HomeMy WebLinkAbout09-27-2004 Regular Meeting3399 STATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monda,, 27 September 2004. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the invocation. Councilmember Quinn moved to approve minutes of the 13 September 2004, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. Harriet Gutknecht, with the Historical Preservation Committee, gave a report on the seventh Historical Homes Tour. Artist, Elizabeth Carrigan and Eve Doherty presented Homes Tour sketches to all homeowner participants for the Historical Homes Tour for 2004. A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance No. 557. Councilmember Anders introduced in writing the proposed ordinance. The proposed ordinance would amend the PUD for Ellington Place the property of Gene Tillman by increasing lot size, move lots and configuration, and over all decreasing the number of lots. This property is located at the North side of Windmill Road just West of County Road 27, Fairhope, Alabama. (PUD adopted by Ordinance No. 1177, September 22, 2003) Mayor Kant called on Christopher Baker, Director of Planning and Building, to give an overview of this ordinance. The Planning Commission recommended approval of this ordinance. Mayor called the Public Hearing opened Bill Scott addressed the City Council expressing that he is very skeptical about the drainage. Seth Moore — representative of Gene Tillman addressed the City Council. Mr. Moore with Moore Engineering stated that a burm will not be installed, but a small swell will be installed to take the water to the south. 3400 Council Meeting 27 September 2004 Page —2- Councilmember Christenberry inquired that if Mr. Scott is right about the drainage and the engineers are wrong will the repercussion go to the engineers. Councilmember Gentle moved for immediate consideration. This motion died for a lack of a second. This proposed ordinance will layover until the next regular City Council meeting. A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance No. 557. Councilmember Christenberry introduced in writing a proposed ordinance. The proposed ordinance would amend Phase One only of the PUD for Huntington Subdivision, the property of the Street Family by changing the side setbacks on Lots 57 feet to Lots 60 feet wide to10-foot side and 6 foot on all other sides as indicated on the Site Plan. This property is located West of US Highway 98, North of Old Battles Road, Fairhope, Alabama. (PUD adopted by Ordinance No. 1171, June 9, 2003 — Subdivision once known as Oak Hill Subdivision). Mayor Kant called on Christopher Baker Director of Planning and Building to give an overview of this ordinance. The Planning Commission recommended approval of this ordinance. Mayor Kant called the Public Hearing opened Scott Hutchinson with HMR was present for any questions regarding this request. This proposed ordinance will layover until the next regular City Council meeting. Councilmember Anders introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing the Building Department to waive permit fees related to storm damage from Hurricane Ivan until November 1, 2004. This resolution does not waive the process of getting a permit. Seconded by Councilmember Gentle, motion passed unanimously. Mr. Baker stressed that the citizens make sure that all contractors have a valid business license to protect themselves. 3401 Council Meeting 27 September 2004 Page —3- RESOLUTION NO. 1058 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the Planning and Building Dept. is ordered to not charge for building permits related to storm damage from Hurricane Ivan. Furthermore, the Planning and Building Dept. is ordered to not charge for all electrical permits resulting from storm damage from Hurricane Ivan. This resolution is effective until 1 November 2004. After 1 November 2004 the Planning and Building Dept. is ordered to return to normal charges and fees for all activity whether or not associated with Hurricane Ivan. Adopted This 271h Day of September 2004. Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to execute an emergency contract with Pittman Tractor Company, Inc. to remove and dispose of debris from Hurricane Ivan — September 16, 2004. Seconded by Councilmember Quinn, motion passed unanimously. 3402 Council Meeting 27 September 2004 Page —4- RESOLUTION NO. 1059 WHEREAS, THIS CONTRACT, made and entered into this 171" day of September. 2004, by and between the City of Fairhope a Municipal Corporation of Baldwin County, Alabama (hereinafter called the City) and Pittman Tractor Co. (hereinafter called the Contractor). WITNESSETH NOW, THEREFORE, in consideration of the following mutual agreements and covenants, it is understood and agreed by and between the parties hereto as follows: WHEREAS, The Contractor is hereby granted and awarded a contract to remove and disposal of debris from Hurricane Ivan to include the following conditions: 1. Debris removal will be from right of way, City owned facilities, or other areas as determined by the City. 2. Contractor is to be responsible for their employee's workman's Compensation Insurance. 3. Contractor must provide a certificate of proof of insurance. 4. The City reserves to right to add additional contractors as deemed necessary. 5. Wayne Smith, Purchasing Agent 3405 Council Meeting 27 September 2004 Page —7- Councilmember Ford moved to accept the low bid of Terex Utilities South, Birmingham, Alabama for Freightliner Aerial Device (Bucket Truck) and Chassis — Hurricane Ivan — September 16, 2004, provided all specifications are met. Mrs. Johnson is authorized to secure financing for this new truck. This truck was going to be in this year's budget. Seconded by Councilmember Christenberry, motion passed unanimously. The Mayor and Council thanked all employees for all their hard work during Hurricane Ivan, September 16, 2004. All electric power was restored in four days. There being no further business to come before the City Council the meeting was duly adjourned at 6:20 p.m.
