COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at 5:30 p.m.; Fairhope
Municipal Complex Council Chamber; 161 North Section Street, Fairhope, Alabama
36532; on Monday, 25 February 2002.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders and Cecil Christenberry; City
Attorney Marion E. Wynne, and Acting City Clerk, Tyron D. Hoskins. City Clerk,
Geniece W. Johnson was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and the invocation was given by Mr. Don Taebel of
Redeemer Lutheran Church. Councilmember Gentle moved to approve minutes of the 13
February 2002, regular meeting. Seconded by Councilmember Quinn, motion passed
unanimously.
Councilmember Ford introduced in writing and moved for the adoption of the
following resolution. Seconded by Councilmember Gentle, motion passed unanimously.

WHEREAS, The No Notice Agreement Master Contract Number 14497 between the
City of Fairhope and Gulf South ("NNSSCO Contract") and will supercede and replace
the NNSSCO agreement dated April 22, 1998.
WHEREAS, This Agreement is subject to all the applicable Federal Energy Regulatory
Commission ("FERC") regulations.
WHEREAS, In the event this Agreement conflicts with the NNSSCO Contract, the
language of this agreement shall control. To the extent the language of this Agreement is
determined to conflict with the language in Gulf South's FERC Gas Tariff, as amended
from time to time ("Tariff'), then the Tariff shall control.
WHEREAS, The term of this Agreement shall commence on April 1, 2002, and expire
on March 31, 2012. The City of Fairhope shall have a contractual right of first refusal to
extend this Agreement and the NNSSCO Contract subject to and be applied under the
procedures established in Gulf South's Tariff.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby
authorized to execute a No Notice Service Agreement between the City of Fairhope and
Gulf South Pipeline Company, LP (Gulf South).

Councilmember Gentle introduced in writing and moved for the adoption of the
following resolution. Seconded by Councilmember Quinn, motion passed unanimously.
RESOLUTION NO. 818-02
WHEREAS, The Lighthouse, Baldwin County Family Violence Project, is funded in part by the Law
Enforcement/Traffic Safety Division of the Alabama Department of Economic and Community Affairs.
The program currently has a full time Sexual Assault Counselor and a full time Sexual Assault Specialist
and serves Baldwin.
WHEREAS, The Sexual Assault Counselor works directly with adult victims of rape and sexual assault and
their families/significant other providing assessment and counseling services.
WHEREAS, The Sexual Assault Specialist is responsible for recruiting, training, and coordinating
volunteer advocates to respond to adult victims of rape and sexual assault in the crisis situation as requested
by law enforcement or hospital emergency room staff. The Sexual Assault Specialist will also be involved
in developing and implementing rape prevention programs throughout the county.
WHEREAS, there are several other services provided by this program for sexually assaulted victims.
WHEREAS, the Lighthouse provides a Domestic Violence Program were the following services are
provided:
• Twenty-four hour Crisis Line
• Safe, Confidential shelter
• Individual Crisis Counseling
• Support Groups
• Direct services provided to children while in the shelter
• Court advocacy and accompaniment
• Training on issues relating to domestic violence
• Speakers Bureau
• Elementary School Programs
• Dating Violence Date Rape Program
While the Lighthouse is excited to be in the position to offer these needed services for the residents of
Baldwin County. The Lighthouse needs the support to continue to provide these and other services.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE,
ALABAMA, that Mayor Kant is hereby authorized to execute a Contractual Agreement between the City
of Fairhope and The Lighthouse, Baldwin County Family Violence Project, to support the Lighthouse
domestic violence program and sexual assault program, in the amount of $3,500.00.

Councilmember Quinn moved to grant the request of Alabama Sports Festival XX
permission to use Fairhope Pier parking area for their start and finish area for their Metric
Century and Fun Bicycle Torch Ride. The ride will take place Sunday, June 23, 2002,
from 6:00 a.m. to 2:00 p.m. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Gentle, Street Committee Chairperson, reported on the request of
William Farnell, requesting the installation of two speed humps on Rosa Avenue.
Councilmember Gentle reported that the Police Department's data report for a 48 hour
period indicated a total of 181 vehicles with 25% speeding. Mayor Kant expressed that
he did not want to set a precedence of having all the citizens in that area request speed
bumps. Councilmember Anders requested that we have the police to radar the area and
issue tickets in an effort to get the attention of the speeders. Councilmember Gentle
moved to install a temporary speed hump for a two month period and requested that the
police patrol the area. Seconded by Councilmember Anders, motion passed
unanimously.
Councilmember Gentle, Street Committee Chairperson, reported on the request of
Michael and Nancy May requesting help with calming the traffic on lower Fels Avenue,
and requesting that non -local delivery trucks be re-routed away from Fels Avenue.
Councilmember Gentle reported that the Police Department's data report for a 48 hour
period indicated a total of 1,631 vehicles with 52% speeding in a 30 mph speed zone.
With the recommendation of Lieutenant Christopher Browning, Councilmember Gentle
moved to reduce the speed limit from 30 mph to 25 mph, install a 4-way at Bayview
Avenue and Fels Avenue, change the flashing light from amber to red, and have the
police patrol the area. Seconded by Councilmember Anders, motion passed
unanimously.

Councilmember Gentle moved to accept the low bid of Combatel Distribution,
Inc., Birmingham, Alabama, for repairs to line truck for the Electric Department in the
amount of $12,400.00, provided all specifications are met. Seconded by Councilmember
Ford, motion passed unanimously.
Councilmember Anders moved to accept the state bid of Ben Atkinson Motors,
Inc., Tallassee, Alabama, for a car for the Gas Department, in the amount of $19,884.07,
provided all specifications are met. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Gentle moved to accept the state bid of Woody Anderson Ford,
Huntsville, Alabama, for three police cars for the Police Department in the amount of
$59,952.00, provided all specifications are met. Seconded by Councilmember
Christenberry, motion passed unanimously.
Councilmember Anders moved to reschedule the March 11 `h regular City Council
meeting to Thursday, March 14, 2002, due to the National League of Cities meeting.
Seconded by Councilmember Gentle, motion passed unanimously.
Mayor Kant announced that the State of the City Address will be held Sunday,
March 3, 2002, at 2:00 p.m., at the Fairhope Civic Center.
There being no further business to come before the City Council, the meeting was
duly adjourned at 5:58 p.m.
