HomeMy WebLinkAbout11-10-2003 Regular MeetingSTATE OF ALABAMA )( 3223 COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on 10 November 2003. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk/Treasurer Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Deacon George Yeend with St Lawrence Catholic Church, gave the invocation. Councilmember Gentle moved to approve minutes of the 27 October 2003, regular meeting. Seconded by Councilmember Ford, motion passed unanimously. Recent additions of four specimens give the city a total of 13 State Champions. 10 November 2003 3224 A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance No. 557. Councilmember Anders introduced in writing Ordinance No. 1191. The Planning & Zoning Commission recommended approval of this ordinance. No one present was opposed to the amendment, an ordinance to re- zone the property of Klumpp Family Limited Partnership and Fairhope Single Tax Corporation from R-6 Mobile Home Park District to R-2 Medium Density Single - Family Residential District 4 concurrent with annexation in the City of Fairhope. The property is located West of Blueberry Lane on Gayfer Avenue Ext., Fairhope, Alabama. In order to take immediate action Councilmember Anders moved for immediate consideration. Seconded by Councilmember Gentle, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Christenberry, and Anders. NAY -none. Councilmember Gentle moved for final adoption of Ordinance No. 1191. Seconded by Councilmember Quinn, motion for final adoption passed unanimously by the following votes: AYE - Gentle, Ford, Quinn, Kant, Christenberry, and Anders. NAY -none. Councilmember Ford introduced in writing Ordinance No. 1192, an ordinance establishing Minimum Standards for fixed base operations at H. L. " Sonny" Callahan Airport. In order to take immediate action Councilmember Ford moved for immediate consideration. Seconded by Councilmember Gentle, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle then moved for final adoption of Ordinance No. 1192. Seconded by Councilmember Ford, motion for final adoption passed unanimously by the following vote: AYE - Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Ford introduced in writing Ordinance No. 1193, an ordinance repealing the current Tree Ordinance No. 1037 and Ordinance No. 1140. In order to take immediate action Councilmember Gentle moved for immediate consideration. Seconded by Councilmember Christenberry, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Quinn so moved for final adoption of Ordinance No. 1193. Seconded by Councilmember Anders, motion for final adoption passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. Seconded by Councilmember Anders, motion passed unanimously. Seconded by Councilmember Gentle, motion passed unanimously. RESOLUTION NO.998-03 WHEREAS, a contract shall be executed between the City of Fairhope and the Eastern Shore Art Center for contract funding for the Arts Bridging Creativity (ABC) program in the amount of $5,000.00; and, WHEREAS, this program has expanded from the Fairhope K-1 Center to the Fairhope Elementary, Intermediate, and Middle School, and due to the demand for this program, additional funding is necessary; and, WHEREAS, the term of said contract shall be for one year, beginning 1 October 2003 and ending 30 September 2004, but the contract shall be cancelled at any time upon notice; and, WHEREAS, payment shall be made quarterly in the amount of $416.76 from the three Utility Funds of the City of Fairhope. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to sign a contract between the City of Fairhope and the Eastern Shore Art Center for funds to supplement the coordinator's salary and program expenses associated with the Arts Bridging Creativity Program. ADOPTED this 10`' day of November , 2003. 10 November 2003 3227 Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to execute an agreement between the City of Fairhope and Live Eye Net, Inc., to remove one fixed web camera, to install one zoom web camera for Live Eye, and to install one zoom web camera for the Police Department, at no cost to the city, and replacing the current contract that we have with Softec Computers Inc., Foley, Alabama. Seconded by Councilmember Gentle, motion passed unanimously. RESOLUTION NO. 999-03 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT Mayor Timothy M. Kant, is hereby authorized to execute a contract between the City of Fairhope and Live Eye Net, Inc., to remove one fixed web camera, to install one zoom web camera for Live Eye, and to install one zoom web camera for the Police Department, at no cost to the city, and replacing the current contract with Softec Computers Inc., Foley, Alabama. Siren Sensor, and Radio Receiver for transmitters by increasing the contract by $675.00 at the H.L. "Sonny" Callahan Airport. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Quinn so moved to update the Volunteer Fire Department roster by adding: Mark Kellerman, Jamie Peterson, Frank Nespor, and Jimmy Cantrel, and by deleting Scott Claycomb. The City of Fairhope will go by the set time of stopping all sells at 2:00 a.m. on Sunday morning and resume sells at 12:00 p.m. on Sunday. Mayor Congratulated the Fairhope Volley Ball Girl's Team. They are third in the State, and the Fairhope Football team was also congratulated that will play their second round in the playoffs on Friday, November 14.
