COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 23 June 2003.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Rev. Pierre Burns, Pastor of Fairhope Christian
Church, gave the invocation. Councilmember Anders moved to approve minutes of
the 09 June 2003, regular meeting. Seconded by Councilmember Quinn, motion
passed by the following votes: AYE -Ford, Quinn, Kant, Anders, and Christenberry.
NAY -none. ABSTAINED — Gentle.
Danny Calhoun, representative of Wayne Duncan, addressed the City Council
requesting that Mr. Duncan's request to zone his property to B4-Business and
Professional District be remanded back to the Planning and Zoning Commissioners,
to be considered at a Planned United Development. This property is located at the
Southwest corner of Gayfer and U.S. Highway 98. (Public Hearing held on June 9, 2003).
City Attorney Marion E. Wynne arrived 5:39 p.m.
Councilmember Ford moved to remand Mr. Duncan's rezoning request back to the
Planning and Zoning Commissioners to discuss a PUD. Seconded by
Councilmember Gentle, motion to remand this request back to P&Z passed by the
following votes: AYE -Gentle, Ford, Kant, Anders, and Christenberry. NAY -none
ABSTAINED -Quinn.
Sam Irby, representative of Regions Financial Corporation Tax Department,
addressed the City Council requesting that Regions Financial request to zone the
property of Regions Financial Corporation Tax Department to B-2 General Business
District be remanded back to the Planning and Zoning Commissioners for further
consideration. The property is located at the Northwest corner of Morphy and U. S.
Highway 98. (Public Hearing held on June 9, 2003)
Councilmember Gentle moved to remand Regions Financial's request back to the
P&Z particularly to look at zoning. Seconded by Councilmember Christenberry,
motion to remand this request back to P&Z passed by the following votes: AYE -
Gentle, Ford, Kant, Anders, and Christenberry. NAY -none ABSTAINED -Quinn.

Councilmember Gentle introduced in writing Ordinance No. 1173, an
ordinance authorizing a special election for a citizen vote on whether to authorize the
City of Fairhope to acquire, establish, purchase, construct, maintain, lease, and
operate a cable television system for the purpose of furnishing cable service to
subscribers. Chris Gill an Attorney with Hand Adrenal addressed the City Council to
explain this ordinance. In order to take immediate action, Councilmember
Christenberry moved for immediate consideration. Seconded by Councilmember
Gentle, motion for immediate consideration passed unanimously by the following
votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none.
Councilmember Gentle then moved for final adoption of Ordinance No. 1173.
Seconded by Councilmember Ford, motion for final adoption passed by the following
votes: AYE -Gentle, Ford, Quinn, Kant, and Christenberry. NAY -Anders.
Councilmember Gentle introduced in writing, and moved for the adoption of
the following resolution, a resolution accepting Streets and Utilities within Jackson
Place Phase Il subdivision for maintenance. Seconded by Councilmember
Christenberry, motion passed unanimously.
Resolution No. 471-03
WHEREAS, the Owners of Jackson Place Phase II desire to have all public streets and public right-of-ways
dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama, on Slide S-2117D, and
all Fairhope public utilities located in public right-of-ways accepted for maintenance by the City of Fairhope,
Alabama, and;
WHEREAS, the City of Fairhope, Alabama, has received notice from the engineers of the project that the design
and capacity of the public improvements have been designed in conformance with City requirements as indicated
on the recorded plat, and;
WHEREAS, the General Superintendent has indicated that the improvements meet City requirements, and;
WHEREAS, the City of Fairhope, Alabama, is not and in no manner will be responsible for the maintenance of
common areas in the subdivision as indicated on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama, has received from the owners of Jackson Place Phase II a
maintenance bond for the public improvements constructed for a period of 2 years from the date of the approval
of this Resolution, and;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that the public improvements indicated herein for Jackson Place Phase II are hereby accepted for
public maintenance subject to the bond posted.

Councilmember Gentle moved to table a resolution that would accept the
streets and all utilities within Idlewild Phase 7A subdivision for maintenance until
issues regarding drainage and engineering are addressed. Seconded by
Councilmember Ford, motion passed unanimously.
Councilmember Quinn introduced in writing, and so moved for the adoption
of the following resolution, accepting the streets and all utilities within Colony Place
Phase III subdivision for maintenance. Seconded by Councilmember Christenberry,
motion passed unanimously.
Resolution No. 472-03
WHEREAS, the Owners of Colony Place Phase III desire to have all public streets and right-
of-ways dedicated on the plat filed for record in the Probate Records of Baldwin County,
Alabama, as Slide Number 2118 D and E, and all utilities located in easements and in right-
of-ways accepted for maintenance by the City of Fairhope, Alabama, and;
WHEREAS, the General Superintendent of the City of Fairhope, Alabama, represents that
the public improvements in Colony Place Phase III have been installed in substantial
conformity with City requirements, and;
WHEREAS, the City of Fairhope, Alabama, has received notice from the engineers of the
project that the design and capacity of the public improvements have been designed in
conformance with City requirements as indicated on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama, is not and in no manner will be responsible for
the maintenance of common areas in the subdivision as indicated on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama, has received from the owners of Colony Place
Phase III a maintenance bond for the public improvements constructed for a period of 2 years
from the date of the approval of this Resolution, and;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRHOPE, ALABAMA, that the public improvements for Colony Place Phase III are
hereby accepted for public maintenance subject to the bond posted.

A Public Hearing was held as advertised on the request for a Club Liquor
License by Karen Lavender Schurr, dba Sweet Willies Brews and Cures, located at
109 South Section Street, Fairhope, Alabama. Chris Browning, Police Chief,
reported to the City Council that there are some unanswered questions regarding this
request, and recommended that the City Council table this request until the
unanswered questions are answered.
At 6:05 Mayor Kant opened the Public Hearing. Sandy Mitchell's family owns 109
South Section and he addressed the city council explaining that the building currently
needs to be redeveloped, and the Fire Inspector, Thomas Odom, has given the basis
on what needed to be done. Mr. Mitchell also stated that the Life Community Church
that is currently using the building would be moving out at the end of July 2003.
Charlie Baunhauer addressed the City Council expressing that he operates a business
at 402 Bellangee Lane and he spoke in favor of the Club Liquor License.
Emily Garner, a member of Fairhope United Methodist Church, located at 155 South
Section Street addressed the City Council to inquire about the age of persons that
would be allowed in this establishment, and the hours that the establishment will be
opened. The Public Hearing was closed at 6:10 p.m.
Councilmember Ford moved to table this request until all concerns and questions are
answered. Seconded by Councilmember Quinn, motion passed unanimously.
City Council reviewed an application for a Restaurant Liquor License by
Eliseo Avalos, dba El Mexicano, located at 80 & 90 Baldwin Square Shopping
Center, Fairhope, Alabama. Councilmember Quinn moved to approve the issuance of
the license. Seconded by Councilmember Gentle, motion passed unanimously.
Councilmember Ford moved to approve change order request # 2 by
Consolidated Fence Company, Daphne, Alabama to install two electronic control
gates at the Airport increasing the contract by $15,350.00. Seconded by
Councilmember Gentle, motion passed unanimously.
Councilmember Gentle moved to approve change order request # 1 by
Ammons and Blackmon Construction, Inc., Spanish Fort, Alabama for the Bishop
Road relocation portion of the new runway project by increasing the contract by
$2,100.00. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Quinn moved to update the Fairhope Police Reserve Roster
by adding: Daniel McKenzie. Seconded by Councilmember Ford, motion passed
unanimously.

Councilmember Gentle, Chairperson of the Old Jail Committee, and his
committee, Councilmember Anders and Councilmember Ford, reported that the
Committee envisions what the exterior of the Old Jail Building should look like. An
exhibit by Walcott Adams Verneuille Architects was presented. The new look for the
building is actually an old look. The Old Jail Committee recommends that the fagade
of the building be returned to its 1927 look complete with orange clay tile roofing and
stucco walls. Councilmember Gentle further reported that the committee has not
decided on what to do with the inside of the building.
Councilmember Gentle shared the following ideas for the use of the Old Jail building.
He expressed that the location for the City's clock, currently located on the corner of
Section Street and Fairhope Avenue, is not owned by the City of Fairhope.
Councilmember Gentle further stated that the building could be used as a people
center and could be used as the entrance to the new library.
Councilmember Ford expressed that this would be a good location for a Fairhope
Historical Museum.
Councilmember Anders, Chairperson of the Finance Committee, and her
committee, Councilmember Gentle and Councilmember Quinn, made the following
report:
In looking over the six-month financial report, it is clear that our expenses are
increasing at a faster rate than our revenues. While we are still in the black the trend
shows that corrections need to be made before problems do arise.
One of our biggest expenses has been in medical insurance payments. The city
basically has no control over those expenses. We feel offering our employees the
best possible coverage is important, and we do not recommend any change in our
policy.
Another large expense has been in legal fees. Again we have little control over those
issues.
In looking over our utilities and city services, we see that some items do not pay for
themselves. Garbage pick-up looses money each year. We recommend that the
Mayor look at charging an amount that actually covers the cost of operation.
Some of our biggest expenses have come in improvements to our water department
and adding much needed water wells, adding towers, and pumping stations. We
recommend that the city look at the actual cost of providing water services for its
citizens, and charging tap fees that include a pro rata share of the cost of a water well,
water tower, sewage treatment plant — any item that makes up the actual cost of
providing services to a new residence.

Merchants Capital has found that we can refund the 1996 Utility Revenue Warrant
Bond Issue that can now be called and save the city around $120, 000.00 to
$140,000.00 depending on the interest rate. We recommend that the city act now to
refund this issue and either take the cash out now, or lowering our interest payment.
Furthermore, we recommend that the city restore the fagade of the Old Jail/ Old City
Hall with the money we get from the State of Alabama for capital improvements. We
feel that restoring the fagade would enhance downtown and add to the downtown's
economic strength by keeping the area charming. We do not have the money at this
time to restore the interior, but the outside should be improved at once.
Councilmember Quinn moved to refund the 1996 URW bond issue, and to have
Merchants Capital and The Frazer Lanier Company to work together 50150.
Seconded by Councilmember Anders. Councilmember Gentle requested to amend
the motion to consider borrowing new monies for the need of the city's utilities.
Councilmember Quinn amended her motion as requested by Councilmember Gentle.
Again, seconded by Councilmember Anders.
Councilmember Ford questioned who would lead in this financing? Who will be in
charge? Mayor Kant stated that the two companies would have to work that out. The
motion passed unanimously.

Sue Mason Chairperson of the Airport Board addressed the City Council
requesting approval of the low bid of Esfeller Construction Company for Grading and
Drainage with a contingent addendum for First Course of Asphalt.
This bid is in two parts. The first part, grading and drainage of the new runway, is
already funded from this year's grant money. The low bid of Esfeller Construction
Company meets all specifications.
There is indication that there will be additional monies available at year's end
(August/September) and Fairhope is very high on the list to receive some of this
money because the Airport Board has been planning and engineering ahead on the
project.
The second portion of the bid is for the layer of paving on the new runway. If
additional funds are received, this addendum will be done. If no additional funds, this
portion of the bid will be cancelled and this work delayed until next year's funds.
Councilmember Quinn moved to accept the low bid of Esfeller Construction
Company, Coden, Alabama, for the grading and drainage of the new runway and for
the layer of paving on the new runway if additional funds are available, and provided
all specifications are met. Seconded by Councilmember Ford, motion passed
unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:32 p.m.
