The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 23 September 2002.
Present were Mayor Pro -temp Cecil Christenberry, Councilmembers: Robert
C. Gentle, Michael A. Ford, Debbie W. Quinn, and, Pauline Anders; City Clerk
Geniece W. Johnson. Mayor Timothy M. Kant, and City Attorney Marion E. Wynne
were absent.
There being a quorum present, Mayor Pro -temp Christenberry called the
meeting to order. The Pledge of Allegiance was recited, and Father Gordon Milsted,
Pastor of St. Lawrence Catholic Church, gave the invocation. Councilmember Gentle
moved to approve minutes of the 09 September 2002, regular meeting. Seconded by
Councilmember Ford, motion passed unanimously.
Councilmember Anders introduced in writing Ordinance No. 1156. This is an
ordinance providing regulations relating to existing non -metered electrical
connections. In order to take immediate action, Councilmember Gentle moved for
immediate consideration. Seconded by Councilmember Ford, motion for immediate
consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn,
Anders, and Christenberry. NAY -none. Councilmember Gentle then moved for final
adoption of Ordinance No. 1156. Seconded by Councilmember Anders, motion for
final adoption passed unanimously by the following votes: AYE -Gentle, Ford,
Quinn, Anders and Christenberry. NAY -none.
Councilmember Gentle introduced in writing an ordinance to provide for
uniform location of utility service laterals and meters in the Fairhope service area.
Councilmember Gentle moved to layover this proposed ordinance until some
questions could be answered. Seconded by Councilmember Quinn, motion to layover
this proposed ordinance passed unanimously by the following votes: AYE -Gentle,
Ford, Quinn, Anders and Christenberry. NAY -none.
Councilmember Gentle introduced in writing Ordinance No. 1157. This is an
ordinance amending in part and ratifying in part Ordinance Number 1037 — Tree
Committee Ordinance. In order to take immediate action, Councilmember Ford
moved for immediate consideration. Seconded by Councilmember Quinn, motion for
immediate consideration passed unanimously by the following votes: AYE -Gentle,
Ford, Quinn, Anders, and Christenberry. NAY -none. Councilmember Ford
then moved for final adoption of Ordinance No. 1157. Seconded by Councilmember
Quinn, motion for final adoption passed unanimously by the following votes: AYE -
Gentle, Ford, Quinn, Anders and Christenberry. NAY -none.

Councilmember Ford introduced in writing, and moved for the adoption of the
following resolution. Seconded by Councilmember Anders, motion passed
unanimously.
RESOLUTION NO.412-02
WHEREAS, under the provisions of Section 216 of Public Law 81-516, Emergency Watershed
Protection Program, and Title IV of the Agricultural Credit Act of 1978, Public law 95-334, NRCS is
authorized to assist the Sponsor in relieving hazards created by natural disasters that cause a sudden
impairment of a watershed; and,
WHEREAS, the Sponsor and NRCS agree to a plan which provides for restoration of certain works of
improvement referenced in Section A.
NOW THEREFORE, in consideration of the premises and of the several promises to be faithfully
performed by the parties hereto as set forth, the Sponsor and NRCS do hereby agree as follows:
A. IT IS AGREED that the following described work is to be constructed at a total estimated
cost of $145,800.00

City Council reviewed an application for a Restaurant Liquor License by
Robert Comalander Jr., dba Blue Marlin Restaurant, located at 8594 U.S. Highway
98, Fairhope, Alabama. Councilmember Anders moved to approve the issuance of
the license. Seconded by Councilmember Gentle, motion passed unanimously.
City Council reviewed an application for a Restaurant Liquor License by Gina
L. Gambino, dba The Ravenite Pizzerria, located at 102 North Section Street,
Fairhope, Alabama. Councilmember Gentle moved to approve the issuance of the
license. Seconded by Councilmember Anders, motion passed unanimously.
City Council reviewed an application for a Restaurant Liquor License by
James P. McKay, dba Jubilee Bar & Grill, located at 902 Morphy Avenue, Fairhope,
Alabama. Councilmember Quinn moved to approve the issuance of the license.
Seconded by Councilmember Anders, motion passed unanimously.
City Council reviewed an application for a Special Retail License (Golf
Course) by The City of Fairhope (Applicant Alan Pate), dba Quail Creek Golf Course
Snack Bar, located at 19841 Quail Creek Drive, Fairhope, Alabama. Councilmember
Ford moved to approve the issuance of the license. Seconded by Councilmember
Gentle, motion passed unanimously.
City Council reviewed an application for a Special Retail License (One time
Event) by Mark J. Kidd, dba Coastal Conservation Association (Mark J. Kidd
Bartender), located at 14210 Greeno Road (Oak Hollow Farm), Fairhope, Alabama.
Councilmember Quinn moved to approve the issuance of the license. Seconded by
Councilmember Anders, motion passed unanimously.
City Council reviewed an application for a Special Retail License (One time
Event) by Anita Drummond, dba Prevent Child Abuse Alabama, located at 16655
Polo Club Road, Fairhope, Alabama. Councilmember Ford moved to approve the
issuance of the license. Seconded by Councilmember Gentle, motion passed
unanimously.
Lee Turner addressed the City Council requesting permission to place 4-
columns, 5 feet into the City Right-of-way at 402 Bellangee as well as having a
stairway landing within this 5-foot area. Councilmember Ford expressed that he did
not have a problem with the 4 columns, but did have a problem with setting a
precedence with placing a stairway on the City's right-of-way. After further
discussion, Councilmember Ford moved to grant the request to place 4 columns 5 feet
into the City's right-of-way, and moved to refer the stairway request to the Sidewalk
Committee. Christopher Baker is assigned to work with the Sidewalk Committee on
this request. Seconded by Councilmember Gentle, motion passed unanimously.

In the absent of Sherry Sullivan, Police Chief Christopher Browning
addressed the City Council requesting permission to block De la Mare Avenue from
3:30 p.m. — 7:00 p.m. each Thursday evening from October 3, 2002 to November 14,
2002. The streets will be used to host an outdoor Fall Farm Market. Chief Browning
pointed out that traffic will be exiting the parking lot across from the K-I Center exit
onto De la Mare Avenue. Therefore, Chief Browning requested to allow the entrance
and exit of this parking lot from Church Street only during the Fall Farm Market.
Chief Browning also pointed out that this Fall Farm Market will be a grower market,
and that other persons selling produce Monday through Friday will only be allowed to
sell on Church Street only after obtaining a permit from the Chief of Police. After
further discussion, Councilmember Gentle so moved to grant this request. Seconded
by Councilmember Quinn, motion passed unanimously.
Councilmember Anders moved to grant the request of the Lighthouse
requesting permission to celebrate Domestic Violence Awareness Month with a walk
through Fairhope. This event will begin at the Municipal Pier on October 12, 2002, at
9:00 a.m. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Quinn moved to update the Police Reserve Roster by adding:
Bunkie Bishop, Danny Beaver and David Johnson, and by deleting: Tommy
Bozeman, Jimmy Cantrell, and Dan McCrory. Seconded by Councilmember Gentle,
motion passed unanimously.

the following resolution. Seconded by Councilmember Ford, motion passed
unanimously.
RESOLUTION NO. 413-02
WHEREAS, THE GOVERNING BODY OF THE CITY OF FAIRHOPE authorized
Mayor Kant within Resolution No. 803-01, on December 10, 2001, to execute a
contract agreement between the City and the Alabama Department of Conservation
and Natural Resources, State Lands Division, to provide and install interpretative
signage to be located in the Mobile Bay area, and Mayor Kant is hereby authorized to
pay the matching portion of $4,300.00 of Grant NOAA Award 170Z1112. The term
of this contract shall be from October 1, 2001 to September 30, 2002.
WHEREAS, the parties hereto agree to amend the original Contract as follows:
Duration — "The Contractor shall commence performance on this Contract on the lst
day of March, 2002, and shall complete performance to the satisfaction of the Lands
no later than the 3 0 day of March, 2003."

Dr. George Gilmore addressed the City Council to offer a proposal to the City
Council for the Old City Jail, located at 24 North Section Street. Mr. Gilmore stated
that the Single Tax Corporation has received two bona fide offers of over a half
million dollars each for the old jail site. FSTC know that the City is unable to enter
into such transactions. Therefore, FSTC asked the City to return the old jail site to
the FSTC in order to make the lease available for purchase. When the old jail site is
returned to FSTC, FSTC hereby pledge to return to the City of Fairhope all net
proceeds from the sale of the lease for the new library complex.

Dr. Gilmore did not know what the leasee would do with the old city jail, but stated
that the leasee would communicate with the City of Fairhope, and would preserve
what ever could be preserved.
Councilmember Gentle, Chairperson of the Old Jail Committee, stated that the
committee is working on getting to the footprint of the original building, and then will
look at the options for the building. An environmental study still has to be done to
address all environmental issues.
Councilmember Ford expressed concerns of the amount of the net profit. There may
be environmental issues that will cut the net profit, such as buried fuel tanks, bringing
the building up to code and salvaging what can be preserved. Councilmember Ford
also inquired if there was a time limit on these offers.
Dr. Gilmore stated that there was no time limit on these offers.
Charles W. Ham, FSTC Secretary, addressed the City Council and expressed that the
FSTC would pick up the bill of the environmental concerns.
Mayor Pro -temp Christenberry thanked FSTC, and expressed that the City Council
will take this proposal under consideration.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:23 p.m.
