COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 10 February 2003.
Present were Mayor Pro -temp Cecil Christenberry, Councilmembers: Robert
C. Gentle, Michael A. Ford, Debbie W. Quinn, and Pauline Anders; City Attorney
Marion E. Wynne, and City Clerk Geniece W. Johnson. Mayor Timothy M. Kant
was absent.
There being a quorum present, Mayor Pro -temp Christenberry called the
meeting to order. The Pledge of Allegiance was recited, and Mrs. Laurey Murphy,
Associate Pastor of Trinity Presbyterian Church, gave the invocation.
Councilmember Quinn moved to approve minutes of the 27 January 2003, regular
meeting. Seconded by Councilmember Gentle, motion passed unanimously.
Mayor Pro -temp Christenberry read the following Proclamation proclaiming
February 18, 2003 as Arbor Day.

WHEREAS, TREES ARE RECOGNIZED AS A VALID ASSET PROVIDING A MORE
HEALTHFUL AND BEAUTIFUL ENVIRONMENT IN WHICH TO LIVE; AND,
WHEREAS, THEY PROVIDE OXYGEN, SHADE, AESTHETICS AND A PRICELESS
PSYCHOLOGICAL COUNTERPOINT TO THE MAN-MADE URBAN SETTING; AND,
WHEREAS, TREES ARE ECONOMICALLY BENEFICIAL IN ATTRACTING NEW
INDUSTRY, RESIDENTS, AND VISITORS; AND,
WHEREAS, WHEN GROWN IN THE RIGHT PLACE AND OF THE PROPER
VARIETIES, THEY ENHANCE THE VALUE AND MARKETABILITY OF PROPERTY, AND
PROMOTE THE STABILITY OF DESIRABLE NEIGHBORHOODS; AND,
NOW THEREFORE, I, TIMOTHY M. KANT, AS MAYOR OF THE CITY OF FAIRHOPE
DO HEREBY PROCLAIM TUESDAY, FEBRUARY 18, 2003, AS ARBOR DAY IN THE CITY OF
FAIRHOPE, RECOGNIZING THE IMPORTANCE OF TREES IN OUR ENVIRONMENT AND
THE RESPONSIBILITY WE HAVE TO MAINTAIN AS MANY NATURAL TREES AS
POSSIBLE FOR GENERATIONS TO COME AS WELL AS IMPLEMENTING WHEN WE CAN;
AND,
FURTHER, BE IT RESOLVED THAT I URGE ALL OUR CITIZENS TO DO THEIR
PART IN MAKING OUR ENVIRONMENT POLLUTION FREE THEREBY IMPROVING THE
ECONOMIC AND CULTURAL CLIMATE OF THE COMMUNITY AND GROWING AND
MAINTAINING TREES ON THEIR PROPERTY WHEN THEY CAN.

Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution authorizing Mayor Kant to execute an agreement between
the City of Fairhope and Moore Engineering Company to provide engineering
services for the construction of repairs to the City of Fairhope Municipal Pier caused
by Tropical Storm Isidore. Seconded by Councilmember Gentle, motion passed
unanimously.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that
Timothy M. Kant is hereby authorized to execute an agreement between the City of Fairhope and
Moore Engineering Co., Inc. to provide engineering services for the construction of repairs to the
City of Fairhope Municipal Pier caused by Tropical Storm Isidore (September 2002).

City Council reviewed an application for a Restaurant Liquor License by
Mitchell Lee Sconfrenza, dba Mitch's Point Cafe, located at 759 Nichols Avenue,
Fairhope, Alabama. Councilmember Gentle moved to approve the issuance of the
license. Seconded by Councilmember Quinn, motion passed unanimously.
Councilmember Anders moved to appoint Hank Mullins to the Recreation
Board to complete Bob Callahan's (resigned) term. The term will end 5/2004.
Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Ford moved to grant the request of Alabama Environmental
Council, requesting permission to use the North Park at the Municipal Pier for Earth
Day, April 13, 2002. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Anders moved to grant the request of South Alabama British
Car Club requesting permission to conduct their Annual British Car Show at Fairhope
Beach Park on Saturday, November 8, 2003. This event will be held from 7:00 a.m.
until 4:00 p.m. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Gentle moved to pay bills as presented. Seconded by
Councilmember Ford, motion passed unanimously.
Richard Bond with the Citizens Responsible Government addressed the City
Council stating that he and his group is opposed to the plan to extend County Road
13. Mr. Bond listed the following environmental problems and impacts that the
extending of County Road 13 would cause Fairhope:

• Impact on Fly Creek and Cowpen Creek watershed
• The City would be divided
• The extension of the road would aggravate existing problems such as runoff
and siltation in area watersheds.
• The extension of County Road 13 is not in the best interest of the citizens of
Fairhope.
The City Council voted at the regular City Council meeting on September 9, 2002 to
pass a resolution stating that the Fairhope City Council disapproved of the proposal
for County Road 13 in its present form.
The City Planner, Christopher Baker, expressed that anybody that is interested in
looking at the plans that he has you are welcome to come by his office.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:00 p.m.
