HomeMy WebLinkAbout09-09-2002 Regular Meeting2949 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 9 September 2002. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Father Gordon Milsted, Pastor of St. Lawrence Catholic Church gave the invocation. Councilmember Quinn moved to approve minutes of the 26 August 2002, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Gentle introduced in writing Ordinance No. 1153. An Ordinance for Bond Issue, General Obligation Warrants, 2002. In order to take immediate action, Councilmember Anders moved for immediate consideration. Seconded by Councilmember Ford, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY - none. Councilmember Gentle then moved for final adoption of Ordinance No. 1153. Seconded by Councilmember Ford, motion for final adoption passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders and, Christenberry. NAY - none. Councilmember Ford introduced in writing Ordinance No. 1154. An Ordinance for Bond Issue, Utilities Revenue Warrants, Series 2002. In order to take immediate action, Councilmember Anders moved for immediate consideration. Seconded by Councilmember Quinn, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY - none. Councilmember Ford then moved for final adoption of Ordinance No. 1154. Seconded by Councilmember Gentle, motion for final adoption passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY - none. Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Christenberry, motion passed unanimously. 09 September 2002 RESOLUTION NO. 408-02 2950 A RESOLUTION COMPLYING WITH THE REQUIREMENTS OF SECTION 8.2 (B) OF THE TRUST INDENTURE BETWEEN THE CITY OF FAIRHOPE, ALABAMA, AND REGIONS BANK DATED AS OF NOVEMBER 1, 1996 BE IT RESOLVED by the Mayor and City Council (herein together called the "Council") of the City of Fairhope (herein called the "City"), in the State of Alabama, as follows: In order to comply with the requirements of Section 8.2 (b) of that certain Trust Indenture between the City and Regions Bank, dated as of November 1, 1996 (herein called the "1996 Indenture"), so that $6,720,000 aggregate principle amount of Utilities Revenue Warrants, Series 2002, dated September 1, 2002 (herein called the "Series 2002 Warrants") of the City may be issued as additional securities under the provisions of the 1996 Indenture, the Council does hereby adopt this resolution, request that Regions Bank, as trustee, authenticate and deliver the Series 2002 Warrants to the purchasers thereof, and make the following recitals preliminary to the issuance of the Series 2002 Warrants: (1) The City is not at this time in default under the 1996 Indenture and no such default is imminent; (2) The persons to whom the Series 2002 Warrants have been sold and shall be delivered are The Frazer Lanier Company Incorporated and Merchant Capital LLC; (3) The Series 2002 Warrants are to be issued by sale and none thereof is to be issued by exchange; (4) The sale price of the Series 2002 Warrants is $6,608,504.70 (which reflects an original issue discount of $61,095.30 and an underwriting discount of $50,400) plus accrued interest on the Series 2002 Warrants from their date until the date of delivery thereof and payment therefore; 2951 09 September 2002 (5) No securities have previously been issued by the City under the 1996 Indenture or under any indenture supplemental thereto other than $4,195,000 aggregate principal amount of Utilities Revenue Warrants, Series 1996, dated November 1, 1996, which were issued under the 1996 Indenture and which are now outstanding in the aggregate principal amount of $2,830,000; $7,735,000 aggregate principal amount of Utilities Revenue Warrants, Series 1997, dated March 1, 1997, which were issued under the First Supplemental Indenture dated as of March 1, 1997, and all of which are now outstanding and $1,905,000 aggregate principal amount of Utilities Revenue Warrants, Series 1999, dated June 1, 1999, which were issued under the Second Supplemental Indenture dated as of June 1, 1999, and which are now outstanding in the aggregate principal amount of $1,780,000; and (6) The Series 2002 Warrants are to be issued for the purpose of (a) paying the costs of acquiring and constructing water and sanitary sewer line extensions, a water tank, three water wells, and booster pump and such other improvements as the Council may determine to be necessary and desirable, (b) providing for the debt service reserve fund under the 1996 Indenture, and (c) paying the costs related to the issuance of the Series 2002 Warrants, including the premium for municipal bond insurance. An Ordinance ratifying Resolution No. 763-01, and amending Ordinance No. 1128 — Environmental Advisory Board. In order to take immediate action, Councilmember Anders moved for immediate consideration. Seconded by Councilmember Gentle, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle then moved for final adoption of Ordinance No. 1155. Seconded by Councilmember Quinn, motion for final adoption passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders and Christenberry. NAY -none. Councilmember Ford moved to address item # 9 at this time. Seconded by Councilmember Gentle, motion passed unanimously. Daniel G. Blackburn with Blackburn & Conner, P.C. Law Office, addressed the City Council requesting the City Council to review the Fairhope Planning Commission's denial of an application submitted by Baldwin County Sewer Service for approval to extend its lines within the extraterritorial planning jurisdiction of the City of Fairhope. (ss 11-52-11 Code of Alabama). Mr. Blackburn requested that the City Council, along with the Planning Commission, meet with him and his clients, Baldwin County Sewer Service, in a work session to discuss this issue and reach an agreement. Christopher Baker, Director of Planning and Building, explained to the City Council that the request to approve Baldwin County Sewer Service to provide sewer service in the Planning Jurisdiction of the City of Fairhope under Section 11-52-11 of State Code, came before the Planning Commission on July 1, 2002. The Planning Commission denied the request and passed a resolution. The request was denied based on the following: A. The application is incomplete: 1. The applicant did not meet all of the requirements of providing map information, slopes, inverts, materials, pump sizes, alarm systems etc. (requested in item 1 of 31 May letter) 2. The applicant did not indicate all future sewer service expansion plans and areas of proposed service (requested in item 2 of 31 May letter). 2953 09 September 2002 The applicant did not provide financial information requested in item 4 and 6 of the 31 May letter. This information is critical to determining whether the proposed public utility is fiscally viable in the long-term. Without determining whether that is the case, the Planning Commission cannot reasonably assess the likelihood that the proposed utility will be able to serve future customers and to maintain, test, and monitor constructed facilities. 4. The applicant did not provide information regarding its response to documented ADEM environmental violation, as requested in item 5 of the 31 May letter. 5. The applicant did not provide financial information as requested in item 7 of the 31 May letter. B. Existing sewer facilities appear to be inconsistent with the Comprehensive Plan. The Current pattern of sewer provision is disconnected and irrational and will encourage leapfrog, of sprawl, type development patterns, which are specifically rejected in the Comprehensive Plan. 2. The current pattern of sewer provision appears inconsistent with the growth patterns currently predominating the City and the extraterritorial planning areas. 3. The current pattern of the sewer provision appears inconsistent with the "village" concept overwhelmingly favored by the community as specifically articulated in the Comprehensive Plan. 4. The sewer system proposed by the applicant is inherently inconsistent with the character of Fairhope and the numerous goals and objectives listed in the Comprehensive Plan, including: a. This provision of infrastructure be made according to priority growth areas and identified village centers. b. That the timing, intensity, and density of growth be coordinated with the availability of public facilities and services. c. The public investment be discouraged beyond or outside of planned growth areas. Mr. Baker expressed that he still had not received the items requested. 2954 09 September 2002 Robert H. Freilich, with Freilich, Leitner & Carlisle Law Office, from Kansas City, Missouri, and City Attorney Marion E. Wynne was present. Mr. Wynne stated that he was not sure if it was appropriate to give legal advice in a public forum. The City of Fairhope is currently in litigation with Elite Development LLC, pertaining to this issue. After City Council questions and discussion, Councilmember Quinn moved to uphold the staff s recommendation to deny the request. Seconded by Councilmember Gentle, motion passed unanimously. City Attorney, Marion E. Wynne exited the dais at 6:15 p.m. Councilmember Ford introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Anders, motion passed unanimously. After discussion, Councilmember Ford withdrew his motion authorizing Mayor Kant to amend the 2001-2002 budget. Councilmember Anders introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Ford, motion passed unanimously. RESOLUTION NO. 409-02 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, BALDWIN COUNTY, ALABAMA that Mayor Timothy M. Kant is hereby authorized to amend the Working of Budget FY 2001-2002, as recommended by staff. Adopted this 9th day of September , 2002 M. Seconded by Councilmember Quinn, motion passed unanimously. 09 September 2002 RESOLUTION NO. 410-02 2955 WHEREAS, there was filed in the Probate Records of Baldwin County, Alabama, in Miscellaneous Book 1 at Pages 230, 231 and 287, a plat of Park City Subdivision which dedicated certain streets and alleys for public use, and; WHEREAS, Park City Subdivision was not then nor has it ever been within the corporation limits or jurisdiction of the City of Fairhope, Alabama, such as would give the City control of streets or alleys therein, and; WHEREAS, the City of Fairhope did, by virtue of having installed and maintained a natural gas service pipeline within an area described in the attached Declaration of Vacation, acquired or have an easement to operate and maintain a gas pipeline therein, and; WHEREAS, the superintendent of the City of Fairhope Natural Gas Utility has informed the City Council that the particular line is no longer in service and, therefore, the subject easement is not being used nor is it required by the City, and; WHEREAS, it is the determination of this Council that the City of Fairhope has no jurisdiction over streets or alleys within Park City and, further, that the City has no public need for the easement existing within the described area; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, that this Council hereby assents to the Declaration of Vacation filed by Rocco and Bari Valluzzo and Kevin V. Spriggs Enterprises on 19 August 2002, insofar as it operates to divert the public of any rights existing or which might have existed by virtue of a natural gas pipeline within the area described. RESOLUTION NO. 411-02 WHEREAS, the State proposes a project of certain highway improvements in Baldwin County, Alabama, said project being designed as Project No. BRF 0101 (547) and consisting approximately of the following: 2365 LIN. Ft. 2" P.V.C. Water Line and miscellaneous appurtenances. WHEREAS, the City of Fairhope Water Department is the owner of certain facilities located on private or public right-of-way, as applicable, at places where they will interfere with the construction of said project unless said facilities are relocated; and, WHEREAS, the Transportation Director has determined that the relocation of the facilities hereinafter referred to is necessitated by the construction of said project and has requested or ordered, as applicable, the City of Fairhope Water Department to relocate same; and, WHEREAS, under the laws of Alabama, the State is required to compensate the City of Fairhope Water Department for all or part of such relocation; NOW, THEREFORE, the parties hereto agree as follow and other particular listed within the contract: The City of Fairhope Water Department, not being staffed or equipped to perform the relocation, requests that the relocation work be included in the State's Highway Construction Contract. The relocation of the facilities will be accomplished in accordance with and as shown by the City of Fairhope Water Department's reproducible mylar plans, specifications, and estimate transmitted herewith and made a part hereof by reference. The estimated cost of the "In -Kind" relocation including engineering is $28,249.99. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant, is hereby authorized to execute a reimbursable Agreement between the City of Fairhope and State of Alabama Department of Transportation for the relocation of utility facilities located on Highway 98 (Fish River Bridge Project). Adopted this 091h Day of September , 2002 C � � Ti thy M. ant, yor Attest: IOWA Geniece W. `► 2957 09 September 2002 Harry Phillips, Environmental Advisory Board Chairperson, addressed the City Council advising the City Council of the potential adverse environmental impacts the extension of County Road 13, as currently proposed by the Baldwin County Commission, will likely have upon the citizens of Fairhope — particularly those residing in or near the Fly Creek and Cowpen Creek watersheds. Mr. Phillips presented the following report: Mr. Mayor, members of the City Council and fellow citizens. In pursuit of its mission to advise and inform this Council and the public on environmental issues, the Board has investigated the proposed County Road 13 Extension Project in an attempt to weigh the benefits against the probable impact on our environment. We have met with county commissioners, county highway officials and engineers, county environmental officers, Auburn Experimental Station officials, and numerous citizens who reside in or near the path of the proposed extension. We have also spoken to city officials and Baldwin County Education Board officials. We have heard rumors that the County Road 13 extension was selected as an alternative to the widening of County Road 27 due in part to the high cost of relocating public utilities. We have also been led to believe that the State of Alabama has plans to trade another state highway in exchange for County Road 27 at which time they will proceed with plans to 4-lane 27. We have learned that some $3,000,000 in state and federal money has been appropriated for the extension from County Road 64 in Daphne to Highway 104 in Fairhope, and from County Road 44 to County Road 32 in Fairhope. In addition, an interchange at I-10 has been approved. Thus, when complete, County Road 13 will extend from Interstate 10 South, all the way to U.S. 98 west of Magnolia Springs. We have been told that the extension will be a 2-lane road needed to accommodate local traffic, such as transportation to the schools on or near the route. In fact, the extension is designed for speeds of 55 mph with few turns, no traffic lights and with 100-ft, or more, right -a -ways — 40 feet wider than is required for 2- lane county roads. It is a known fact that, regardless of the best laid plans, new roads lead to increased vehicular traffic and new development — both of which can be detrimental to our environment. We were told that the county highway officials met with the previous city administration five or six years ago and did not hear any objections to a long-range plan to extend County Road 13. A lot can happen in five years! 09 September 2002 2958 Five years ago, how many in this room had any idea that the City of Fairhope would record the highest ozone pollution levels in all of Mobile and Baldwin Counties. Were it not for a sudden shift in weather patterns this past summer, we could very likely be declared non -attainment. Ozone is formed when high levels of nitrous oxide and VOC's are exposed to sunlight and warm temperatures. Nitrous oxides are emitted from coal burning power plants and internal combustion engines. Until such time that these emissions are reduced through better technologies and more stringent regulations, increased vehicular traffic within the City of Fairhope and its surroundings will increase the probability of being declared non -attainment for air pollution. Five years ago, how many in this room had any idea that in the year 2001, the City of Fairhope would issue 281 new single family permits — a record in spite of the fact that we have adopted a Comprehensive Plan, which is intended to control growth so that "what makes Fairhope, Fairhope will not be destroyed". The proposed County Road 13 extension is likely to be in conflict with the Comprehensive Plan and has all the markings of accelerating SPRAWL. Furthermore, new road construction and residential and commercial development will, by definition, reduce our "green -space" by increasing "hard -surface" areas and result in increased storm water run off into and through the Fly Creek and Cowpen Creek watersheds. Peter Weise, of our Board, reported last year on these two watersheds. He questioned whether, in connection with development already in place, sufficient attention was being paid to the impact an individual development has on the entire watershed and observed "It would appear that development in the Cowpen Creek watershed has reached the point where the societal benefits of more development will be offset by the negative factors." He went on to state " The greatest threat to the environment in the Fly Creek watershed is yet to come. If property managed, this section of Fairhope can be an asset to the City and an example for the rest of the county and the state. If not properly managed the residents of Fairhope can look forward to flooding and concrete flumes as the order of the day and downstream residential and harbor activities adversely affected". As a result of our investigation, it is this Board's recommendation that the City Council move to deter and defer the proposed extensions to County Road 13 until such time that studies show that it will be compatible with the City's Comprehensive Plan and in the best interests of the majority of our citizens. It is our opinion that our citizens have the most to lose and the least to gain from this proposed project. Some of those present here tonight may have other concerns that they would like to present to you. 09 September 2002 2959 After discussion, Councilmember Gentle moved to pass a resolution stating that the Fairhope City Council disapprove of the proposal for County Road 13 in its present form. Seconded by Councilmember Christenberry. The motion passed by the following votes: AYE -Gentle, Ford, Kant, Anders and Christenberry. NAY — none, Abstain- Quinn. Several residents that reside on Highway 13 were present. City Council reviewed an application for a Special Retail License (One time event) by Brian "Scot" Sanders, dba 911 Memorial Freedom Rally, located at Oak hollow Farm, Inc. 14210 Greeno Road, Fairhope, Alabama. Councilmember Anders moved to approve the issuance of the license. Seconded by Councilmember Gentle, motion passed unanimously. City Council reviewed an application for a Special Retail License (One time event) by James A. Ketchum, dba Andree's Wine Cheese & Things, Inc., located at 403 Fairhope Avenue, Fairhope, Alabama. Councilmember Ford moved to approve the issuance of the license. Seconded by Councilmember Anders, motion passed unanimously. City Council reviewed an application for a Restaurant Liquor License by John E. Crimmins, dba Jalapenos at Battles Wharf, located at 19344 Scenic Highway 98, Fairhope, Alabama. Councilmember Anders moved to approve the issuance of the license. Seconded by Councilmember Quinn, motion passed unanimously.
