Home My WebLink About08-25-2003 Regular MeetingSTATE OF ALABAMA X 3167 COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 25 August 2003. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; and City Clerk Geniece W. Johnson. City Attorney Marion E. Wynne was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Rev. Bruce O'Neil, Pastor of Eastern Shore Presbyterian Church, gave the invocation. Councilmember Anders moved to approve minutes of the 11 August 2003, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Gentle introduced in writing Ordinance No. 1175, an Ordinance increasing the Cigarette Tax. In order to take immediate action, Councilmember Anders moved for immediate consideration. Seconded by Councilmember Gentle, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle then moved for final adoption of Ordinance No. 1175. Seconded by Councilmember Christenberry, motion for final adoption passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders and Christenberry. NAY -none. Councilmember Anders introduced in writing a Lodging Tax ordinance. Bill Jones, owner of two Bed and Breakfasts, addressed the City Council inquiring the following questions: • How will the City identify those businesses that will pay a lodging tax? • How will the City enforce the lodging tax? • Will the City go to the State? • How will the City figure those that do not pay? • How much will it cost the City to collect this tax, if collected fairly? • How will the City address Condos, downtown short rentals that do not have this type of business license? Mr. Jones stated that he would like to see a quarterly report showing how this tax would promote tourism. Councilmember Christenberry and Mayor Kant explained that the Lodging Tax monies will not be earmarked, and that this money will go into the General Fund. 25 August 2003 3168 Councilmember Ford introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to execute an agreement between the City of Fairhope and U. S. Department of Agriculture NRCS for the Emergency watershed protection program. (Event — Washout on North Section Street due to July 2003 Rainstorms). Seconded by Councilmember Anders, motion passed unanimously. RESOLUTION NO. 981-03 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA that Mayor Kant is hereby authorized to extend the agreement between the City of Fairhope and the United States Department of Agriculture Natural Resources Conservation Service for an Emergency Watershed protection program. Johnson, C' er reasurer City Council reviewed an application for a Beer/Wine Off -Premises License by Sherree M. Brush, dba Jerry' Country Store, located at 17236 Greeno Road, Fairhope, Alabama. Councilmember Christenberry moved to approve the issuance of the license. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Gentle moved to grant Change Order Request # 1 — Kahlbau Construction for the emergency repairs to the Box Culvert on North Section Street at Bayou Street by increasing the contract by $12,298.03. Seconded by Councilmember Christenberry, motion passed unanimously. One appointment to Planning and Zoning Commission. Councilmember Quinn moved to re -appoint Dick Charles for a 6-year term ending 8/2009. Seconded by Councilmember Gentle, motion passed unanimously. One appointment to Industrial Development Board. Councilmember Ford moved to re -appoint Robert Clark for a 6-year term ending 8/2009. Seconded by Councilmember Gentle, motion passed unanimously. 25 August 2003 3169 Two appointments to Board of Adjustment and Appeals. Councilmember Ford moved to re -appoint Bob Mannich and Charles Bassett to replace Charles Senior (resigned) for a 3-year term ending 8/2006. Seconded by Councilmember Gentle, motion passed unanimously. Charles Bassett is currently serving as an alternate. The alternate position will be filled at a later date. One appointment to Library Board. Councilmember Quinn moved to re- appoint Hollis Wisemen for a 4-year term ending 8/2007. Seconded by Councilmember Gentle, motion passed unanimously. Kelly Ivy, CEO of the Southland Gulf Neuromuscular Foundation (SGNF), addressed the City Council requesting permission to hold The Walk to D'Feet ALS in the streets of Fairhope on Saturday, November 15, 2003. After Mr. Ivy's presentation and City Council discussion Councilmember Ford requested to lay this issue over until the next regular City Council meeting so that the City Council could study the proposed route (map).
