded by Councilmember Christenberry, motion passed unanimously by voice
vote.
Councilmember Quinn moved to make the following appointments to the
Library Board:
Jenny Stimpson to replace Elouise Benford (Deceased). This is a four (4) year term.
Justin Robertson to replace Jim Gilbert (moved). This term will end April 2006
Seconded by Councilmember Stankoski, motion passed unanimously by voice vote.
Councilmember Ford moved to appoint Derrick Thomas to the Recreation
Board. Mr. Thomas will replace Larry Thomas (resigned), his father. Seconded by
Councilmember Quinn, motion passed unanimously by voice vote.
Councilmember Christenberry reported that the Harbor Board has met twice
to discuss a new lease at the Yardarm Restaurant and the Marina. Councilmember
Christenberry stated that a draft of the new lease will be given to the City Council and
will come before the City Council for consideration on the first meeting in February.
Councilmember Ford moved to address and item not on the printed agenda.
Seconded by Councilmember Quinn, motion passed unanimously by voice vote.
Ack Moore with Moore Engineering addressed the City Council requesting
that the City Council amend the bid awarding for repairing the Municipal Pier
damaged by Hurricane Ivan to include approval of Alternate #1 of Morgan Dredging
and Pile Driving, Spanish Fort, Alabama. This will decrease the contract by $146.00.
Councilmember Quinn moved to approve the amendment. Seconded by
Councilmember Christenberry, motion passed unanimously by voice vote.

Dr. Hollis Wiseman addressed the City Council expressing that the Library
Board is going to continue with the plans for the new library as designed. Dr.
Wiseman also thanked the Mayor and City Council for their commitment to allow the
use of the Nut Processing Property for the new library and for their commitment of 3
million dollars for this project.
Councilmember Ford addressed the City Council clarifying that the City
Council has approved allowing the use of certain city street for the Arts and Crafts
Show. The City never approved fencing off the downtown area and charging to
attend the Arts and Crafts Show.
Marion E. (Tut) Wynne, City Attorney, confirmed that fencing off the downtown area
and charging to attend the Arts and Crafts Show was never a part of the City
Council's actions, and the City Council would have to approve this before this could
take place.
There being no further business to come ore the City Council the meeting
was duly adjourned at 6:06 p.m.
