COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 28 June 2004.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one
was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Geniece W. Johnson, City Clerk/Treasurer,
gave the invocation. Councilmember Quinn so moved to approve minutes of the 14
June 2004, regular meeting. Seconded by Councilmember Gentle, the motion passed
by the following votes: AYE -Gentle, Ford, Quinn, Kant, and Christenberry. NAY -
None. ABSTAIN -Anders
Councilmember Ford moved for final adoption of Ordinance No. 1220, an
ordinance establishing policies and procedures for sidewalk and/or street usage.
Seconded by Councilmember Anders. Councilmember Quinn requested that this
ordinance be amended to authorize Mayor Kant, at his discretion, to waive fees for
educational events and events that promote downtown Fairhope. Councilmember
Ford amended his motion to make these amendments. Seconded by Councilmember
Anders. Ordinance No. 1220 passed by the following votes: AYE -Gentle, Ford,
Quinn, Kant, Anders, and Christenberry. NAY -none.
Councilmember Ford moved for final adoption of Ordinance No. 1221, an
ordinance establishing policies and procedures for park usage. Seconded by
Councilmember Gentle. Councilmember Quinn was concerned that this ordinance
would place too much restriction on the citizens of Fairhope. Ordinance No. 1221
passed by the following votes: AYE -Gentle, Ford, Kant, Anders, and Christenberry.
NAY -none. ABSTAIN -Quinn.
Councilmember Anders introduced in writing Ordinance No. 1222, an
ordinance amending Ordinance No. 1176 Lodging Tax Ordinance. This ordinance
does not allow for retroactive discounts. In order to take immediate action
Councilmember Anders moved for immediate consideration. Seconded by
Councilmember Ford, motion for immediate consideration passed unanimously by the
following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -
none. Councilmember Gentle then moved for final adoption of Ordinance No. 1222.
Seconded by Councilmember Quinn, motion for final adoption passed unanimously
by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry.
NAY -none.

Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution authorizing Historic Fagade Preservation Grants. The first
grant will go to the Writer's Cottage of the Fairhope Center of the Writing Arts in the
amount of $2,500.00. (City owned buildings only). Seconded by Councilmember
Quinn. Councilmember Gentle requested amending the motion to clearly show what
preservation means according to the State of Alabama. Councilmember Anders
amended her motion according to Councilmember Gentle's request. Seconded by
Councilmember Quinn, motion passed unanimously.
RESOLUTION NO. 1041
WHEREAS, the purposes of the Fairhope Historic Preservation Committee include to increase awareness
of the valuable resources we have in our historic buildings and to encourage preservation of our historic
building; and,
WHEREAS, the Fairhope Historic Preservation Committee has obtained money from its annual Historic
Homes Tours; and,
WHEREAS, several historic buildings are owned by the City of Fairhope, it is hereby,
RESOLVED, that the Fairhope Historic Preservation committee shall grant some of its funds to
contribute to the preservation of the historic facades of city -owned buildings; and be it
FURTHER RESOLVED, that officials or other responsible persons may request such a grant of the
Fairhope Preservation Committee; and be it
FURTHER RESOLVED, that the Fairhope Historic Preservation Committee shall reasonable determine
that any project to be supported will include plans to directly restore or maintain the historic or
contributing designation of a city -owned building, and the Fairhope Historic Preservation Committee
shall determine the amount of any grant; and be it
FURTHER RESOLVED, that any grant will be within the amount of funds obtained by the Fairhope
Preservation Committee and held by the City; and be it
FURTHER RESOLVED, the City Council shall have final approval of such grant made by the Fairhope
Historic Preservation Committee; and be it
FURTHER RESOLVED, that the first such grant be given in the amount of $2,500.00 to the Writer's
Cottage of the Fairhope Center for the Writing Arts.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALBAMA that the
Fairhope Historic Preservation Committee shall grant funds to contribute to the preservation of the
historic facades of city -owned buildings and that the first such grant be given to the Writer's Cottage of
the Fairhope Center for the Writing Arts in the amount of $2,500.00.

City Council reviewed an application for a Restaurant Liquor License by
Steven D. Anderson, dba Fly Creek Restaurant, located at 831 North Section Street,
Fairhope. Councilmember Gentle moved to approve the issuance of the license.
Seconded by Councilmember Anders, motion passed unanimously.

Excavating, Daphne, Alabama, for NRCS Bids — Isidore (Tropical Storm 2002),
provided all specifications are met. Seconded by Councilmember Anders, motion
passed unanimously. The City will do the work at Echo Lane & Southern Run.

There being no further business to come before the City Council the meeting
was duly adjourned at 5:56 p.m.
