COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Tuesday, 28 May 2002.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; and
City Clerk Geniece W. Johnson. City Attorney Marion E. Wynne was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Pastor Wallace H. Robinson of Fairhope
Christian Church, gave the invocation. Councilmember Quinn moved to approve
minutes of the 13 May 2002, regular meeting. Seconded by Councilmember Gentle,
motion passed unanimously.
William Payne Chairperson of the Fairhope Industrial Development Board,
reported to the City Council the various projects that the Industrial Development
Board has recently worked on.
Mr. Payne also gave the Industrial Development Board's new Mission
Statement: The mission of the Fairhope Economic Development Board is to promote
improvement of the quality of life for the residents of the Fairhope area by facilitating
environmentally sound economic diversification.
The Industrial Development Board operates under the Code of Alabama § 11-
54-80.
Lance LaCour, with the Baldwin County Economic Development and Alliance,
addressed the City Council stating that the BCEDA is responsible for marketing all of
Baldwin County as a whole, and marketing Fairhope. Mr. LaCour stated that light
industries are targeted for Fairhope
Following the Industrial Development Board Report, Councilmember Anders
moved to reappoint Lonnie Pardue and Rusty Winfree to serve a 6-year term each on
the Industrial Development Board. Seconded By Councilmember Christenberry,
motion passed unanimously.

Councilmember Gentle introduced in writing Ordinance No. 1149. An
Ordinance to amending Ordinance No. 606 to allow the Mayor to create a sidewalk
committee to review and approve requests to use sidewalks in the Central Business
District. In order to take immediate action, Councilmember Anders moved for
immediate consideration. Seconded by Councilmember Gentle, motion for
immediate consideration passed unanimously by the following votes: AYE -Gentle,
Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Gentle
then moved for final adoption of Ordinance No. 1149. Seconded by Councilmember
Anders, motion for final adoption passed unanimously by the following votes: AYE -
Gentle, Ford, Quinn, Kant, Anders and Christenberry. NAY -none.
A Resolution authorizing the City of Fairhope to appoint a Board of Directors
to evaluate proposals for an Alabama Artist's Museum was withdrawn. Mayor Kant
stated that several City Council members would like more information before making
a decision on what to do with the Old Police Department Building, located at 24
North Section Street. Mayor Kant stated that results of a survey that was conducted a
year ago revealed that the majority of the citizens wanted a museum placed at this
location. The survey did not specify whether the citizens wanted an art or historic
museum. Mayor Kant further stated that the City Council is trying to look at all
options for this location. Mayor Kant stated that for the next 30 to 60 days the
citizens are encouraged to present their request/concerns in writing or call the City
Council members. The City Council can then make a decision to benefit the whole
community not just one person.
Mayor Kant also stated that another proposal for the old jail was received. A
citizen proposed to donate $100,000.00 to the City if the jail was converted to a
children's learning center.
Councilmember Gentle moved to un-table the request to authorize Mayor
Kant to sign an agreement between the City of Fairhope and Softec Computers Inc.,
to install six (6) web cams. (Tabled on 4/22/02). Seconded by Councilmember
Quinn, motion passed unanimously.
Councilmember Quinn and Councilmember Gentle were appointed to research
this request. Councilmember Quinn reported, and recommended placing one web
cam at the top of the bluff overlooking the Municipal Pier. The site from the web
cam will be placed on the Eastern Shore Chamber of Commerce and Alabama Live
web sites only. At this time the committee does not recommend placing 5 (five) other
cams around town. Councilmember Quinn stated that a cam is already installed at
Page & Palette Book Store, overlooking Section Street. The Page & Palette cam is
installed on private property, and there may be other cams installed around town on
private properties in the future. The City cannot do anything about cams being
installed on private properties.

After discussion, Councilmember Quinn introduced in writing, and moved for
the adoption of the following resolution. Seconded by Councilmember Gentle,
motion passed unanimously.
RESOLUTION NO. 836-02
WHEREAS, Tommy Rachel with Softec addressed the City Council on 22 April
2002 requesting authorization for Mayor Kant to sign an agreement between the City
of Fairhope and Softec Computers Inc., to install six (6) web cams; and,
WHEREAS, Mr. Rachel proposal was to place four of the six web cams at the
intersection of Fairhope Avenue and Section Street. The web cams will be installed
to provide East, West, North and South views of the intersection. The fifth camera
will be installed on the bluff overlooking the pier; and,
WHEREAS, The service, equipment and installation will be at no cost to the City,
and the City's logo will be on all web cam pictures.
WHEREAS, This request was discussed and tabled at the regular City Council
meeting on 22 April 2002, until more information was provided.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, THAT Mayor Timothy M. Kant, is hereby authorized to execute a
contract between the City of Fairhope and Softec Computers Inc., Foley, Alabama to
install one (1) Web Cams at the top of the bluff overlooking the Municipal Pier.

Larry Smith addressed the City Council requesting permission to sell Baldwin
County fruits and vegetables on Church Street on Fridays and Saturdays. Mayor Kant
appointed Christopher Browning, Police Chief, Jennifer Fidler, Public Work Director,
and James Gillespie, Meter Department Superintendent, to work out the details of Mr.
Smith's request, and make the final decision. This will not come back before the City
Council for final decision.
Councilmember Gentle moved to update the Volunteer Fire Department
Roster by adding: Bill Bulman, Tommy Bozeman, David McAuley and Scott
Claycomb and by deleting: Mike Odom, Jim Salac, Tommy McDonald, Chad Kelly,
Jimmy Cantrell, Dodson Brown, Stoney Weaver, Doug Brown, and Mark Smith.
Seconded by Councilmember Quinn, motion passed unanimously.
Councilmember Quinn moved to update the Police Reserve Roster by adding:
Chris Boyington. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Ford moved to add a report by Jennifer Fidler on the cats and
dogs of Fairhope. Seconded by Councilmember Gentle, motion passed unanimously.
Jennifer Fidler, Public Works Director, reported that the City of Fairhope is
currently experiencing a problem with wild dogs running through the gullies. Ms.
Fidler stated that every effort to contain the dogs is being put in place, and
encouraged the residents to continue to call and report when wild dogs are sited. Ms.
Fidler reported the following information from the Animal Shelter since January
2002:
• 218 Total animals has been picked up
• 139 dogs were picked up
• 79 cats were picked up
• 100 plus wild dogs has been picked up
Ms. Fidler encouraged the residents to keep their cats inside from harms reach of
the wild dogs, and encouraged the residents to participate in a spay and neuter
program.
Councilmember Anders moved to add the bid for following bid for Triplex #4/0
AL Sweetbriar Strandseal Wire. Seconded by Councilmember Quinn, motion passed
unanimously.

Councilmember Ford moved to accept the low bid of Hughes Supply, Inc.,
Pensacola, Florida, for Triplex #4/0 AL Sweetbriar Strandseal Wire, provided all
specifications are met. Seconded by Councilmember Gentle, motion passed
unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:11 p.m.
