COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Wednesday, 11 December 2002.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Rev. Jim Hill, Pastor of Fairhope Avenue
Baptist, gave the invocation. Councilmember Quinn moved to approve minutes of
the 25 November 2002, regular meeting. Seconded by Councilmember Gentle,
motion passed unanimously.
A Public Hearing was held as advertised on a proposed ordinance to amend
the Zoning Ordinance No. 557. Councilmember Ford introduced in writing
Ordinance No. 1163. This ordinance will amend Zoning Ordinance No. 557, and
amend Ordinance No. 1136 approving a Planned Unit Development to be called
Village North. The zoning classification of Village North is hereby changed from
R1- Low Density Single Family Residential and R4-Low Density Multi -Family
Residential to a Planned Unit Development, and as such shall be developed in
accordance with Ordinance No. 1087 and the terms of this Ordinance. The Planning
& Zoning Commission recommends approval of this ordinance. No one present was
opposed to the amendment. The property is located South of Parker Road, North of
Highway 104, West of U.S. Highway 98 (Greeno Road), and East of Scenic Highway
98.
After a review by Christopher D. Baker, Director of Planning and Building,
Councilmember Gentle moved for immediate consideration. Seconded by
Councilmember Ford, motion for immediate consideration passed unanimously by the
following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -
none. Councilmember Ford moved for final adoption of Ordinance No. 1163.
Seconded by Councilmember Christenberry, motion for final adoption passed by the
following votes: AYE -Gentle, Ford, Quinn, Kant, and Christenberry. NAY -Anders.

Councilmember Gentle moved to grant Change Order request # 1 by
Consolidated Fence Company for the H.L. "Sonny" Callahan Airport, Fairhope,
Alabama, increasing the contract by $2,275.00. Seconded by Councilmember Quinn,
motion passed unanimously.
Councilmember Anders moved to authorize the sale of Surplus Property
owned by the City of Fairhope. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Gentle moved to open a checking account for the Industrial
Development Board in the amount of $10,000.00, and proper reporting of all
expenditures must be given. This money will be used to support the Industrial
Development Board's goals. Seconded by Councilmember Ford, motion passed
unanimously.

Two options available:
Option A: Chip waste into usable mulch (yard waste recycling)
Option B: Burn material with Air Curtain Burner

Two options are available.
Option l: Chip waste into usable mulch (yard waste recycling).
Option 2: Burn material with Air Curtain Burner.
Recommendations:
To accept Pittman Tractor Bid of $19,900.00 to burn material yard waste on site (option B).
Should the council decide to have material chipped instead of burnt, recommendation would be to accept EGS,
Inc. bid of $43,000.00 to chip all of yard waste currently on -site.

Councilmember Anders moved to award the public works project to Pittman
Tractor for the burning of the City of Fairhope's yard waste and debris caused by
Topical Storm Isidore. Seconded by Councilmember Christenberry, motion passed
unanimously. The total cost of this project is $19,900.00. The debris caused by
Tropical Storm Isidore costing $11,250.00 will be reimbursed by the following:
FEMA will reimburse 75%. State will reimburse 10%, and the City of Fairhope will
be responsible for 15% of the cost.
Councilmember Quinn so moved to pay bills as presented. Seconded by
Councilmember Gentle, motion passed unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 5:49 p.m.
