NOTICE AND CALL OF SPECIAL MEETING

Notice is hereby given of a special meeting of the City Council of the City
of Fairhope, Alabama, to be held at the Fairhope Municipal Complex on
Wednesday, 29 September 2004, at 10:00 a.m., for the purpose to authorize
premium pay to essential full-time hourly employees that worked during
Hurricane Ivan.
CONSENT TO HOLDING OF MEETING
The undersigned member of the City Council of the City of Fairhope,
Alabama, do hereby acknowledge service of the Notice and Call of Special
Meeting hereinabout set forth and do hereby consent to the holding of such
meeting as such time in such place for the purpose set forth therein.

The City Council, City of Fairhope, met in Special Session City Council
Meeting at 10:00 a.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Wednesday, 29 September 2004.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, and Cecil Christenberry; and City
Clerk/Treasurer Geniece W. Johnson. Councilmember Anders and City Attorney
Marion E. Wynne were absent
There being a quorum present, Mayor Kant called the meeting to order
Councilmember Ford introduced in writing, and moved for the adoption of the
following resolution, a resolution authorizing to pay all the full-time hourly city
employees for a full 8 hours base pay for Tuesday, September 14, 2004, Wednesday,
September 15, 2004, and Thursday, September 16, 2004. Mayor Kant is also authorized to
pay all full-time hourly essential city employees premium pay for Wednesday, September
15`h through Sunday, September 19 at mid -night (12:00 a.m.). Premium pay is equal to an
additional one and a half time on top of all hours worked at regular rate. All Premium pay
shall be paid out of the Rainy Day Fund. Seconded by Councilmember Christenberry,
motion passed unanimously.
RESOLUTION NO. 1060
WHEREAS, the State of Alabama was under imminent threat of a hurricane, namely
Hurricane Ivan, a Category 4 hurricane; and,
WHEREAS, many counties and individuals experienced damage to public and private
property; and,
WHEREAS, disruption of essential utility systems has caused extreme peril to the citizens in
the City of Fairhope and all over the State of Alabama; and
WHEREAS, increased danger to the health and safety of the citizens of the City of Fairhope
occurred as essential employees were unable to take part in Governor Bob Riley's mandatory
evacuation of all residents living South of Interstate 10.
WHEREAS, the essential employees were required to take shelter at the Fairhope Civic
Center in an effort to address any protective measures and to maintain public utility systems
and to restore all public utility systems immediately following the storm; and,

WHEREAS to determine pay for this pay period:
1. Added hours to any full-time employee who did not work their full shift on Tuesday,
Wednesday or Thursday, September 14 — 16, 2004, in order to allow employees to
secure their families, homes and personal property.
2. To determine who was "essential." First and foremost are the utility department
employees. Second are certain public works employees. Third, all employees who
worked on Thursday, September 16, 2004, such as emergency phone operators, meter
department, and those that worked with the Police and Fire Departments and those
that worked with the utility departments.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, that
Mayor Kant is hereby authorized to pay all the full-time hourly city employees for a full 8
hours base pay for Tuesday, September 14, 2004, Wednesday, September 15, 2004, and
Thursday, September 16, 2004. Mayor Kant is also authorized to pay all full-time hourly
essential city employees premium pay for Wednesday, September 151h through Sunday,
September 19 at mid -night (12:00 a.m.). Premium pay is equal to an additional one and a
half time on top of all hours worked at regular rate. All Premium pay shall be paid out of the
Rainy Day Fund.

There being no further business to come before the City Council the meeting
was duly adjourned at 10:09 a.m.
