HomeMy WebLinkAbout10-28-2002 Regular Meeting2986 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 28 October 2002. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Rev. Mark Wilson, Pastor of St. James Episcopal Church, gave the invocation. Councilmember Quinn moved to approve minutes of the 14 October 2002, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. The Dogwood Trail Maids presented the City Council with a new 2002 Dogwood Trail Court picture to hang in the Fairhope Civic Center Lobby. Councilmember Gentle introduced in writing Ordinance No. 1161. An ordinance to amend Ordinance No. 955, Personnel Rules, Policies and Procedures Ordinance to add Disability Insurance as an employee benefit. In order to take immediate action, Councilmember Anders moved for immediate consideration. Seconded by Councilmember Gentle, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle then moved for final adoption of Ordinance No. 1161. Seconded by Councilmember Ford, motion for final adoption passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders and Christenberry. NAY -none. Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution, to execute an agreement between the City of Fairhope and Bay Benefits Group to provide Disability Insurance to the City of Fairhope employees. Seconded by Councilmember Ford, motion passed unanimously. 28 October 2002 RESOLUTION NO.418-02 2987 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA that Mayor Kant is hereby authorized to execute an agreement between the City of Fairhope and Bay Benefits Group to provide Disability Insurance to the City of Fairhope employees. RESOLUTION NO.419-02 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA that Mayor Kant is hereby authorized to execute an agreement between the City of Fairhope and Tank Pro Inc. to provide a maintenance program for the 300,000 Gallon Elevated Tank located at 18440 County Road 33. John n, City Clerk 2988 28 October 2002 Councilmember Anders introduced in writing, and moved for the adoption of the following resolution to amend the original agreement between the City of Fairhope and Gould Evans Goodman, Associates, L.C. to simplify the City of Fairhope Zoning Ordinance. The original agreement was signed 12/99. Seconded by Councilmember Quinn, motion passed unanimously. RESOLUTION NO.420-02 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA that Mayor Kant is hereby authorized to amend the original agreement between the City of Fairhope and Gould Evans Goodman, Associates, L.C. to simplify the City of Fairhope Zoning Ordinance. RESOLUTION NO. 421-02 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA that Mayor Kant is hereby authorized to execute an agreement between the City of Fairhope and Gould Evans Goodman, Associates, L.C. to conduct a Traffic Study. Johnson, Jerk 2989 28 October 2002 Councilmember Anders introduced in writing, and moved for the adoption of the following resolution, to execute an agreement between the City of Fairhope and Cable System Services, to conduct a walkout and engineer the entire Fairhope service area and develop a complete telecommunications capital budget for the project. Seconded by Councilmember Gentle, motion passed unanimously. RESOLUTION NO. 422-02 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA that Mayor Kant is hereby authorized to execute an agreement between the City of Fairhope and Cable System Services, to conduct a walkout and engineer the entire Fairhope service area and develop a complete telecommunications capital budget for the project. Johnso , City Clerk 2991 28 October 2002 City Council reviewed an application for a Restaurant Liquor License by A. James Keyser, dba Colony Grill, Inc, located at 104 North Section Street, Fairhope, Alabama. Councilmember Quinn moved to approve the issuance of the license. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Gentle moved to grant the following request of Life Community Church as long as this event is coordinated with the Police Department. Life Community Church requested permission to have a block party at 109 South Section Street on Thursday, October 31, 2002, from 7:00 p.m. to 9:00 p.m. and requested permission to block off Section Street at Greer's Super Market and Morphy Avenue at 5:30 p.m. and requested permission to assemble a live band at 109 South Section Street, amplification of Christian music, and safe fun festivities for trick -or - treaters. Seconded by Councilmember Quinn, motion passed unanimously. Christopher Browning, Chief of Police, addressed the City Council to explain that the Police Department had applied for a Local Law Enforcement Block Grant. Each Police Department must establish or designate an advisory board to review the application. The board must be designated to make non -binding recommendations for the proposed use of funds received under this program. The advisory board must include a member from each of the following local organization: law enforcement agency, prosecutor's office, court system, school system, and a nonprofit group (e.g., educational, religious, community) active in crime prevention or drug -use prevention or treatment. The advisory board will be dissolved once the project is complete. Councilmember Ford moved to establish the following advisory board: Chief of Police Christopher Browning District Judge Jody Bishop City Attorney/Prosecutor Carol Kemp J. Larry Newton School Principal SuEllen Brazil Faith Baptist Church Dr. Stan Weatherford The motion to establish the advisory board for the LLEBG, was seconded by Councilmember Quinn, motion passed unanimously. Appointment — Tree Committee — One 3-year term. Councilmember Gentle moved to reappoint Tom Ellis to the Tree Committee for a 3-year term. (Term ends October 2005). Seconded by Councilmember Ford, motion passed unanimously. Appointment — Harbor Board — One 2-year term. Councilmember Anders moved to appoint Councilmember Christenberry to the Harbor Board for a 2-year term. (Term ends October 2004). Seconded by Councilmember Gentle, motion passed unanimously. 2992 28 October 2002 Councilmember Quinn moved to reschedule the next Regular Council meeting to Tuesday, November 12, 2002, due to Veteran's Day. Seconded by Councilmember Gentle, motion passed unanimously. Identification: SEWER MACHINE Bids be received no later than: October 22, 2002 at: 4.00 p.m. Sewer Machine Truck to be used by City of Fairho a Sewer Department. VENDOR: TOTAL PRICE: DELIVERY.• SANSOM EQUIPMENT CO., Mobile, AL Total Equipment Cost: $218,872.00 Rate Of Interest: 150-180 Days 4.88%for 5-years Total Lease Price: $251,932.65 Payment due one (1) year after delivery. Rate of interest unknown at 10/22/02 at 4:00 p.m. DID NOT INCLUDE LEASE PRICE INFORMATION TRUCK EQUIPMENT SALES, Mobile, AL SPECIFICATIONS NOT MET It is recommended to accept the low bid of Sansom Equipment, Mobile, AL with all specifications being met. Dan McCrory, Water & Sewer Department Wayne Smith, Purchasing Agent Councilmember Gentle moved to accept the low bid of Sansom Equipment, Mobile, Alabama, provided all specifications are met. Seconded by Councilmember Ford, motion passed unanimously. EXPLANATION: We cannot legally accept the interest rate of Empire Truck Sales since it was not included in the bid package received on October 22, 2002 at 4:00 p.m. Ms. Johnson double-checked the interest rates of Sansom Equipment and Empire Truck Sales. For informational purposes, Sansom Equipment was $17,328.71 less than Empire Truck Sales. A fax from Empire Truck Sales stating interest rate was received on October 23. Specifications not met by TRUCK EQUIPMENT SALES, Mobile, AL. • The air conveyance system did not meet specifications • Dull Stainless Steel Ball Floats located on each outlet of the debris body not provided. They can provide one (1). • Storage rack could not be mounted where specified. • Vacuum system drive blower configuration could not be provided. • Hot shift blower drive system could not be provided. • On the Boom, the lift and swing movements cannot be provided as specified. • Other specifications not met. Seconded by Councilmember Anders, motion passed unanimously. This was a State of Alabama Bid. Councilmember Ford moved to address the following item not on the printed agenda. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution to designate Tommy Long as the City of Fairhope's local agent for FEMA. Seconded by Councilmember Ford, motion passed unanimously. 2994 28 October 2002 RESOLUTION NO. 424-02 DESIGNATION OF APPLICANT'S LOCAL AGENT BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that TOMMY LONG, General Superintendent, 251/928-2136, Post Office Drawer 429, Fairhope, Alabama 36533, is hereby authorized to execute for and in behalf of the City of Fairhope, a public entity established under the laws of the State of Alabama, this application and to file it in the appropriate State office for the purpose of obtaining certain Federal financial assistance under the Disaster Relief Act (Public Law 100-707) or otherwise available from the President's Disaster Relief Fund. That the City of Fairhope, a public entity established under the laws of the State of Alabama, hereby authorized its agent to provide to the State and to the Federal Emergency Management Agency (FEMA) for all matters pertaining to such Federal disaster assistance the assurances and agreements as required.
