The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 14 June 2004.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, and Cecil Christenberry; City Attorney Marion
E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. Councilmember Anders
was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the
invocation. Councilmember Christenberry moved to approve minutes of the 27 May
2004, regular meeting. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Quinn introduced in writing a proposed ordinance to establish
Policy and Procedure for Sidewalk and/or Street Usage. This proposed ordinance
will layover for final adoption at the next regular City Council meeting

adoption at the next regular City Council meeting
Councilmember Ford stated that the striping on Section Street should stay as
is. He is against the diagonal parking from Pine Street to Equality Street on the West
side of Section Street. Councilmember Ford further stated that speeding is a factor on
Section Street, but why take something that is already dangerous and make it doubly
dangerous. Councilmember Ford would rather look into using Bancroft Street for
diagonal parking, and add more lighting to Bancroft Street.
Councilmember Gentle stated that he was concerned with speeding on Section Street.
He further stated that we are going to have to stop traffic at Oak Street.
Pat McDonald, one of the owners in this area addressed the City Council. Mr.
McDonald is very much in favor of diagonal parking. The diagonal parking would
create an additional 17 or 18 parking spaces and this design will also slow traffic
entering the city on Section Street per Christopher Baker, Planning and Building
Director.

Councilmember Gentle introduced in writing, and moved to leave the design that we
have started out with (Diagonal Parking from Pine Street to Equality Street on the
West side only. The East will be as is), immediately install a 4-way stop with
flashing light at Oak Street and Section Street until the next administration can afford
a traffic light. Seconded by Councilmember Quinn, motion passed by the following
votes: AYE -Gentle, Quinn, Kant, and Christenberry. NAY -Ford
REESOLUTION NO. 1039
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that the striping for North Section Street shall be as originally designed, to have
diagonal Parking from Pine Street to Equality Street on the West side only. The East
will be as is. Immediately a 4-way stop shall be installed with flashing light at Oak
Street and Section Street until the next administration can afford a traffic light.

Councilmember Quinn introduced in writing, and moved for the adoption of
the following resolution authorizing Mayor Kant to close all City Offices on July 5ch
for observance of the 41h of July. Seconded by Councilmember Ford, motion passed
unanimously.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
that Mayor Kant is hereby authorized to close all City Offices on July 51h for
observance of the 41h of July.

Site Plan Review — Spencer Johnson — Christopher Baker, Director of Planning and
Building, addressed the City Council and made the following report on Spencer
Johnson's request for an addition on the New Church Mouse Building, generally
located West of Church Street just before Fairhope Avenue.
Mr. Spencer Johnson recently purchased the building at 14 South Church Street. This
building has been several restaurants. It is zoned B2 and is located in the Central
Business District and in the Fire District.
The issues associated with this case are as follows:
Addition: Mr. Johnson has removed the existing dining room and courtyard. He will be extending the
first floor of the building to the street.
Impervious Coverage: Essentially the whole site will be impervious. Stormwater will be taken to
Church Street.
Building Height: The project architect has been advised of the building height. The plans submitted
meet this requirement.
All other requirement have been met or agreed to.
The Planning Commission unanimously approved the request.
Staff Recommendation — To approve as requested.
Councilmember Quinn moved to approve Spenser Johnson's Site Plan Review as
requested. Seconded by Councilmember Gentle, motion passed unanimously.
City Attorney Marion E. Wynne left the dais 5:55 p.m.
A public hearing was held as advertised on the request of a Package Store
License by Brad Wintzell, dba Autry Greer and Sons, Inc dba Tiger Liquors, located
at 75 Section Street, Fairhope, Alabama. There was police approval of the applicant.
Councilmember Gentle moved to approve the issuance of the license. Seconded by
Councilmember Christenberry, motion passed unanimously
City Attorney Marion E. Wynne returned to the dais 5:56 p.m.
City Council reviewed an application for a Restaurant Liquor License by,
Lanny West dba French Quarter Blues Caf6, Inc., located at 42 1/2 South Section
Street, # 1, Fairhope, Alabama. Councilmember Ford moved to approve the issuance
of the license. Seconded by Councilmember Gentle, motion passed unanimously.

Councilmember Gentle so moved to grant Change Order # 2 for Esfeller
Construction Company, Inc. for the grading and drainage for Runway relocation base
and pave new runway, by increasing the contract by $2,180.00. Seconded by
Councilmember Quinn, motion passed unanimously.
Councilmember Gentle moved to grant Change Order # 1 for Ammons &
Blackmon Construction for the North Section Street Sidewalk Improvements, by
increasing the contract by $6,301.15. Seconded by Councilmember Christenberry,
motion passed unanimously.
Verla Peace addressed the City Council requesting permission to advertise
local businesses by pulling a wagon holding a miniature horse, and offering miniature
horse carriage rides to children along the beach and public park areas in Fairhope.
Councilmember Ford stated that we may have problems allowing franchises in the
park lands. Police Chief Christopher Browning stated that as for the carriage rides on
public streets, Ms. Peace would have to comply with state laws pertaining to slow
moving vehicles by using reflective devices, and required lighting equipment and
illuminating devices for vehicles. Councilmember Christenberry moved to grant Ms.
Peace permission to advertise local businesses by pulling a wagon holding a
miniature horse in the downtown area on a trail basis for 30 days. Permission for
using the park areas was not granted. If there are no problems with the downtown
request then Ms. Peach may continue. Seconded by Councilmember Quinn, motion
passed unanimously.
R. C. (Buddy) Odom addressed the City Council requesting permission to
designate Cottage Drive to be one-way North to vehicle traffic. Mr. Odom stated that
numerous problems have taken place on Cottage Drive from loud music to drug busts.
The Chief of Police Christopher Browning stated that the residents of Cottage Drive
do have problems. However, by turning Cottage Drive into a one-way will stop
traffic from Spring Run Apartment and Autumn Trailer Park from using Cottage
Drive as a through street. The U. S. Mail deliver will use private allies in back of the
homes on Cottage Drive to aid with delivering mail. Councilmember Christenberry
moved to grant the request to see if this will help, if not do something else. Seconded
by Councilmember Gentle, motion passed unanimously.
Barry Little with Gulf Coast Storytelling addressed the City Council
requesting permission to use the South Beach area at the City Pier to erect a large tent
with seating for 300 people to hold a storytelling festival on September 24tn — 25tn,
2004 from 9:00 a.m. to 9:30 p.m. each day. Councilmember Gentle moved to grant
the request and to work with Sherry Sullivan due to a wedding that is scheduled to
take place at the fountain on Saturday, September 25, 2004 at approximately 2:00 pm.
Seconded by Councilmember Christenberry, motion passed unanimously.

Tracy Wilhelm addressed the City Council requesting permission to block off
a section of George Street between Nichols Avenue and White Street to hold a
neighborhood party on June 19, 2004, from 6:00 — 9:00 p.m. Councilmember
Christenberry moved to grant the request and to work with the Police Department.
Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Christenberry moved to address an item by the Mayor not on
the printed agenda. Seconded by Councilmember Gentle, motion passed
unanimously.
Mayor Kant requested authorization to hire an engineer to see what must be done to
fix the drainage problem at Spring Lake. Councilmember Gentle moved to grant
Mayor Kant authorization. Seconded by Councilmember Ford, motion passed
unanimously.

Councilmember Gentle moved to accept the low bid of Hosea O. Weaver of
Mobile, Alabama, for resurfacing Section Street from Magnolia Avenue to Bayou
Street from Section Street to Bancroft Street, provided all specifications are met.
Seconded by Councilmember Quinn. Mayor Kant stated that this project will be
funded by using the remaining balance of GOW 2002 funds for street resurfacing, and
the balance will come from Capital Improvement Fund. Councilmember Gentle
amended his motion to include how this project will be funded. Seconded by
Councilmember Quinn, motion passed unanimously.
Councilmember Ford moved to pay bills as presented. Seconded by Councilmember
Christenberry, motion passed unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:50 p.m.
