HomeMy WebLinkAbout06-24-2002 Regular MeetingSTATE OF ALABAMA )( 2907 COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 24 June 2002. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Wayne Smith, Purchasing Agent, gave the invocation. Councilmember Christenberry moved to approve minutes of the 10 June 2002, regular meeting with one correction. Seconded by Councilmember Gentle, motion passed unanimously. **Correction to the June 10, 2002, minutes: Over 150 citizens attended the City Council meeting to witness the City Council's final decision on the Alabama Art Collection. Mayor Kant thanked the citizens for attending this meeting, and thanked the citizens for voicing their opinions and concerns about the Alabama Art Collection. Mayor Kant stated that this was not a public hearing. Mayor Kant further stated that we should keep Fairhope, Fairhope and support the Fairhope artists, and if someone donated something to the City they should not expect something in return. Mayor Kant also stated that after contacting The Alabama League of Municipalities on the proposal to provide space to an artist, and in lieu of paying rent the artist would donate art work to the City, a person at the League advised that there are too many unknown facts, and recommended getting an Attorney General's Opinion on this proposal. ** End of Correction to the June 10, 2002, minutes. Councilmember Christenberry requested for the record his Old Jail Committee Understandings: Understanding # 1 July 23, 2001 (Agenda Item # 8) Mayor Kant appointed the Old Jail Committee with the stated purpose of "looking into the future of the old police building" Bob Gentle, Chairman Pauline Anders Mike Ford 24 June 2002 Understanding # 2 April 8, 2002, (Agenda item # 17) The Old Jail Committee, with a letter written by Mrs. Anders, requested the possible use of the old jail as an Art Museum, Artists Residence/Studio. Also requested the authorization of Mayor Kant to enter into negotiations with Nall on securing Alabama Art Collection to be a part of the museum for the possibility of using the old jail as an Art Museum, Artist Residence/Studio. Motion passed unanimously. Mayor appointed Pauline Anders to get someone from the Eastern Shore Art Center and from the Fairhope Historical Museum to work together to ensure that the endeavor with Nall will not hurt the Eastern Shore Art Center and the Fairhope Historical Museum. Understanding # 3 May 28, 2002 (Agenda item #4) A Resolution authorizing the City of Fairhope to appoint a Board of Directors to evaluate proposals for an Alabama Artist's Museum was withdrawn. The citizens committee never received the authorization of our City Council. Understanding # 4 Councilmember Christenberry's motion at the June 10, 2002, meeting brought the City Council back to the business of running the City as elected officials. This motion passed by the vote of 5-1, so we now can get to work on business at hand. Councilmember Anders requested for the record that she was offended that it was stated that this was never an official committee. Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Christenberry, motion passed unanimously. See Resolution No. 838-02 on next page 24 June 2002 Resolution No. 838-02 OU BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute an agreement between the City of Fairhope and Hutchinson, Moore & Rauch, LLC to provide Expert Witness Services at the following estimated fees: Task 1: Site Inspection $5,850.00 Task 2: Inspection of Documents $9,760.00 Task 3: Expert Witness Report $12,130.00 Task 4: Deposition and Trail Testimony Hourly, $150.00 per hour DULY ADOPTED THIS 241h DAY OF June , 2002. 4TihyM. ant, ayor Attest Geniece W. Johnson, y Councilmember Gentle moved to grant Change Order request # 2, by James Brothers Excavating, Inc., increasing the contract by $2,996.50, for the Quail Creek Entrance Resurfacing Project. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Ford moved to grant the request of South Alabama British Car Club, requesting permission to conduct their Twelfth Annual British Car Festival at Fairhope Beach Park on Saturday, October 5, 2002. This event will be held from 7:00 a.m. until 4:00 p.m. Seconded by Councilmember Gentle, motion passed unanimously. 24 June 2002 2910 Farther Patrick Dunn addressed the City Council requesting the City Council to pass a resolution causing each Councilmember to fast from the eating of mullet for one year as a teaching example to the public. After discussion, Councilmember Gentle introduced, and moved for the adoption of the following resolution. Seconded by Councilmember Quinn. After further discussion, Councilmember Gentle amended his motion to the following: • To pass a resolution causing each Councilmember to fast from the eating of mullet, but no time limit will be placed on the fasting period. • To contact the Federal and State authorities regarding this issue Seconded by Councilmember Ford, motion passed unanimously. Resolution No. 389-02 on next page 24 June 2002 Resolution No. 389-02 2911 WHEREAS, Farther Patrick Dunn addressed the City Council requesting the City Council to pass a resolution causing each Councilmember to fast from the eating of mullet for one year as a teaching example to the public. WHEREAS, Farther Dunn read the following from a story about the mullet fish: For us to do our job we need your help. You can help us best by removing your nets from us for a while and fast from us for a while and fast from out flesh. If you find that you are too weak to fast, then take what you need of us using cast nets only. If you can do this, I can make you some promise: 1. The value of your shore lands will increase. 2. Safety of waterfront enjoyments will increase. 3. Aquaculture will increase 4. Clean oyster availability will increase (in due time) 5. Mercury levels in mullet eaters of the sea possibly will decrease 6. Health department anxieties will decrease 7. Seafood allergies may probably decrease 8. Children will experience the odor of fresh salt air 9. All salt water industries will improve in the long run 10. Emerald shores will return 11. The tarpon (Ala. State Fish, 1956) will return. (He likes clear water and mullet, and oyster beds. 12. Mullet will be adopted by the U.S. Department of Energy due to the tremendous biomass energy potential of detritus. The above list will continue to grow because of the promise of a fish, and we will live ever happily after. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, BALDWIN COUNTY, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to cause each Councilmember to fast from the eating of mullet, but with no time limit placed on the fasting period, and authorized to contact the Federal and State authorities regarding this issue Adopted this 241h day of June , 2002. Johnson, jity Clerk 24 June 2002 2912 Mr. Harry Phillips, Chairman of the Environmental Committee, addressed the City Council reporting the highlights of the Fairhope Environmental Advisory Board activities through June 2002. The FEAB's focus is on on -going environmental issues of prime concern to the Mayor and City Council, the Planning and Zoning Board and of interest to the citizens of our city. These are: • Storm Water Runoff and Soil Erosion • Sanitary Sewer and Septic Systems • Air Quality Issues and Awareness • Water Resources and Quality • Community Activities • Public Issue Response Activities Councilmember Gentle exited the Council Chambers at 6:15 p.m. and returned at 6:15 p.m. Councilmember Christenberry granted Mayor Kant's request to authorize conducting a monthly City Council Update Meeting on the 3rd Friday of each month at 8:30 a.m., in the City Hall Conference Room. This meeting will last one hour and a half. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Ford moved to reschedule City Council Meeting from Monday, July 8, 2002, to Wednesday, July 10, 2002, due to the Electric Cities Meeting. Mr. Long showed each vendor the area to be fenced. Mr. Long asked that they figure the fencing per linear foot. Both vendors did so but one, Mobile Fence, figured incorrectly. The amounts were recalculated and the pricing on the bid tabulation reflects figures per linear foot. I asked Tommy Long, General Superintendent, to be present at the council meeting if there were any questions. Wayne Smith, Purchasing Agent Councilmember Gentle moved to accept the low bid of Mobile Fence Company, Mobile, Alabama, provided all specifications are met. Seconded by Councilmember Ford, motion passed unanimously.
