HomeMy WebLinkAbout06-09-2003 Regular MeetingSTATE OF ALABAMA )( 3126 COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 09 June 2003. Present were Mayor Timothy M. Kant, Councilmembers: Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and Acting City Clerk Tyron D. Hoskins. Councilmember Robert Gentle and City Clerk Geniece W. Johnson were absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Reverend Mark Wilson of St. James Episcopal Church gave the invocation. Councilmember Anders moved to approve the minutes of the 27 May 2003, regular meeting and the 22 May 2003 special meeting. Seconded by Councilmember Ford, motion passed unanimously. Harriet Gutknecht, with the Historical Preservation Committee, gave a report on the recent Historical Homes Tour. Linda Jones and Eve Doherty presented Homes Tour sketches to all home owner participants for the Historical Homes Tour for 2002 and 2003. Dave Cain with Mediacom Cable gave a brief presentation on the enhanced services that they now offer subscribers. Mr. Cain stated that Mediacom provides same day service, 24-hour customer service, and greater reliability due to new fiber optic system. He also stated that they have enhanced the services by offering ten new analog channels, video on demand and will soon offer high definition television and telephony. Mr. Cain stated that Mediacom is committed to the City of Fairhope and their business investment in the community. Councilmember Anders moved for final adoption of Ordinance No. 1171 with the following conditions: This ordinance will zone the property of Hilliard V. Street, Anna Fisher Street, William E. Street, Elizabeth Mosley Street, Clifford Street, Gloria Devine Street, Harold Street and Cathy Meaut Street to Residential Planned Unit Development concurrent with annexation. This property is located at South Greeno Road on the West side near the intersection of County Road 34. Conditions: ❑ Require 10 feet side setbacks except in difficult situations at the discretion of planning staff. (Example 6 feet on one side and 14 feet on opposite side for a total of 20 feet) ❑ Require side entry or rear entry garage except in difficult situations at the discretion of planning staff. ❑ Traffic light will be paid by developer ❑ Require 37% house coverage 09 June 2003 3127 Seconded by Councilmember Ford, motion for final adoption of Ordinance No. 1171 passed by the following votes: AYE -Ford, Quinn, Kant, Anders, and Christenberry. NAY -None. A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance No. 557. Councilmember Anders introduced in writing the proposed ordinance to zone the property of Wayne Duncan to B4-Business and Professional District. The property is located at the Southwest corner of Gayfer and U.S. Highway 98. The Planning and Zoning Commission recommended denial of this zoning request. The public hearing was opened at 6:12 p.m. Vincent Valentim addressed the City Council with concerns about Greeno Road and stated that the City Council need to take a closer look at these projects before making decisions. The public hearing was closed at 6:16 p.m. This ordinance will come before the City Council for final adoption at the next City Council meeting. A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance No. 557. Councilmember Anders introduced in writing the proposed ordinance to zone the property of Regions Financial Corporation Tax Department to B-2 General Business District. The property is located at the Northwest corner of Morphy and U.S. Highway 98. The Planning and Zoning Commission recommended denial of this zoning request. The public hearing was opened at 6:19 p.m. Matt Dial addressed the City Council with concerns about the traffic and noise that already exist in this area. The public hearing was closed at 6:21 p.m. This ordinance will come before the City Council for final adoption at the next City Council meeting. A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance No. 557. Councilmember Anders introduced in writing Ordinance No. 1172, an ordinance to zone the property of Craig Dyas to R-3 TH High Density Single -Family Townhouse Residential District. The property is located at 204 Oswalt Street. The Planning & Zoning Commission recommended approval of this ordinance. No one present was opposed to the amendment. In order to take immediate action Councilmember Anders moved for immediate consideration. Seconded by Councilmember Christenberry, motion for immediate consideration passed unanimously by the following votes: AYE -Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Christenberry so moved for final adoption of Ordinance No. 1172. Seconded by Councilmember Anders, motion for final adoption passed by the following votes: AYE -Ford, Kant, Anders, and Christenberry. NAY -Quinn. 09 June 2003 3128 Councilmember Quinn introduced in writing and so moved for the adoption of the following resolution, a resolution adopting the 1,500 L.F. paved portion of Manley Road for maintenance. Seconded by Councilmember Anders, motion passed unanimously. Resolution No. 467-03 WHEREAS, the City of Fairhope and the Baldwin County Commission want to enter into an agreement providing for the continued improvements, and maintenance of Manley Road, and; WHEREAS, Baldwin County has already paved approximately .34 miles of Manley Road beginning at U. S. Highway 98 and extending eastward; and, WHEREAS, Baldwin County has received commitments for financing the construction and paving of an additional 1,500 L.F. of Manley Road beginning at the east end of the existing pavement and extending eastward from Southland Place, LLC and from Colony Place; and NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the public improvements constructed in accordance with Baldwin County Commission Resolution #2003-53 and City of Fairhope standards will be accepted for maintenance by the City Council of the City of Fairhope after 2 years of completion. Johnson, City C reasurer 09 June 2003 3129 Councilmember Anders introduced in writing and so moved for the adoption of the following resolution, a resolution accepting the streets and utilities within Sandy Ford Phase II subdivision for maintenance. Seconded by Councilmember Ford, motion passed unanimously. Resolution No. 468-03 WHEREAS, the Owners of Sandy Ford Phase II desire to have all public streets and public right-of- ways dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama, on Slide 2113 F, and all Fairhope public utilities located in public right-of-ways accepted for maintenance by the City of Fairhope, Alabama, and; WHEREAS, the City of Fairhope, Alabama, has received notice from the engineers of the project that the design and capacity of the public improvements have been designed in conformance with City requirements as indicated on the recorded plat, and; WHEREAS, the General Superintendent has indicated that the improvements meet City requirements, and; WHEREAS, the City of Fairhope, Alabama, is not and in no manner will be responsible for the maintenance of common areas in the subdivision as indicated on the recorded plat, and; WHEREAS, the City of Fairhope, Alabama, has received from the owners of Sandy Ford Phase II a maintenance bond for the public improvements constructed for a period of 2 years from the date of the approval of this Resolution, and; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the public improvements indicated herein for Sandy Ford Phase II are hereby accepted for public maintenance subject to the bond posted. Seconded by Councilmember Ford, motion passed unanimously. 9 June 2003 3130 RESOLUTION NO. 469-03 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute an Oil, Gas and Mineral Lease to Stampede Production, LLC on properties taken for the extension of the Fairhope Municipal Airport. Johnson, City Clerk/ asurer Councilmember Ford introduced in writing and made a motion for adoption of the following resolution, a resolution authorizing Mayor Kant to execute a Small Customer Exemptions Affidavit with Gulf South Pipeline Company, L.P. Seconded by Councilmember Quinn, motion passed unanimously. RESOLUTION NO. 470-03 WHEREAS, The No Notice Agreement Master Contract Number 14497 between the City of Fairhope and Gulf South ("NNSSCO Contract") and will supercede and replace the NNSSCO agreement dated April 22, 1998. WHEREAS, This Agreement is subject to all the applicable Federal Energy Regulatory Commission ("FERC") regulations. WHEREAS, In the event this Agreement conflicts with the NNSSCO Contract, the language of this agreement shall control. To the extent the language of this Agreement is determined to conflict with the language in Gulf South's FERC Gas Tariff, as amended from time to time ("Tariff'), then the Tariff shall control. WHEREAS, The term of this Agreement shall commence on April 1, 2002, and expire on March 31, 2012. The City of Fairhope shall have a contractual right of first refusal to extend this Agreement and the NNSSCO Contract subject to and be applied under the procedures established in Gulf South's Tariff. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that Mayor Timothy M. Councilmember Ford made a motion to accept Change Order Request # 1 from Don Gordon Construction for the Municipal Pool project by increasing the contract by $160,000.00. Seconded by Councilmember Christenberry, motion passed unanimously. Seconded by Councilmember Ford, motion passed unanimously. Identification: "FIBER OPTIC OUTSIDE PLANT" Bids to be received by: Tuesday, May 6, 2003 at: 4:00 p.m. City of Fairhope Utilities to utilize ADSS Single mode cable in all overhead construction.
