HomeMy WebLinkAbout10-11-2004 Regular Meeting3414 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday. 11 October 2004. Present were Council President Robert C. Gentle, Councilmembers: Debbie W. Quinn, Daniel Stankoski, Cecil Christenberry and Michael A. Ford; Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one was absent. There being a quorum present, Council President Gentle called the meeting to order. The Pledge of Allegiance was recited, and Rev. Stan Weatherford, Pastor of Faith Baptist Church, Fairhope, Alabama, gave the invocation. Councilmember Christenberry moved to approve minutes of the 4 October 2004, organizational meeting. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Mayor Kant presented the following Proclamation to Chauncey Packer. Mr. Packer sang God Bless America during the council meeting. PROCLAMATION WHEREAS, Mobile Opera is celebrating 59 years of providing residents along the Gulf Coast with a variety of high -quality and enthusiastically received opera performances and programs, and WHEREAS, Mobile Opera has endeavored to provide opportunities for aspiring young talent to develop their voices and careers, and WHEREAS, Mobile Opera has played a critical role in the development of Tenor and Fairhope native Chauncey Packet as rising star in the operatic world, and WHEREAS, Chauncey Packer, who was raised in Fairhope and was educated in the Fairhope public school system graduated in 1993 from Fairhope High School, and WHEREAS, Chauncey Parker has served his community by sharing his talent with many civic and community organizations, including a 2004 appearance in the upcoming Phantasy of the Arts, and WHEREAS, Chauncey Packer will honor us all with his hometown debut in the role of Lieutenant Pinkerton in Mobile Opera's production of Madame Butterfly, and THEREFORE, I, Mayor Tim Kant and the City Council of Fairhope, Alabama, do hereby proclaim Thursday October 21, 2004 as CIYAUNCEYPACSER DAY in the city of Fairhope , and encourage the attendance of all of our citizens at Madame Butterfly performances on October 21 & 23 to celebrate his debut in the role of Lieutenant Pinkerton. 3415 11 October 2004 Police Chief Christopher Browning presented Officer Ben Taylor with a Medal of Merit to display on his uniform for his outstanding community police work. Officer Taylor assisted an elderly citizen who suffers with Alzheimer and further aided the citizen with cleaning her home. Officer Taylor went over and beyond his call of duty to assist this elderly citizen. Councilmember Quinn moved for final adoption of Ordinance No. 1227, an ordinance amending the PUD for Ellington Place, the property of Gene Tillman, by increasing lot size, move lots and configuration, and over all decreasing the number of lots. This property is located at the North side of Windmill Road just West of County Road 27, Fairhope, Alabama. (PUD adopted by Ordinance No. 1177, September 22, 2003) (Public Hearing held Sept. 27, 2004). Seconded by Councilmember Stankoski, the motion for final adoption of Ordinance No. 1227 passed by the following voice votes: AYE -Quinn, Stankoski, Christenberry, Ford and Gentle. NAY -None. Councilmember Christenberry moved for final adoption of Ordinance No. 1228, an ordinance amending Phase One only of the PUD for Huntington Subdivision, the property of the Street Family, by changing the side setbacks on Lot 57 and Lot 60 to 10- foot side and 6 foot on all other sides as indicated on the Site Plan. This property is located West of US Highway 98, North of Old Battles Road, Fairhope, Alabama. (PUD adopted by Ordinance No. 1171, June 9, 2003 — Subdivision once known as Oak Hill Subdivision). (Public Hearing held Sept. 27). Seconded by Councilmember Quinn, motion for final adoption of Ordinance No. 1228 passed by the following voice votes: AYE -Quinn, Stankoski, Christenberry, Ford and Gentle. NAY -None. Councilmember Christenberry introduced in writing Ordinance No. 1229, an ordinance directing the disposal and declaring certain real property as surplus and not needed for public or municipal purposes — 10 feet in front of Dr. Harrell new office at 71 North Section Street. In order to take immediate action Councilmember Christenberry moved for immediate consideration. Seconded by Councilmember Quinn, motion for immediate consideration passed unanimously by the following voice votes: AYE -Quinn, Stankoski, Christenberry, Ford, and Gentle, NAY -none. Councilmember Quinn moved for final adoption. Seconded by Councilmember Christenberry, motion for final adoption of Ordinance No.1229 passed unanimously by the following voice votes: AYE -Quinn, Stankoski, Christenberry, Ford, and Gentle, NAY -none. Councilmember Quinn introduced in writing, and moved for the adoption of the following resolution, a resolution increasing golf cart fees. Seconded by Councilmember Stankoski, motion passed unanimously by voice vote. 11 October 2004 3416 RESOLUTION NO. 1062-04 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that Mayor Kant is hereby authorized to increase the City of Fairhope Quail Creek Golf Course Cart Fee. The increase of cart fees shall be effective as of November 1, 2004. Currently Increase Cart Fee - 18 holes $ 12.00 $ 14.00 Cart Fee - 9 holes $ 7.00 $ 8.00 Adopted this 1 lth Day of October , 2004 Councilmember Christenberry introduced in writing, and moved for the adoption of the following resolution, a resolution approving the Proposed Budget FY 2004-2005. Seconded by Councilmember Ford, motion passed unanimously by voice vote. 11 October 2004 RESOLUTION NO. 1065-04 3417 BE IT RESOLVED by the Mayor and Council of the City of Fairhope, Alabama, that the proposed Budget Presented and reviewed this 10th day of September 2004, be hereby approved and adopted for FY 2004- 2005; and BE IT FURTHER RESOLVED that the Annual Salaries of City Personnel shall be as shown on a list entitled Annual Salaries of All City Personnel - Res. No. 1065-04; said list filed in the Office of the Mayor, of the City Clerk, and of the Personnel Director; and BE IT FURTHER RESOLVED that each Full Time employee completing 12 (Twelve) months of employment without missing a work day for sick shall receive a special One Time Pay Increase of $100.00. The twelve month period is October 1 — September 30. BE IT FURTHER RESOLVED that each Full Time employee shall receive a One Time Pay Increase for the period 1 December 2002 through 30 November 2003, each qualifying employee shall receive $20.00 per month of employment. To qualify, the employee must be a Full -Time Employee during this period. An employee hired on or before the fifteenth (15) day of a month will be given credit for the full month; an employee hired on or after the sixteenth (16`h) day of a month will not be given credit for that month. In order to receive this One Time Pay Increase an employee must be employed on the 301h of November. For the same time period, and hiring rule each qualifying Part-time employee shall receive the following: First year $ 25.00 Second year $ 50.00 Third year $ 75.00 Fourth year $100.00 The maximum amount for Part-time employees is $100.00. In the past, temporary employees have not received anything. This One -Time increase will be awarded on Friday, 11 December 2004. BE IT FURTHER RESOLVED that the Mayor be authorized to enter into a contract with the Eastern Shore Chamber of Commerce to promote the City of Fairhope. The contract shall be for one year, 1 October 2004 - 30 September 2005, but may be canceled at any time. Contract shall call for a payment to the Eastern Shore Chamber of Commerce of $125.00 per month from the General Fund and $125.00 per month from each of the Utility Funds; or $6,000.00 for the one year term. Johnson, City er reasurer 3418 11 October 2004 Councilmember Quinn introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to execute a contract between the City of Fairhope and Roberds Corporation for Consultant/Construction Management services for the renovation of City Hall: foyer, office reception, payment center, lobby and waiting area. This project amount is $63,566.00, and shall be paid for by URW-2002 Bond Issue. Seconded by Councilmember Ford, motion passed unanimously by voice vote. Mayor Kant expressed that all parts of this project over $7,500.00 will be bid out. RESOLUTION NO. 1066-04 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, that Mayor Kant is hereby authorized to execute a contract between the City of Fairhope and Roberds Corporation, for Consultant/Construction Management services for the renovations of City Hall: Foyer, Office reception, payment, lobby and waiting area. This project amount is $63,566.00, and shall be paid for by URW- 2002 Bond Issue. ADOPTED THIS THE I Ith DAY OF October , 2004 M. Attest: Geniece W. Johnson, C' Clerk/Treasurer Councilmember Quinn moved to grant Eastern Shore Optimist Club's request, requesting the use of the City's property behind the site for the new Fairhope Public Library on Bancroft for their annual fund raising Christmas Tree Sale for 2004. (Old Nut Processing building location). Seconded by Councilmember Ford, motion passed unanimously by voice vote. Mac Walcott with Walcott Adams Verneuille Architects addressed the City Council to give a status report on the new Public Library the base bid will be for the shell of the building, and alternative bids will be taken for finish work of the project. Councilmember Quinn moved to pay bills as presented. Seconded by Councilmember Christenberry, motion passed unanimously by voice vote. 3419 11 October 2004 Councilmember Ford moved to address an item not on the printed agenda. Seconded by Councilmember Quinn, motion passed unanimously by voice vote. Councilmember Christenberry addressed the City Council to report on the Harbor Board concerns regarding Bob Pope's monthly lease payments for the Yardarms Restaurant and Marina. The restaurant and the marina were both damaged by Hurricane Ivan. Councilmember Christenberry moved to waive Mr. Pope's monthly lease payments for the restaurant and the marina until both are back in operation, at which time the monthly lease payments will resume. The waiving of these lease payments will be retroactive to September 16, 2004. Seconded by Councilmember Quinn, motion passed unanimously by voice vote.
