The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 10 June 2002.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Rev. Stan Weatherford, Pastor of Faith Baptist
Church, gave the invocation. Councilmember Gentle moved to approve minutes of
the 28 May 2002, regular meeting. Seconded by Councilmember Quinn, motion
passed unanimously.
Over 150 citizens attended the City Council meeting to witness the City
Council's final decision on the Alabama Art Collection. Mayor Kant thanked the
citizens for attending this meeting, and thanked the citizens for voicing their opinions
and concerns about the Alabama Art Collection. Mayor Kant stated that this was not
a public hearing. Mayor Kant further stated that we should keep Fairhope, Fairhope
and support the Fairhope artists, and if someone donated something to the City they
should not expect something in return. Mayor Kant also stated that after contacting
Perry Rocquemore with the Alabama League of Municipalities on the proposal to
provide space to an artist, and in lieu of paying rent the artist would donate art work
to the City, Mr. Rocquemore advised that there are too many unknown facts, and
recommended getting an Attorney General's Opinion on this proposal. "Corrected
at June 24, 2002, meeting."
Councilmember Christenberry moved on the following 4-part motion:
• To completely dissolve and disband the citizens committee, effective
immediately and put this matter back under the hands of the City Council Jail
Committee, Chairperson Councilmember Bob Gentle, Councilmember Ford,
and Councilmember Anders.
• Remove from consideration any and all current proposals for possible use of
the Old Jail building.
• To do our job, as an elected body, of securing hard factual numbers on
possible renovation costs of wonderful old structure.
• Slow down, listen to our citizens and this council should determine viable
options for the use of the property.

Councilmember Ford seconded Councilmember Christenberry's 4-part
motion. Councilmember Ford stated that we should focus and showcase the Fairhope
artists. Councilmember Ford also thanked the Fairhope artist for making Fairhope
what it is today.
Councilmember Anders addressed the City Council stating that the Committee
should continue and finish their work, and make their report on the Old Jail building.
Mayor Kant stated that this committee was never officially established by the City
Council. The proposed resolution to appoint a Board of Directors to evaluate
proposals for an Alabama Artist's Museum was withdrawn on 28 May 2002.
The vote on the 4-part motion was as follows: AYE -Gentle, Ford, Quinn,
Kant, and Christenberry. NAY -Anders.
5 minutes recess was given to clear the Council Chambers.
A Public Hearing was held as advertised on a proposed ordinance to amend
the Zoning Ordinance No. 557. Councilmember Gentle introduced in writing
Ordinance No. 1150. The Planning & Zoning Commission recommends approval of
this ordinance. No one present was opposed to the amendment. An ordinance to
rezone Ms. Doris Manifold Estate (Benjamin Manifold Executor) from RA -
Residential Agriculture to RI -Low Density Single Family Residential. This property
is located West of County Road 27, and South of Windmill Road. After discussion,
in order to take immediate action Councilmember Anders moved for immediate
consideration. Seconded by Councilmember Gentle, motion for immediate
consideration passed unanimously by the following votes: AYE -Gentle, Quinn, Kant,
Anders, and Christenberry. NAY -none. Abstained -Ford. Councilmember Gentle
moved for final adoption of Ordinance No. 1150. Seconded by Councilmember
Christenberry, motion for final adoption passed unanimously by the following votes:
AYE -Gentle, Quinn, Kant, Anders, and Christenberry. NAY -none. Abstained -Ford.
Councilmember Quinn introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF FAIRHOPE, ALABAMA, that Electric Superintendent Aaron
Norris is hereby appointed to serve as the City of Fairhope's AMEA
Election Committee Representative.
I, Geniece W. Johnson, duly appointed City Clerk -Treasurer of the City of Fairhope,
Alabama, do hereby certify that the above Resolution is a true and correct copy of a
Resolution No. 837-02 passed and approved by the City Council of the City of
Fairhope, Alabama, on the 10`h day of June 2002.

Councilmember Quinn moved to grant the request of the American Heart
Association, requesting permission to hold their Eighth Annual American Heart Walk
on Saturday, November 2, 2002, beginning at 8:00 a.m. at the Fairhope Municipal
Pier. Seconded by Councilmember Gentle, motion passed unanimously.
Michael Cornell, President of Foley High School Band Boosters, addressed
the City Council and explained that the FHS Band Booster organization is hosting
their first motorcycle run on Saturday, June 29, 2002, initiating at Lulu's Marina at
Weeks Bay and touring the South Baldwin County area. The Foley Band Boosters
are requesting permission to place a checkpoint for the motorcycle run at the Fairhope
Municipal Pier area, and requesting permission to offer soda and water at the
checkpoint for the riders. Councilmember Ford moved to grant the request as long as
containers are placed at the checkpoint to collect the trash, and as long as this event is
organized with the Police Department. Seconded by Councilmember Gentle, motion
passed unanimously.

Pam Matthews addressed the City Council to ask that the City make everyone
aware of the problem with dogs attacking little dogs and cats in Fairhope. Ms.
Matthews and neighbors stated that they are afraid that these dogs may attack kids
and the elderly. Ms. Matthews experienced a tragic lost of her beloved cat to a pack
of dogs. Mayor Kant stated that the City is working on this problem and encouraged
the citizens to help with resolving this problem by contacting the City when they see
packs of dogs.
Councilmember Christenberry moved to hear a request from Councilmember
Quinn not on the printed agenda. Seconded by Councilmember Gentle, motion
passed unanimously.
Councilmember Quinn recommended and moved to ascertain the cost of
hiring a professional company that does restoration and renovation of older buildings
to access the structural environmental concerns, and what uses would be appropriate
for the Old Jail building. Seconded by Councilmember Gentle, motion passed
unanimously. Once said company is located the City Council will vote on
authorizing Mayor Kant to enter into a contact with said company.
Councilmember Gentle moved to pay bills as presented. Seconded by
Councilmember Ford, motion passed unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:14 p.m.
