COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Wednesday, 13 February 2002.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Pastor Jackson, Pastor of Redeemer Lutheran
Church, gave the invocation. Councilmember Gentle moved to approve minutes of
the 31 January 2002, regular meeting. Seconded by Councilmember Quinn, motion
passed unanimously.
Councilmember Ford introduced in writing, and moved for the adoption of the
following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.

WHEREAS, Mayor Kant has received another counter offer on the purchase
of the Fuel Oil Supply property located at 560 South Section Street, for a city facility.
WHEREAS, the counter offer purchase price is $230,000.00. The purchase
amount will be financed by the owners for a term of ten (10) years. An initial first
year payment in the amount of $35,000.00 to be due at the time of closing with eight
annual payments in the amount of $29,000.00. The final payment of $23,000
including principal and interest to follow. A $5,000.00 earnest money deposit is to be
provided at the time this agreement is placed in contract form and will be applied to
the purchase price held by REMAX Real Estate Partners Eastern Shore.
WHEREAS, the seller will convey the property by Warranty Deed, provide an
Owner's Policy of Title Insurance in the amount of the purchase price, provide a new
Boundary Survey and Termite Inspection. Seller will provide a current
Environmental Site Assessment and reserves the right to correct any negative findings
or, by mutual agreement between parties, renegotiate and cancel this agreement.
WHEREAS, the seller will warrant that the heating and cooling system and
the plumbing and electrical systems to be in working order at the time of conveyance.
Purchaser will accept the building in its current condition with the understanding that
the owner will remove all existing inventory and equipment.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby
authorized to purchase the Fuel Oil Supply property located at 560 South
Section Street, under the said terms. This property includes a 7,200 square feet
building and the lot is 230 x 414 x 188 x 400 which contains approximately
1.93 acres more or less.

Councilmember Gentle moved to approve the change order request # 1, by
Southern Sash Supply, Montgomery, Alabama, increasing the contract by $29,917.00,
for the Fairhope Justice Center Detention Equipment, by providing bedding,
mattresses, mirrors with back plates, shelves power coat with hooks, eight man picnic
tables, and six compartment pistol lockers. Seconded by Councilmember Anders,
motion passed unanimously.
Councilmember Anders moved to grant permission Theatre 98 to sublease the
theater building to Diane Elam for acting classes. Pending the amendment of the
current lease and pending liability insurance is provided. Seconded by
Councilmember Quinn, motion passed unanimously.
Michael and Nancy May addressed the City Council requesting help with
calming the traffic on lower Fels Avenue, and requesting that non -local delivery
trucks be re-routed away from Fels Avenue. Mayor Kant assigned this request to the
Street Committee where Councilmember Gentle is Chairperson. The Street
Committee will conduct a study on Fels Avenue and report back to the City Council
at the next regular City Council meeting.
Bob Mallory addressed the City Council on behalf of Ed Graham. Mr.
Mallory stated that Spring Run Place has major problems with water each time it
rains. The worst part is on the North end where the houses were not elevated
properly thereby not allowing the landscaping to let the rainwater fall to the street.
Mr. Mallory requested that the City issue an injunction stating that there will be no
more building permits granted in Spring Run Place until the developer has followed
or paid for the accomplishment of the city engineering study and plan to clear the
water problem at the North end of the development.
Mayor Kant stated that he would request the original engineer's study, and
would have to speak with the City Attorney on legal ramifications of placing an
injunction on building permits in Spring Run Place until the water problem was
resolved.

It is recommended to accept the low bid of Jubilee Music, Fairhope, AL at the price of $8,597.00. All specifications have been
met. Working of having the delivery time moved up.

Councilmember Christenberry moved to accept the low bid of Jubilee Music,
Fairhope, Alabama, provided all specifications are met. Seconded by
Councilmember Anders, motion passed unanimously.
Mayor Kant made the following announcements:
• Arbor Day Celebration would be held Tuesday, February 19, 2002, at Faulkner State
Community College, Fairhope location. This will be a week celebration.
• Congressmen Sonny Callahan has secured a IMillion Dollar Grant for trails and sidewalks.
Sidewalks will be installed and/or connected in 16 areas.
• Historical Preservation Ordinance — The City Council will work on an ordinance for Fairhope.
This ordinance would benefit everybody.
Councilmember Gentle moved to pay bills excluding Holland Industrial,
Invoice number 350101, in the amount of $13,418.53. Seconded by Councilmember
Ford, motion passed unanimously.
There being no further business to come before the Ci Council the meeting
was duly adjourned at 6:11 p.m.
