COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 22, March 2004.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Pauline Anders, and Cecil Christenberry; City Attorney Marion E.
Wynne, and City Clerk/Treasurer Geniece W. Johnson. Councilmember Debbie W.
Quinn was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the
invocation. Councilmember Anders moved to approve minutes of the 11 March
2004, regular meeting. Seconded by Councilmember Ford, motion passed
unanimously.
Mayor Kant presented a Proclamation to members of the Library Board,
proclaiming April 18-24, 2004 as National Library Week.
City Attorney Marion E. Wynne recommended 1-year probation for the
business license revocation of Derek Williams Homebuilders. Mr. Wynne stated that
a written document shall be written and signed stating the terms of his probation, and
Mr. Williams may continue working. Councilmember Anders moved to grant the
City Attorney's recommendations. Seconded by Councilmember Ford, motion
passed unanimously.
Councilmember Gentle moved for final adoption of Ordinance No. 1200,
amending Ordinance No. 1114, Sewer Maintenance Section for connecting to the
sewer main, and request that the qualified installers provide a blanket bond to the City
of Fairhope. Seconded by Councilmember Ford, Ordinance No.1200 passed by the
following votes: AYE -Gentle, Ford, Kant, Anders, and Christenberry. NAY -None.
Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution, a resolution authorizing Mayor Kant to execute a
Contractual Agreement between the City of Fairhope and The Lighthouse, Baldwin
County Family Violence Project, to support the Lighthouse domestic violence
program and sexual assault program — $3,500.00. Seconded by Councilmember
Gentle, motion passed unanimously. Mayor Kant assigned Police Chief Chris
Browning, James Gillespie, and himself to look at adding monies to the court cost to
aid the Lighthouse of Baldwin County Projects.

RESOLUTION NO. 1016-04
WHEREAS, The Lighthouse, Baldwin County Family Violence Project, is funded in part by the Law
Enforcement/Traffic Safety Division of the Alabama Department of Economic and Community Affairs. The
program currently has a full time Sexual Assault Counselor and a full time Sexual Assault Specialist and serves
Baldwin.
WHEREAS, The Sexual Assault Counselor works directly with adult victims of rape and sexual assault and their
families/significant other providing assessment and counseling services.
WHEREAS, The Sexual Assault Specialist is responsible for recruiting, training, and coordinating volunteer
advocates to respond to adult victims of rape and sexual assault in the crisis situation as requested by law
enforcement or hospital emergency room staff. The Sexual Assault Specialist will also be involved in developing
and implementing rape prevention programs throughout the county.
WHEREAS, there are several other services provided by this program for sexually assaulted victims.
WHEREAS, the Lighthouse provides a Domestic Violence Program were the following services are provided:
• Twenty-four hour Crisis Line
• Safe, Confidential shelter
• Individual Crisis Counseling
• Support Groups
• Direct services provided to children while in the shelter
• Court advocacy and accompaniment
• Training on issues relating to domestic violence
• Speakers Bureau
• Elementary School Programs
• Dating Violence Date Rape Program
While the Lighthouse is excited to be in the position to offer these needed services for the residents of Baldwin
County, the Lighthouse needs the support to continue to provide these and other services.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA,
that Mayor Timothy M. Kant is hereby authorized to execute a Contractual Agreement between the City of
Fairhope and The Lighthouse, Baldwin County Family Violence Project, to support the Lighthouse domestic
violence program and sexual assault program, in the amount of $3,500.00.

Councilmember Ford introduced in writing and moved for the adoption of the
following resolution, a resolution authorizing Mayor Kant to execute a Lease
Agreement between the City of Fairhope and University of South Alabama, to lease
the existing Fairhope Public Library, located at 161 North Section Street for fifteen
years. Seconded by Councilmember Gentle, motion passed unanimously.
RESOLUTION NO. 1017-04
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorizing Mayor
Kant to execute a Lease Agreement between the City of Fairhope and University of
South Alabama, to lease the existing Fairhope Public Library, located at 161 North
Section Street for fifteen years.

A public hearing was held as advertised on the request of a Lounge Liquor
License by Harold Bracy, dba American Legion Post 335, located at 18887 South
Section Street, Fairhope, Alabama. There was police approval of the applicant.
Councilmember Anders moved to approve the issuance of the license. Seconded by
Councilmember Christenberry, motion passed unanimously.
Councilmember Gentle moved to grant Change Order # 1 for Ammons and
Blackmon Construction, Inc., for Water System Booster Pump Station, decreasing the
contract by $2,694.00. Seconded by Councilmember Anders, motion passed
unanimously.
Councilmember Christenberry moved to grant Change Order # 1 for Robert J.
Baggett, Inc., for the renovations to the Ultraviolet (UV) System, to extend the term
of this contract from 210 days to 231 days. Seconded by Councilmember Gentle,
motion passed unanimously.

Councilmember Anders moved to authorize the sale of Surplus Property.
Seconded by Councilmember Gentle, motion passed unanimously.
Mayor Kant assigned Police Chief Chris Browning and Public Works Director
Jennifer Fidler to look into the request by Verla Peace and report back to the City
Council. Ms. Peace is requesting permission to advertise local businesses by pulling
a wagon holding a miniature horse, and offering miniature horse carriage rides to
children along the beach and public park areas in Fairhope. Ms. Peace was not
present.
Councilmember Ford moved to grant the request of the Young Patrons of the
Fairhope Public Library, requesting permission to use the parking lot of the Library
and Civic Center for Library Fun Day on Saturday, April 24, from 9:00 a.m. until
12:00 p.m. This event must be coordinated with the Police Chief. Seconded by
Councilmember Gentle, motion passed unanimously.

It is recommended to accept the low bid of IED INC., Foley, AL with all specifications

Councilmember Anders moved to accept the low bid of IED, Inc., Foley,
Alabama for the removal of the steel building located at Fairhope Avenue and
Bancroft Street. This project must be complete by June 1, 2004. Seconded by
Councilmember Gentle, motion passed unanimously. Mayor Kant stated that this bid
does not include the removal of the concrete slab and two building located at the front
of the property.
Councilmember Gentle moved to address an item not on the printed agenda.
Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Anders introduced in writing and so moved for the adoption
of the following resolution, a resolution accepting the streets and utilities, and public
right-of-ways within Idlewild Phase 7B for maintenance. Seconded by
Councilmember Ford, motion passed unanimously.

RESOLUTION NO. 1018-04
WHEREAS, the Owners of Idlewild Phase 7B desire to have all public streets and public rights -of -
way dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama on
Slide S-2149A, and all Fairhope public utilities located in public rights -of -ways accepted for
maintenance by the City of Fairhope, Alabama, and;
WHEREAS, the City of Fairhope, Alabama has received notice from the engineers of the project that
the design and capacity of the public improvements have been designed in conformance with City
requirements as indicated on the recorded plat, and;
WHEREAS, the General Superintendent has indicated that the improvements meet City requirements,
and;
WHEREAS, the City of Fairhope, Alabama is not and in no manner will be responsible for the
maintenance of common areas in the subdivision as indicated on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama has received from the owners of Idlewild Phase 7B a
maintenance bond for the public improvements constructed for a period of 2 years from the date of
the approval of this Resolution, and;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA that the public improvements indicated herein for Idlewild Phase 7B are
hereby accepted for public maintenance subject to the bond posted.
