HomeMy WebLinkAbout12-20-2001 Regular Meeting2797 STATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Thursday, 20 December 2001. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Father Mark Wilson, Pastor of St. James Episcopal Church, gave the invocation. Councilmember Gentle moved to approve minutes of the 10 December 2001, regular meeting. Seconded by Councilmember Quinn, motion passed unanimously. Ed D. Wilson, a member of the Alabama Committee for Employers Support of the Guard and Reserve (ESGR), presented Mayor Kant with a plaque thanking him and the Council for meritorious leadership and initiative in support of the men and women who serve America in the National Guard and Reserve. Councilmember Anders moved for final adoption of Ordinance No. 1139. An Ordinance to re -zone Khim Vira's property from R2 Medium Density Single Family Residential District to B-3A Tourist Resort Lodging District. This property is located adjacent to Baron's Inn, and fronting on Laurel Street. Seconded by Councilmember Gentle. Councilmember Christenberry and Councilmember Quinn expressed concerns with future owners wanting to rezone their property, and expressed concerns with commercial property invading residential neighborhoods. Councilmember Ford stated that the City Council must keep in mind that nothing goes beyond multi- family at Satsuma Street. After further discussion, Ordinance No. 1139 passed by the following votes: AYE -Gentle, Ford, Kant, and Anders. NAY -Quinn, and Christenberry. Councilmember Anders moved for final adoption of Ordinance No. 1140. An Ordinance to establish an Airport Noise Zoning District. Seconded by Councilmember Gentle. Councilmember Ford expressed concerns with the wording of Article 7-4 (Certification — Noise Attenuation capability of a proposed noise sensitive structure shall be certified on the building plans by a registered architect, engineer, or acoustician). 2798 20 December 2001 Councilmember Ford would like for the wording to be revised to reflect the recommendation of Peter M. Green, AICP Environmental /Aviation Planner with Barge Waggoner Summer & Cannon, Inc. (An architect and engineer must review the plans to determine if the building design complies substantially with the intent of the ordinance). After further discussion, the motion for final adoption, and to revise Article 7-4 to read as recommended passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Anders introduced in writing Ordinance No. 1141. An Ordinance to amend Ordinance No. 544, Business License Ordinance. Due to the City's population increase according to the new census, the City of Fairhope may now increase the flat fee for insurance companies other than fire and marine insurance companies. The current flat fee is $15.00. This fee will increase to $20.00 effective January 1, 2002. In order to take immediate action, Councilmember Anders moved for immediate consideration. Seconded by Councilmember Quinn, motion for immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Christenberry then moved for final adoption of Ordinance No. 1141. Seconded by Councilmember Gentle, motion for final adoption passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders and Christenberry. NAY - none. City Council reviewed an application for a Special Retail License — more than 30 days by Robert Baumhower, dba Mangos on the Point (Gulf Coast Food Co., LLC), located at 6832 Marlow Road, Point Clear, Alabama. Councilmember Anders moved to approve the issuance of the license. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Ford addressed the City Council to further discuss Resolution No. 804-01, National Register of Historic Places Survey. Councilmember Ford explained that the resolution passed the last meeting only authorized the survey. The resolution does not allow for any other action. Councilmember Ford continued with sharing information on tax dollars received by the City within the CBD (Central Business District) excluding businesses located on the West side of Church Street and East side of Bancroft Street. The City received last year $94,647.60 from the businesses located within the CBD. If businesses become a Historic Site, these businesses would receive a 50% tax break. The City would lose $47,323.80. The information given at the last City Council meeting indicated that the City would not lose any money, but the Federal Government would receive 20% less tax dollars. According to the research by Councilmember Ford, the Federal Government would not be out of any money because the Federal Government does not receive any portion of ad valorem taxes. 2799 20 December 2001 However the City would be out 50% of the dollars received by the businesses ad valorem tax. Councilmember Ford and Mayor Kant expressed that Councilmembers, Committee members, and Employees need to be careful when reporting information, because the City Council base their decisions on information reported to them. Councilmember Christenberry moved to grant the request of Eastern Shore Art Center Grand Festival of Art Committee, requesting permission to use the Pier Park for the weekend of October 19 & 20, 2002. The show will be Saturday and Sunday from 10:00 until 5:00 each day. Seconded by Councilmember Anders, motion passed unanimously. Councilmember Christenberry moved to grant the request of the Mardi Gras MGs, requesting permission to display their British cars on the grass area at the Northeast corner of Bancroft and Fairhope Avenue during the annual Arts and Craft Festival in March of 2002. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Anders moved to grant the request of Children of the World, requesting permission to use the Fairhoper's Community Park on Saturday, April 27, 2002, to host their Annual Family Fun Day. This event will be opened to the public. Seconded by Councilmember Christenberry, motion passed unanimously.
