HomeMy WebLinkAbout10-25-2004 Regular Meeting3420 STATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 25 October 2004. Present were Council President Robert C. Gentle, Councilmembers: Debbie W. Quinn, Daniel Stankoski, Cecil Christenberry and Michael A. Ford; Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one was absent. There being a quorum present, Council President Gentle called the meeting to order. The Pledge of Allegiance was recited, and Geniece W. Johnson, City Clerk/Treasurer, gave the invocation. Councilmember Quinn moved to approve minutes of the 11 October 2004, regular meeting. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. The Fairhope Industrial Board, Baldwin County Economic Development Alliance, and the Eastern Shore Chamber of Commerce were presented the following proclamation proclaiming the week of October 25 — 29, 2004 Industry Appreciation Week PROCLAMATION INDUSTRY APPRECIATION WEEK OCTOBER 25 — 29, 2004 WHEREAS, the City of Fairhope is pleased to have a thriving base of industry to support the local economy; and, WHEREAS, These industries provide essential employment opportunities for the citizens of the Fairhope and provide local revenue from which the entire local citizenry benefit; and, WHEREAS, These industries also make significant contributions in out city to promote educational opportunities for our children and promote a variety of activities which increase the quality of life of the area, and, WHEREAS, We recognize and appreciate these industries. NOW THEREFORE, We, the City of Fairhope, the Baldwin County Economic Development Alliance, and the Eastern Shore Chambers of Commerce, hereby recognize our existing industries, and by virtue of the proclamation give notice dot our citizens that the industries of the City of Fairhope are recognized and appreciated. It is further proclaimed that the week of October 25 — 29, 2004, is INDUSTRY APPRECIATION WEEK IN FAIRHOPE, ALABAMA. 3421 25 October 2004 Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution lifting the Moratorium on annexation due to the 2004 Municipal Election, and allowing annexations for the month of December 2004 and resuming the regular quarterly schedule for annexation on January 1, 2005. RESOLUTION NO. 1067-04 MORATORIUM ON ANNEXATION WHEREAS, The City of Fairhope currently conducts annexations on a quarterly basis: The Second City Council meeting of January, April, July and October; and, WHEREAS, It is required by law to have a clearance letter from the U. S. Department of Justice, Civil Rights Division, Voting Section, Washington, DC on all annexations; and, WHEREAS, A Municipal Election was held August 24, 2004, and a Run-off Election was scheduled for September 14, 2004, if necessary. WHEREAS, the City's regular scheduled annexation is July 26, 2004. There would not have been ample time to receive the required clearance letter from the U.S. Department of Justice; and, THEREFORE, The City Clerk is requesting of the Governing Body of the City of Fairhope, Alabama, to place a moratorium on annexations effective May 1, 2004 - January 1, 2005. The City will conduct regular annexations on January 24, 2005. BE IT FURTHER RESOLVED, That the City of Fairhope scheduled Run-off Election was not necessary. Therefore I Geniece W. Johnson, City Clerk/Treasurer of the City of Fairhope hereby request that the moratorium placed on annexations be lifted immediately, and allow annexation to take place during the month of December 2004, and resume regular quarterly scheduled annexations January 1, 2005. This duly adopted Resolution shall be published once in the local Gulf Coast Newspaper. Adopted and Approved this the 251' Day of October , 2004. Attest: Geniece W. This resolution authorizes Mayor Kant to match additional funds of $86,040.00, but not to exceed, for the Baldwin County Commission Grant of $320,000.00 for the Kirkman Lane Neighborhood Sewer Project. Seconded by Councilmember Ford, motion passed unanimously by voice vote. RESOLUTION NO. 1068-04 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, that Mayor Timothy M. Kant is hereby authorizes Mayor Kant to match additional funds of $86,040.00, but not to exceed, for the Baldwin County Commission Grant of $320,000.00 for the Kirkman Lane Neighborhood Sewer Project. Johnson, City Cle re surer Councilmember Christenberry introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing an appropriation of $10,000.00 to the Ecumenical Ministries Inc. Seconded by Councilmember Quinn, motion passed unanimously by voice vote. RESOLUTION NO. 1069-04 WHEREAS, in Fairhope, Alabama, Ecumenical Ministries Incorporated (EMI) is a public, non-profit, non- denominational, United Way social service agency; and, WHEREAS, EMI's mission is to improve the quality of life in Baldwin County by meeting basic needs, encouraging personal growth, effecting social and economic justice and celebrate our common life; and, WHEREAS, EMI provide services to the socio-economic and those in crisis situations and have no place to turn for help on the Eastern Shore, including Fairhope and South Baldwin County. The services rendered include: • Emergency Aid — Direct assistance for medical, food, utilities, rent, clothing, child care, transportation and other emergency needs. • Meals on Wheels (MOW'S) — Volunteer's deliver nutritious, warm meals six days a week. Meals are subsidized based on need and funding — Fairhope area has nine routes. • Home Repair — These projects include plumbing, electrical work, rebuilding floors, installing windows and doors, roofing, building wheelchair ramps and more. This program is for the elderly and disabled. 3423 25 October 2004 • Food Pantry — Our pantries provide a week's supply of food based on the size of the family and their situation. • Prescription Assistance — This program allows under -insured and non-insured persons to receive life sustaining medications at reduced or no cost through pharmaceutical companies indigent care program. EMI also provide prescription assistance through the Ozanam Charitable Pharmacy in Mobile. • Church -based Community Organizing — This program empowers poor and moderate income families to participate effectively in our democratic system and allow community members the opportunity to address the issues affecting their lives: paved streets, lighting, sewage, recreation and drainage. • Christmas Sharing — Children age newborn to 13 and homebound elderly receive gift request so they will have a memorable Christmas. Home health agencies deliver gifts to the elderly. Community Santa's sponsored 220 children and 66 elderly in Fairhope and distributed 110 holiday food boxes. • Gleaning Program — Local grocers, fruit markets, restaurateur and farmers provide fresh produce and other food products to low income families and shutins. • EMMY'S Thrift Shop — Through our emergency aid center vouchers are given at no cost. With these vouchers, people can receive such items as appliances, furniture, clothing, etc.. WHEREAS, Ecumenical Ministries Incorporated has served Fairhope residents since 1969 on a continuous basis and successfully demonstrated the capacity to operate a neighborhood based on social service agency improving countless lives; and, WHEREAS, Ecumenical Ministries support for the 2004-05 fiscal year. EMI's 2003-04 operating budget was $321,492.00. The projected funding is primarily derived from individuals ($76,000.00), United Way ($60,000.00), local churches (30,000.00), Chili for Charity (20,000.00). The remaining funding comes from various sources such as grants business contributions and EMMY's Thrift Shop BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that Mayor Timothy Kant is hereby authorized to establish a contract for services between the City of Fairhope and Ecumenical Ministries Incorporated to appropriate the sum of $10,000.00 to be used for the needs of Fairhope residents. Councilmember Stankoski introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing an appropriation of $5,000.00 for the Arts Bridging Creativity Program. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. 25 October 2004 RESOLUTION NO. 1070-04 3424 WHEREAS, a contract shall be executed between the City of Fairhope and the Eastern Shore Art Center for contract funding for the Arts Bridging Creativity (ABC) program in the amount of $5,000.00; and, WHEREAS, this program has expanded from the Fairhope K-1 Center to the Fairhope Elementary, Intermediate, and Middle School, and due to the demand for this program, additional funding is necessary; and, WHEREAS, the term of said contract shall be for one year, beginning 1 October 2004 and ending 30 September 2005, but the contract shall be cancelled at any time upon notice; and, WHEREAS, payment shall be made quarterly in the amount of $416.76 from the three Utility Funds of the City of Fairhope. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to sign a contract between the City of Fairhope and the Eastern Shore Art Center for funds to supplement the coordinator's salary and program expenses associated with the Arts Bridging Creativity Program. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. RESOLUTION NO. 1071-04 WHEREAS, a contract shall be executed between the City of Fairhope and the Boys' and Girls' Club of Fairhope, making an appropriation of $30,000.00 WHEREAS, the term of said contract shall be for one (1) year, beginning 1 October 2004 and ending 30 September 2005; but the contract shall be cancelled at any time upon notice. WHEREAS, payment shall be made quarterly in the amount of $2,5000 from the three Utility Funds of the City of Fairhope. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT Mayor Timothy M. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. RESOLUTION NO. 1072-04 WHEREAS, a contract shall be executed between the City of Fairhope and the Baldwin County Child Advocacy Center, making an appropriation of $2,000.00 WHEREAS, the term of said contract shall be for one (1) year, beginning 1 October 2004 and ending 30 September 2005; but the contract shall be cancelled at any time upon notice. WHEREAS, payment shall be made in the amount of $2,000.00 from the three Utility Funds of the City of Fairhope. Seconded by Councilmember Ford, motion passed unanimously by voice vote. RESOLUTION NO. 1073-04 WHEREAS, a contract shall be executed between the City of Fairhope and the American Red Cross, Alabama Gulf Coast Chapter, making an appropriation of $3,500.00 WHEREAS, the term of said contract shall be for one (1) year, beginning 1 October 2004 and ending 30 September 2005; but the contract shall be cancelled at any time upon notice. WHEREAS, payment shall be made in the amount of $3,500.00 from the three Utility Funds of the City of Fairhope. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT Mayor Timothy M. Johnson, City Cle reasurer 3426 25 October 2004 Council President Gentle suggested laying over a resolution authorizing Mayor Kant to pledge an appropriation payment to Thomas Hospital's Campaign for Heart in the amount of $25,000.00. The first year the city participated in this pledge when the Hospital was experiencing financially difficulties. This item will layover for 6 months to see how Thomas Hospital is doing financially. City Council reviewed an application for a Restaurant Liquor License by Terra Woods Berry, dba Guy's Gumbo Shack, (Blue Pig Inc.), located at 312 Fairhope Avenue, Fairhope, Alabama. Councilmember Quinn moved to approve the issuance of the license. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Council President Gentle stated that the Council would continue to have monthly finance meetings each 4`h Monday of the month at 4:00 p.m. The Council also discussed having the Update Meetings which were held every third Friday of each month. After discussion, Council President Gentle stated that these meetings would be held on a call bases. Councilmember Christenberry asked for full disclosure on all appropriations. He explained that these monies are not guaranteed and that the quarterly appropriations are only paid based on the availability of funds. Geniece W. Johnson, City Clerk/Treasurer, confirmed that Councilmember Christenberry was correct and that all quarterly appropriates are based on funds availability only.
