COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 24 February 2003_
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Rev. Gordon Milstead, gave the invocation.
Councilmember Gentle moved to approve minutes of the 10 February 2003, regular
meeting. Seconded by Councilmember Quinn, motion passed unanimously.
City Attorney arrived 5:41 p.m.
Mayor Kant and the City Council presented the following Proclamation to the
Fairhope High School Basketball Team, and each team member was presented with a
certificate.

FAIRHOPE HIGH SCHOOL BASKETBALL TEAM DAY
Whereas, it gives me a great deal of pleasure to express to Coach Ralph Watson, his
Assistant Coaches, and all the members of the Fairhope High School Basketball
Team, on behalf of the City Council and all the citizens of Fairhope, our sincere
congratulations on your exceptional season, going Thirty-two straight games without
a loss. The only loss marring this perfect record coming in the third game of the State
Playoff, and,
Whereas, this has been an exciting, hard-fought, and successful basketball season,
and we are proud of the record you have earned and the fine publicity you have
brought to our community by your inspired team play; and,
Whereas, to really excel in any one sport, a young person must demonstrate, in
addition to a great deal of natural ability, and outstanding spirit to dedication
enthusiasm and hard work and a striking example of this has been brought to our
attention in this team's achievement.
NOW THEREFORE, I Timothy M. Kant, as Mayor, on behalf of the Fairhope City
Council and all our citizens do hereby proclaim Monday, February 24, 2003, to be
FARIHOPE HIGH SCHOOL BASKETBALL TEAM DAY in our city, and we
are pleased to publicly commend coach Watson, his staff, and all the members of the
High School Basketball team for your fine efforts, and to extend this token of
affection and admiration with which you are regarded in this city.

Ron Hayes addressed the City Council informing the City Council that he will
spend the two years addressing all the cities in Alabama offering materials and
service to aid in making the work place safe. Mr. Hayes and materials and services
may be used at no cost to the City of Fairhope.
Mayor Kant asked John Pritchett to address the City Council to give an
overview of the City's new Safety Management Team. Mr. Pritchett shared with the
City Council that there is a representative from all department serving on this team.
The purposes of the team:
• To act as a resource for safety programs for each department.
• To develop and refine the city safety program
• To investigate all incidents of on the job injuries and accidents and to obtain a completed
Incident Report from the employee involved or injured and a completed incident Investigation
Report from the employee's supervisor.
• To develop corrective actions based on the above reports
• To address safety matters brought to our attention by City of Fairhope employees.
The Goals of the team and of the Safety Program:
To insure the health and safety of each employee of the City of Fairhope
To have an accident and injury free workplace
To have each and every employee of the city aware of the City's safety program and to
understand the safety is his or her personal responsibility
Each member of the team is charged with going back to his department and
developing a program of regular safety meetings in order to help the City of Fairhope
Management Team fulfill its purpose and meet its goal.
Councilmember Gentle introduced in writing a proposed ordinance for Flood
Damage Prevention. This ordinance will repeal Ordinance No. 668 adopted 9 March
1981. This ordinance will come before the City Council for final adoption at the
next regular City Council meeting.

Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.
RESOLUTION NO. 440-03
BE IT RESOLVED that Mayor Timothy M. Kant is hereby authorized to execute a
contract between the City and Severn Trent Services (STL Mobile), Mobile,
Alabama, to provide services for the NPDES Permit (No. ALS000002 Monitoring
Requirements). For work preformed during 2002. The cost to complete this project
will be $2,216.67

Councilmember Christenberry introduced in writing, and moved for the
adoption of the following resolution. Seconded by Councilmember Ford, motion
passed unanimously.
RESOLUTION NO. 441-03
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute an
agreement between the City of Fairhope and Baldwin County Emergency Communication
District (E-911) to share tower space in Bay Minette area, and Fairhope area in order to
improve emergency communication throughout Baldwin County.
The term of this Agreement shall be for an initial term of one (1) year. This agreement shall
automatically be extended for an additional term of one (1) year (the renewal term).

Councilmember Quinn introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.
RESOLUTION NO. 442-03
WHEREAS, This agreement is entered into between the Baldwin County Health Department
and the City of Fairhope pursuant to an appropriation as provided in 22-3-10- Code of
Alabama, 1975 and entitled "Tax to establish and maintain county health officer and health
department; and,
WHEREAS, the City of Fairhope agrees to support a comprehensive mosquito control
program in accordance with the publication: How to Start a Mosquito Control Program in
Your Town, Alabama, "Step -By -Step instructions and resources to protect the public Health
from Mosquito -Borne Diseases" and other such information and guidance as endorsed by the
Baldwin County Health Department and the Alabama Department of Public Health; and,
WHEREAS, the Baldwin County Commission has established a separate fund for the
proceeds of said tax. Such taxes shall be used for no other purpose except that for which the
said tax is levied and collected. The proceeds of said tax shall be transferred from the
separate fund to the City based on a written authorization from the Department.
Appropriations are based on $2.00 per resident population according to the 2000 Decennial
Census in the amount of $24,960.00 per year for the term of this agreement.
WHEREAS, all services performed under this Agreement shall begin on the date on which
this Agreement is executed and shall terminate three (3) years from the effective date of
execution.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute an
agreement between the City of Fairhope and Baldwin County Health Department to support
the comprehensive mosquito control program in accordance with the publication: How to
Start a Mosquito Control Program in Your Town, Alabama.

Councilmember Ford introduced in writing, and moved for the adoption of the
following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.
RESOLUTION NO. 443-03
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, THAT Mayor Timothy M. Kant, is hereby authorized to execute a lease
contract between the City of Fairhope and Caterpillar Financial Services Corporation
of Nashville, TN for the lease of a Caterpillar Backhoe Loader. The term of the lease
shall be for four (4) years at $10,176.17 each year for the Gas Department.

WHEREAS, it is of vital interest to all citizens of our Nation that we possess a sou
National Defense, and that our Armed Forces and National Guard continue to prov
a strong deterrent to attack from hostile sources and to maintain the security of our
country and free people everywhere; and,
WHEREAS, we gratefully acknowledge that we live in freedom today because of
many sacrifices that have been made and are being made today, by the valiant
serviceman and women in the armed services and national guard; and,
WHEREAS, the citizens of our community have constantly supported liberty and
those who champion the cause of freedom and many of our citizens, family meml
and friends have been called into the current war effort.
NOW THEREFORE BE IT RESOLVED, that the City of Fairhope publicly
acknowledges support of our serviceman and women through our prayers, tl
correspondence, and deeds; and,
BE IT FURTHER RESOLVED, we urge all our citizens to pay tribute to members
all military organizations by hanging a yellow ribbon on trees or in prominent
locations to show our grateful appreciation until their safe return.

City Council reviewed an application for a Restaurant Liquor License by J
W. Kennedy, dba Renaissance Cafe (Oor Wullie Incorporated), located at 10 '/z
North Section Street, Fairhope, Alabama. Councilmember Anders moved to appr
the issuance of the license. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Quinn moved to reschedule the March 1 oth regular City
Council meeting to Thursday, March 13, 2003, due to the National League of Ci
meeting. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Christenberry addressed the City Council and the public to
inform everyone that there will be test performed within the City to determine just
how long and how Formosan Termites have traveled into the City of Fairhope.

Councilmember Gentle moved to accept the only bid of Jim House &
Associates, Inc, Fairhope, Alabama, to provide Ultraviolet (UV) System Equipment
for the Fairhope Water Reclamation Facility, provided all specifications are met.
Seconded by Councilmember Ford, motion passed unanimously.

Mayor Kant stated that he and the Chief of Police, Christopher Browning,
lobbied in Washington DC to secure funds for the City of Fairhope. One Million
Dollars have been allocated to the City of Fairhope to help with the Greeno Road
Project and 1 %2 millions dollars have been allocated by the legislatures for the new
runway at the Municipal Airport.
Chief Browning was also lobbing for the City of Fairhope to be used as a pilot
program for Traffic and Homeland Security.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:00 p.m.
