The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, July 12, 2004.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one
was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Farther Gordon Milsted with St. Lawrence
Catholic Church, gave the invocation. Councilmember Gentle moved to approve
minutes of the 28 June 2004, regular meeting. Seconded by Councilmember Ford,
motion passed unanimously.
Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Geniece W. Johnson, City
Clerk/Treasurer, to perform all the duties otherwise required to be performed by the
Mayor per Code of Alabama 1975, with respect to the Municipal Election and Run-
off if necessary. Seconded by Councilmember Ford, motion passed unanimously.
RESOLUTION NO. 1042
WHEREAS, a General Municipal Election will be held in the City of Fairhope on 241h of August, 2004, and if
necessary a Run-off Election will be held in the City of Fairhope on 14`h September 2004; and,
WHEREAS, the Mayor of the City of Fairhope is a candidate in said election and is thereby disqualified to
perform certain duties per Code of Alabama, 1975.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, that Geniece W. Johnson, City Clerk/Treasurer, is hereby appointed to perform all the duties
otherwise required to be performed by the Mayor per Code of Alabama, 1975 with respect to the Municipal
Election to be held in the City of Fairhope on 24 August 2004 and any Run-off Election ordered held with respect
thereto.

Councilmember Quinn so moved to grant Change Order Request # 1 to
Ammons & Blackmon Construction, Inc, for the Water System Booster Pump
Station, by decreasing the contract by $2,694.00. Seconded by Councilmember
Anders, motion passed unanimously.

are met. Seconded by Councilmember Ford, motion passed unanimously.

The City will keep the Electronics, Mixer, and Trailer, which are all parts of the present boring rig, which will keep the
cost considerably lower. Because of parts not being interchangeable, only one vendor could supply the boring unit.
Therefore, it is recommended to accept the bid of Vermeer Sales, Pensacola, FL. Specifications have been met.

Councilmember Ford so moved to accept the low bid of Vermeer Sales,
Pensacola, Florida, for Directional Boring Machine, provided all specifications have
been met. The machine will be paid for by the three utilities, and Geniece W.
Johnson, City Clerk/Treasurer, is authorized to seek the best financing for the City.
Seconded by Councilmember Anders, motion passed unanimously.

The 1165th Military Police Company based at Fort Riel Armory in Fairhope is
coming home from Iraq. Homecoming plans are being made by the City of Fairhope,
the Citizens for Local Troop Support, and the reserve companies' family support
group. They will arrive in Fairhope from Fort Benning on Saturday, July 17. Their
arrival time depends on when the troops leave Fort Benning, Georgia but they are
expected between 10:30 a.m. and noon.
Councilmember Quinn moved to pay bills as presented. Seconded by
Councilmember Gentle, motion passed unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:14 a.m.
