HomeMy WebLinkAbout07-28-2003 Regular MeetingSTATE OF ALABAMA )( 3156 COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 28 July 2003. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and City Clerk/Treasurer, Geniece W. Johnson, gave the invocation. Councilmember Quinn moved to approve minutes of the 14 July 2003, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Anders moved to deny the request to zone the property of Dorothy Yeager from B3A — Tourist Resort Lodging District to 134-Business and Professional District. This property is located at 58 Fairhope Avenue. Seconded by Councilmember Quinn, the motion to deny this request passed by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none Councilmember Anders moved to approve the Site Plan request of Craig Dyas for Site Plan Review in accordance with Greeno Road Professional Park PUD, located East of U.S. Highway 98, North of Edwards, and South of Gayfer Avenue Ext. (Lot # 4). This site plan, as approved by the Planning Commission, the geometry of the right turn on North on U.S. Highway 98 (Greeno Road) must prohibit a left turn South on U.S. Highway 98 (Greeno Road). Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Quinn introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to enter into an agreement with the State of Alabama, acting by and through the Alabama Department of Transportation Enhancement project (Greeno Road pedestrian Way Development Project (Project STPTE-TE03(935)). Seconded by Councilmember Gentle, motion passed unanimously. Mr. George Roberds will work on having the sidewalks installed to the West side of Greeno Road instead of being installed on the East side of Greeno Road. This project will began in FY 2003-04. 28 July 2003 RESOLUTION NO. 978-03 3157 BE IT RESOLVED, BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE AS FOLLOWS: 1. That the City enter into an agreement with the State of Alabama, acting by and through the Alabama Department of Transportation relating to a Transportation Enhancement project with partial funding by the Federal Highway Administration, which agreement is before the Council. 2. That the agreement be executed in the name of the City, for and on behalf of the City, by it's Mayor. 3. That is be attested by the Clerk and the seal of the City affixed thereto BE IT FURTHER RESOLVED, that upon the completion of the execution of the agreement by all parties, that a copy of such agreement be kept on file by the City of Council. Seconded by Councilmember Anders, motion passed unanimously. Councilmember Anders moved to proceed within legal corporation to help improve County Road 27. Seconded by Councilmember Gentle, motion passed unanimously. The County Commission requested a financial commitment from the City of Fairhope for the County Road 27 Improvement Project, adding middle turn lane from County Road 48 to 44. (1/3 $34,000.00). Alabama on July 21. 2003 for construction of the herein referenced project is a true and correct copy of the bids submitted by the within named corporations. Tim E. Patton, Vice President Volkert and Associates, Inc. Base Bid includes installation of the Owner furnished 10 MGD UV system for a complete operational system. Additive Ahemate No. 1 includes the construction of a pre -fabricated metal building to cover the existing and new UV system. Additive Alternate No. 2 includes the construction of a concrete block building to cover the existing and new UV system. 28 July 2003 3160 Councilmember Gentle moved to accept the low bid of Robert J. Baggett, Inc. for the Renovation of the UV System Equipment at the Fairhope Water Reclamation Facility at $183,719.50, and moved to accept the bid of Robert J. Baggett, Inc. for the additive alternate block building (CMU Building) at $51,377.00, provided all specifications are met. Seconded by Councilmember Ford, motion passed unanimously. If the city crew is able to build the Block Building at a lesser cost of $51,377.00, a change order will be approved by the City Council decreasing this contract. Robert J. Baggett, Inc.'s alternative cost for the block building is good until October 2003. Councilmember Ford moved to hear the following three items that are not on the printed agenda. Seconded by Councilmember Anders, motion passed unanimously. On Tuesday, July 22, 2003, the Baldwin County area experienced lighting and heavy rains, causing damage to areas of the City of Fairhope. Identification: EMERGENCY REPAIRS TO BOX CULVERT ON SECTION ST AT BAYOR ST. Purchasing Agent Councilmember Ford moved to accept the low bid of Kahlbau Construction Co., Fairhope, AL, on an emergency basis to repair the box culvert on Section Street at Bayou Street, provided all specifications are met. Seconded by Councilmember Anders, motion passed unanimously. 28 July 2003 3161 Identification: EMERGENCY — REPLACE THREE REGULATOR AT NICHOLS AVENUE SUBSTATION Bids received by July 25,2003 Emergency replacement is due to lighting and heavy rains on Tuesday, July 22, 2003 VENDOR: TOTAL PRICE: DELIVERY Siemens PP & D , Birmingham, Al 416 KVA $9,445.00 each 333 KVA $8,445.00 each 3 weeks 1 week Cooper Power System, Waukesha WI 416 KVA $9,305.00 each 333 KVA $8,376.00 each 1-2 weeks 2-3 weeks J. H. Stewart, Jr with Stewart Engineering, Inc, and Aaron Norris with Electric Department recommend the purchase of three (3) 416 KUV regulators from Siemans PT &D for a total price of $28,335.00. Councilmember Anders moved to accept the bid of Siemens PT & D, Birmingham, Alabama, on an emergency basis to replace three regulators at Nichols Avenue Substation, provided all specifications are met. Seconded by Councilmember Ford, motion passed unanimously. The Electric Department has Siemens regulators in all their existing substations and all personnel are trained in the operation for this unit. This factor alone justifies paying the small 1.4 percent premium for the Siemens regulators. The large 416 KVA regulators will allow the Electric Department to provide adequate regulation for the maximum capacity of the Nichols Avenue Substation. Councilmember Christenberry moved to authorize Mayor Kant to write a letter to USDA expressing concerns of loosing affordable housing at Springrun Apartments, and require information on this matter, and send copies of this letter to the State Senator and Congressman, and ask to delay the August 11, 2003 deadline for 30 days. Seconded by Councilmember Anders, motion passed unanimously. Councilmember Quinn requested that another public forum be held regarding the Cable services to explain to the citizens what the vote is about and to view hard numbers. Councilmember Ford explained that the vote is just authorizing the city to acquire and operate a cable services. Once the votes are in and if the citizens want the City to look further into this, the City will, but this does not mean that the City will go into the cable business. But at least there will be an option. Councilmember Anders moved to address the cable service issue to the agenda. Seconded by Councilmember Quinn. The motion died due to the following tie vote: AYE -Quinn, Anders, and Christenberry.
