HomeMy WebLinkAbout04-21-2003 Regular MeetingSTATE OF ALABAMA X 3096 COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday. 21 April 2003. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and Acting City Clerk Tyron D. Hoskins. City Clerk Geniece W. Johnson was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Pastor Jim Hill of Fairhope Avenue Baptist Church gave the invocation. Councilmember Anders made a motion to approve the minutes of the 14 April 2003, regular meeting. Seconded by Councilmember Christenberry, motion passed unanimously. Councilmember Anders introduced in writing a proposed ordinance for the prohibiting of the chaining or tethering of dogs or cats and mandating that dog enclosures must provide 150 square feet of space for dogs over six months of age. This ordinance will come before the City Council for final adoption at the next regular City Council meeting. Councilmember Anders introduced in writing Ordinance No. 1166, an ordinance annexing the City of Fairhope property, tract 8, located South of Bishop Road, Fairhope, Alabama, 27.50 acres, more or less. In order to take immediate action Councilmember Ford moved to suspend the rules. Seconded by Councilmember Gentle, motion to suspend the rules passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY - none. Councilmember Gentle then moved for final adoption of Ordinance No. 1166. Seconded by Councilmember Quinn, motion for final adoption passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle introduced in writing Ordinance No. 1167, an ordinance annexing the City of Fairhope property, tract 10, located South of Bishop Road, Fairhope, Alabama, 33.30 acres, more or less. In order to take immediate action Councilmember Quinn moved to suspend the rules. Seconded by Councilmember Ford, motion to suspend the rules passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY - none. Councilmember Gentle then moved for final adoption of Ordinance No. 1167. Seconded by Councilmember Ford, motion for final adoption passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. 21 April 2003 3097 Councilmember Ford introduced in writing Ordinance No. 1168, an ordinance annexing Raynard Bolton and Hezekiah Tate property, located at 19054 Ingleside Street, Fairhope, Alabama, .43 acres, more or less. In order to take immediate action Councilmember Anders moved for immediate consideration. Seconded by Councilmember Quinn, motion for immediate consideration passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle then moved for final adoption of Ordinance No. 1168. Seconded by Councilmember Ford, motion for final adoption passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Ford introduced in writing and moved for the adoption of the following resolution, a resolution authorizing Mayor Timothy Kant to vacate the City of Fairhope's gas line easement in Section 26 and transfer it to Malbis Plantation, Inc. and complete the necessary documents granting the City of Fairhope a gas line easement located in Section 23. Seconded by Councilmember Christenberry, motion passed unanimously. RESOLUTION NO. 461-03 WHEREAS, Malbis Plantation, Inc. on May 29, 1950, granted the City of Fairhope a gas line easement located in Section 26, Township 4 South, Range 2 East and recorded in Book 155, Pages 268-270 at the Office of the Judge of Probate, Baldwin County, Alabama; and, WHEREAS, the City of Fairhope has discovered an error in the description of the gas line location. The gas line exists in Section 23, but is described in the easement as existing in Section 26; and, WHEREAS, the actual gas line exists in Section 23, Township 4 South, Range 2 East, and in order to vacate the gas easement located in Section 26, the City of Fairhope has to execute a Termination of Easement and Quick Claim Deed transferring the easement in Section 26 back to Malbis Plantation, Inc.; and, WHEREAS, the gas easement located in Section 26 is not needed for public or municipal purposes; and, WHEREAS, Malbis Plantation, Inc. will deed an easement to the City of Fairhope, where the gas line actually exists, located in Section 23, Township 4 South, Range 2 East; and, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant, is hereby authorized to vacate the City of Fairhope's gas line easement in Section 26 and transfer it to Malbis Plantation, Inc. and complete the necessary documents granting the City of Fairhope a gas line easement located in Section 23. Milton, dba Williams Grocery, located at 623 Middle Street, Fairhope, Alabama. Councilmember Gentle so moved to approve the issuance of the license. Seconded by Councilmember Anders, motion passed unanimously. City Council reviewed the request of the Fairhope Public Library Board requesting that sufficient funds (additional $1.5 million) be pledged to cover the cost of developing working plans and to begin construction of the new library. This request was turned over to the financial committee. The financial committee requested that a six-month financial review be completed in order to make an intelligent decision of whether or not the City will be able to pledge the additional funds. The financial committee will meet on May 1, 2003, and a decision will be made at the next regular council meeting. Councilmember Ford moved to approve the Eastern Shore Art Center's request to hold its annual Outdoor Art Show on March 19-21, 2004, on Oak Street from Bancroft to Section Street, and up Section Street three quarters of a block past Equality Street. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Gentle moved to approve the Eastern Shore Art Center's request to use the Pier Park south of the Fairhope Pier for the Grand festival of Art by the Bay on October 18-19, 2003, from 10:00 a.m. until 5:00 p.m. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Quinn moved to approve the Fairhope High School Engineering Class request for permission to block off Bancroft Street from the Eastern Shore Art Center north to Bayou for their 2°d Annual Soapbox Derby on May 9, 2003, from 9:00 a.m. until 1:00 p.m. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Gentle moved to accept the bid of Utility Power, Inc., Fairhope, Alabama, for thirty (30) 50 KVA Transformers provided all specifications are met. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Quinn moved to accept the bid of Brasfield Sales, Birmingham, Alabama, for ten (10) 100 KVA Transformers provided all specifications are met. Seconded by Councilmember Gentle, motion passed unanimously. CITY OF FAIRHOPE P.O. Drawer 429 Fairhope, Alabama 36533 OFFICE OF PURCHASING AGENT April 14, 2003 Mr. Mayor, Council, It is time to bid fuel for city use. I recommend that the City of Fairhope begin to purchase from the State of Alabama Petroleum Products Contract number T 104 for Mid -Grade Gasoline and #2 Diesel Fuel used by the City of Fairhope. The low bidder for the Alabama State Bid Contract in our area is Minto Energy Corporation, Mobile, AL. The actual amount would be $0.05400 above plat price. Wayne Smith, Purchasing Agent Councilmember Ford moved to accept the state bid of Minto Energy Corporation for Mid -Grade Gasoline and #2 Diesel Fuel provided all specifications are met. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Quinn moved to hear Councilmember Ford on an item not on the printed agenda. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Ford made a motion to use $130,000.00 from the Recreation Improvement Fund and $30,000.00 from the General Fund to complete the Municipal Pool Complex project and gazebos and to pay the General Fund back the $30,000.00 with the income that comes in monthly to the Recreation Improvement Fund. Seconded by Councilmember Gentle, motion passed unanimously. 21 April 2003 3108 Councilmember Anders moved to allow Chip DeShields, Executive Director of the Alabama Preservation Alliance, to speak on Historical Preservation. Seconded by Councilmember Quinn. There was no vote called for and no resolution to the motion to hear Chip DeShields. Mayor Kant denied the request. There being no further business to come before the City Council the meeting was duly adjourned at 6.15 p.m.
