HomeMy WebLinkAbout05-12-2003 Regular MeetingSTATE OF ALABAMA )( 3109 COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 12 Ma.. 2003. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and Acting City Clerk Tyron D. Hoskins. City Clerk Geniece W. Johnson was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the invocation. Councilmember Quinn made a motion to approve the minutes of the 21 April 2003, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. Joe Birindelli with the South Alabama Veterans Council invited the City Council and the citizens of Fairhope to join them in the "Yellow Ribbon Rally" designed to support the troops on Armed Forces Day, which will be held May 17, 2003, at Battleship Park. The rally is an outgrowth of Fairhope's Yellow Ribbon campaign. Chip DeShields, Executive Director of the Alabama Preservation Alliance, addressed the City Council about preserving the quality of life for the City of Fairhope. Mr. DeShields stated that he would like to work with the Historical Preservation Committee to preserve this district and would like to move forward with preserving the City of Fairhope. Mayor Kant stated that the City Council needs to come together to further discuss this matter before a decision is made. Councilmember Gentle moved for final adoption of Ordinance No. 1169. An ordinance prohibiting the chaining or tethering of dogs and mandating that dog enclosures must provide 150 square feet of space of doges over six months of age. Seconded by Councilmember Christenberry, motion for final adoption passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle introduced in writing and moved for the adoption of the following resolution, a resolution authorizing Mayor Kant to sign the Municipal Water Pollution Prevention Program (MWPP) report. Seconded by Councilmember Ford, motion passed unanimously. 12 May 2003 RESOLUTION NO. 462-03 3110 MUNICIPAL WATER POLLUTION PREVENTION (MWPP) PROGRAM ATTACHMENT 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that Timothy M. Kant, is hereby authorized to inform the Department of Environmental Management that the following actions were taken by the City Council of the City of Fairhope, Alabama. Reviewed the MWPP Annual Report which is attached to the resolution. 2. Set forth the following actions and schedule necessary to maintain effluent requirement contained in the NPDES Permit, and to prevent the bypass and overflow of raw sewage within the collection system or at the treatment plant: No action was required to be taken by the City of Fairhope Passed this 121h Day of May--,,2003 by an unanimous vote r y M.jKant, Attest: eniece W. Johnson, City Clerk /Treasurer Date Councilmember Anders moved to un-table the request of the Fairhope Public Library Board, requesting that an additional $1.5 million be pledged to cover the cost of developing working plans and to begin construction of the new library. 12 May 2003 3111 Seconded by Councilmember Quinn, moved to un-table passed unanimously. Councilmember Anders introduced in writing and moved that we accept the following resolution of the Fairhope Public Library Board by granting them the additional funds needed for a total of $3 million pledged by the City of Fairhope. Seconded by Councilmember Gentle, motion passed unanimously. Resolution No. 463-03 WHEREAS, the Board of Directors and staff of the Fairhope Public Library have studied the needs and requirements for a new freestanding public library building for the City of Fairhope for two years; and, WHEREAS, the Library Board members and staff have met on many occasions with the architect, Mac Walcott, to arrive at an appropriate conception of what the form, capacity, and capabilities of the new library building should be; and, WHEREAS, the last directive received from Mayor Timothy Kant and the Fairhope City Councilmembers limited the Board's planning funds to $75,000.00; and, WHEREAS, it is understood that construction costs may exceed this amount, and the Library Board and friends of the Library pledge to pursue all avenues of funding in order to raise S 1.5 million; and, THEREFORE BE IT FURTHER RESOLVED, by the Governing Body of the City of Fairhope, that Mayor Timothy M. Kant is hereby authorized to pledge an additional S 1.5 million to cover the cost of developing working plans and to begin construction of the new library. Johnson, City Cle / reasurer The request of Fairhope First, Inc., requesting to rename a portion of North Section Street from intersection with U. S. Highway 104 to Greeno Road (Northwest leg of the Triangle) to Freedom Drive, was turned over to the Street Committee. Mayor Kant stated that Fairhope First, Inc. should work with Councilmember Gentle and Police Chief Browning to find a solution to this request. Jim Merrihew, President of Fairhope First, Inc., stated that this request is a show of support for the troops until they return home. 12 May 2003 3112 Councilmember Anders moved to turn over the request of Jeff Pollock requesting permission for Fairhope Police assistance for their Triathlon at the intersection of Scenic Highway 98 and County Road 32 and the intersection of Scenic Highway 98 and County Road 1, to Police Chief Browning to research and to look into having the City reimbursed for all overtime expenses. Seconded by Councilmember Quinn, motion passed unanimously. Councilmember Quinn moved to update the Fairhope Police Reserve roster by adding Michelle Gandy and by deleting Chris Oos.
