The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 13 September 2004.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one
was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the
invocation. Councilmember Quinn moved to approve minutes of the 23 August 2004,
regular meeting. Seconded by Councilmember Gentle, motion passed unanimously.
Mr. Skip Jones, a board member of the Fairhope Center for the Writing Arts,
announced and presented the 2"d Annual Robert Bell Award. This award is an award
named after Fairhope resident and author Robert Bell. This award is given to some
one who, through his or her writing or support of the writing arts, has contributed to
the rich heritage of the writing tradition of Fairhope.
The Robert Bell award in the amount of $1,000.00 is funded by private contributions.
This year, recognition goes to an established writer who has contributed
immeasurably to the literary tradition of our bay area community. He is an
architectural historian; author and literary critic who is a tireless champion of both
local authors and under- appreciated international literary figures.
He is of an informative and delightfully readable historical resource and is in the
process of completing another. Through his weekly Book Page in the Mobile
Register, he entertained us, identified for us wonderful new books by local and
regional authors, and re -acquainted us with older literary gems that have renewed
relevance in today's world. This year's Robert Bell Award goes to Fairhope's John
Sledge.

Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Kant to execute Amendment
# 1 to the supplemental agreement to contract for professional services between Barge
Waggoner Sumner & Cannon, Inc. and the City of Fairhope for improvements to H.
L. "Sonny" Callahan Airport, by decreasing the contract amount by $14,384.50. The
medium intensity approach lighting system (MALS) is being removed from the
design. Seconded by Councilmember Ford, motion passed unanimously.
RESOLUTION NO. 1054
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that Mayor Timothy M. Kant is hereby authorized to execute amendment # 1 to the
supplemental agreement to contract for professional services between Barge
Waggoner Sumner & Cannon, Inc. and the City of Fairhope for improvements to H.
L. "Sonny" Callahan Airport, by decreasing the contract amount by $14,384.50. The
medium intensity approach lighting system (MALS) is being removed from the
design. This part of the design will be funded by the Facilities and Equipment (F and
E) division and installed by FAA personnel. (Resolution No. 1048, August 9, 2004)

Councilmember Gentle introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Timothy M. Kant to execute
the Funding Agreement for the Fiscal Year 2004-Federal And State Grant for Airport
Improvement Project (AIP) 3-01-0029-006-2004 H. L. "Sonny" Callahan Airport.
Seconded by Councilmember Quinn, motion passed unanimously.

RESOLUTION NO. 1055
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that Mayor Timothy M. Kant is hereby authorized to execute the Funding Agreement
for the Fiscal Year 2004-Federal And State Grant for Airport Improvement Project
(AIP) 3-01-0029-006-2004 H. L. "Sonny" Callahan Airport.
This Airport Improvement Funding Agreement shall be to provide funding assistance
for a project to further develop the H. L. "Sonny" Callahan Airport as authorized by
Section 23-1-360, Code of Alabama 1975. The Airport shall be the recipient of funds
from this Agreement for an airport improvement project as more particularly
described in the Airport's funds application dated August 10, 2004 and included as
part of this Agreement as Attachment 1. The total amount of funds from the state for
FAA Project 3-01-0029-006-2004 is $105,126.00.
Adopted This 13h Day of September 2004.
Councilmember Gentle introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Kant to amend the Working
Budget FY 2003-2004, as recommended by staff. Seconded by Councilmember Ford,
motion passed unanimously.
RESOLUTION NO. 1056
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
BALDWIN COUNTY, ALABAMA that Mayor Timothy M. Kant is hereby
authorized to amend the Working Budget FY 2003-2004, as recommended by staff.

Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing and directing Mayor Kant to take
the necessary steps to transfer the Nut Processing Plant Property from the three
utilities of the City of Fairhope to the General Fund in the financial and property
records of the City. Seconded by Councilmember Christenberry, motion passed
unanimously.
RESOLUTION NO. 1057
WHEREAS, pursuant to Resolution No. 565-97, dated May 29, 1997, the City of Fairhope ("the City")
purchased the Nut Processing Plant Property located at 415 Fairhope Avenue and the Single -Family
Residence located at 9 North School; the instrument conveying the said property is recorded in Book
762, page 1925-27, in the Office of the Judge of Probate of Baldwin County;
WHEREAS, the said property was purchased with a portion of the proceeds derived from the sale of
the City's Utilities Revenue Warrants, Series 1997;
WHEREAS, the tract composed of the two parcels contains approximately 120,336 feet (or 2.76 acres)
and was originally purchased with the expectation that it would be used by the City's Utilities
Department;
WHEREAS, said property contained a warehouse storage facility (84,720 square feet) and a single-
family resident — stucco house (1,024 square feet);
WHEREAS, currently the single-family residence -- stucco house is being leased by the City to the
Fairhope Center of the Writing Arts Inc. Board pursuant to Resolution No. 786-01, dated August 27,
2001; and
WHEREAS, the Council hereby finds, determines and declares that the full undeveloped portion of the
said tract is not, nor is it expected to be at any time in the future, needed in connection with the
efficient operation of the City's Utilities Department and that the said property not deemed an integral
part, in any respect, of the City's Utilities Systems; that said property (which shall be designated
appropriately by the City's Engineering Department) shall be transferred to the City's General Fund to
be used as the location of the City's new public library.
BE IT RESOLVED, therefore, that the Mayor and City Clerk are hereby authorized and directed to
take such steps as are necessary to effect the transfer of the said property, as set forth above, and to
reflect such transfer in the financial and property records of the City.

Councilmember Gentle so moved to approve the charge -off of 2000-2001 un-
collectible utility accounts. These accounts total $87,892.52. Seconded by
Councilmember Anders, motion passed unanimously.
Councilmember Gentle moved to authorize Mayor Kant to write a letter of
agreement and fulfill the following mitigation request of the Alabama Historical
Commission for the New Public Library.
1. Install an exhibit in the library and provide an explanation of the
importance of the facility to Fairhope in terms of jobs and industrial
development. This exhibit may include other conjectural history from
Fairhope at the time and information on the family who operated the nut
processing facility and their importance to Fairhope. The Alabama
Historical Commission will have an opportunity to comment on the plans
for the exhibit prior to execution.
2. The City will paint the exterior of the Wolff Cottage. We will provide
color suggestions, but the final color should be a local decision.
3. The City will provide positive slope away from the building to provide
good drainage, as needed.
4. The City will review and replace, as needed, the flashing on the parapet
and make proper connections between roof, flashing, and any counter
flashing needed.
The City will repair the stucco, as needed, as part of the exterior
renovation
6. The City will put the utilities underground.
Councilmember Quinn seconded the motion to authorize Mayor Kant to write a letter
of agreement and fulfill the mitigation request of the Alabama Historical Commission
for the New Public Library. The motion passed unanimously.
City Council reviewed an application for a Restaurant Liquor License by John
Lapeyrouse, dba Julwins Restaurant (Lapeyrouse Hospitality, Inc.), located at 411
Fairhope, Alabama. Councilmember Quinn moved to approve the issuance of the
license. Seconded by Councilmember Gentle, motion passed unanimously.
City Council reviewed an application for a Restaurant Liquor License by
Lynnora L. Ash, dba The Sunflower Cafe, located at 320 Eastern Shore Shopping
Center, Fairhope, Alabama. Seconded by Councilmember Quinn, motion passed
unanimously.

City Council reviewed an application for a Special Retail License by William
Boyd Little, dba Oak Hollow Farm Inc., located at 14210 Greeno Road, Fairhope,
Alabama. Councilmember Ford moved to approve the issuance of the license.
Seconded by Councilmember Quinn, motion passed unanimously.
City Council reviewed an application for Beer/Wine On/Off Premises by
Randolph K. Williams, dba Red or White Wine (Second Half Company Inc.), located
at 323-A De la mare Avenue, Fairhope, Alabama. Councilmember Quinn moved to
approve the issuance of the license. Seconded by Councilmember Anders, motion
passed unanimously.
Councilmember Anders moved to grant the request of Eastern Shore
Democrats, requesting permission to hold an event in Fairhope's park next to
Julwin's Restaurant on Saturday, September 25, 2004, from 9:00 a.m. to 4:00 p.m.
The purpose of this event is to encourage participation in the Presidential Election on
November 2°a. Seconded by Councilmember Quinn, motion passed unanimously.
Councilmember Quinn moved to grant Change Order Request # 3 by Robert
J. Baggett for the Renovations to the Ultraviolet (UV) System at the Fairhope Water
Reclamation Facility, decreasing the contract by $5,762.75. Seconded by
Councilmember Gentle, motion passed unanimously.
Joe Birindelli, Chairman for Citizens for Local Troop Support, addressed the
City Council requesting that the City sponsor a Veterans' Day Parade in Fairhope this
year. The recommended date is Saturday, November 13, 2004 at 2:00 p.m. This
patriotic event will honor all veterans of all wars. Councilmember Ford moved to
sponsor the Veterans' Day Parade. Seconded by Councilmember Gentle, motion
passed unanimously. This waives all fees associated with Ordinance No. 1220 the
Sidewalk and/or Street Usage Ordinance.

Councilmember Anders moved to accept the low bid of Hughes Electrical
Supply, Pensacola, Florida for all the primary and secondary wire and conductor
except for the Primary 4/OAWG 15V Underground Cable which is awarded to the
low bid of Utility Power, Inc, Fairhope, Alabama, provided all specifications are met.
Seconded by Councilmember Ford, motion passed unanimously.

Councilmember Christenberry moved to accept the low bid of Mathes of

Police Chief Christopher Browning gave a report on Hurricane Ivan. This is
currently a Category 4 hurricane, but is expected to be a category 3 once it hits land.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:14 p.m.
