HomeMy WebLinkAbout11-13-2001 Regular Meeting2759 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 13 November 2001. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and Acting City Clerk Betty E. Rivenbark. City Clerk Geniece W. Johnson was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Lieutenant Colonel George Lasett gave the invocation. Councilmember Gentle moved to approve minutes of the 22 October 2001, regular meeting. Seconded by Councilmember Anders, motion passed unanimously. Christopher Baker addressed the City Council telling of the competition and the judging done at Fairhope Middle School by himself and the Planning Commission members for World Town Planning Day. Mayor Kant recognized the first place overall winners: Nina Oakley -Doran and Brittany Starnes. Mr. Baker stated that the three winning towns were displayed in the lobby. Lieutenant Christopher Browning was also recognized as he was one of five nominees for the first annual Golden Shield Award that was presented by the Alabama Coalition Against Rape in October. Assistant Chief of Police James Kinard spoke saying that Chris Browning had joined the force in 1991 as a dispatcher and worked himself up to Police Officer in 1994, and then served as Special Services Utility Person, and then became Chief Investigator in May 2000. Lieutenant Browning spoke and told of the program and his involvement in this program, and the good that it does for the community. City Council considered the Final Adoption to Amend Zoning Ordinance 557. An Ordinance to re -zone Dr. Barry Booth's property from R-1 Low Density Single Family Residential to B4-Business and Professional Offices, the property located on the Northwest side of US Highway 98 and Parker Road. A Public Hearing was held on September 24, 2001. Councilmember Anders moved to un-table this item. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Anders further stated that public notices had not been given to the neighbors as promised before the meeting tonight. Councilmember Anders moved to carry this over until the next regular council meeting, which will be held on November 26, 2001, in order to send the courtesy letter promised. Seconded by Councilmember Quinn, motion passed unanimously. 2760 13 November 2001 Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Ford, motion passed unanimously. RESOLUTION NO. 797-01 WHEREAS, The Alabama Gulf Coast Chapter, American Red Cross enters into a contractual agreement with the City of Fairhope to provide services through the Disaster Specialist in Baldwin County. Services are as Follows: (1) Education for volunteers who want to do disaster work for American Red Cross, such as manning evacuation shelters, responding to single family disasters and multiple family disaster, i.e., apartment fires, tornado damage. (2) Educational programs for groups in order to apprise them of Red Cross Disaster Services and Disaster Preparedness. (3) Response to Baldwin County disaster and calling out volunteers to help with disasters as needed, twenty-four hours a day. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that Mayor Kant is hereby authorized to pay the sum of $1,000.00 toward the funding of Disaster Services through the Baldwin County Disaster Specialist for fiscal year 2001-2002. RESOLUTION NO. 798-01 BE IT RESOLVED that Mayor Timothy M. Kant is hereby authorized to execute a contract between the CITY and THOMPSON ENGINEERING to provide Engineering and Construction Services for the City's 200 ft Self -Support Tower. Johnson, Cit er 2761 13 November 2001 A Public Hearing was held as advertised on the request for a Club Liquor License by Jeffrey L. Dubois, dba The Barn, located at 9115 Hwy 98, Fairhope, Alabama. Councilmember Gentle moved to approve the issuance of the license. Seconded by Councilmember Quinn, motion passed unanimously. City Council reviewed an application for a Beer/Wine Off Premises License by Jason C. Cox, dba Jayco Inc., located at 22772 Hwy 98, Fairhope, Alabama. Councilmember Ford moved to approve issuance of the license. Seconded by Councilmember Gentle, motion passed unanimously. City Council reviewed an application for a Restaurant Liquor License by Doughty Vamedoe, dba Restaurant Vamedoe, LLC, located at 14 South Church Street, Fairhope, Alabama. Councilmember Gentle moved to approve issuance of the license. Seconded by Councilmember Quinn, motion passed unanimously. City Council considered a request by the Eastern Shore Optimist Club, requesting permission to use the corner of Magnolia Avenue and Bancroft Street (behind the Nut Plant) for their 29tn Annual Fundraising Christmas Tree Sale. Councilmember Quinn moved to approve this request. Seconded by Councilmember Anders, motion passed unanimously. City Council heard a request from the Downtown Fairhope Retail Merchants Association to change the sign ordinance to allow directional post signs on the corners of downtown streets. Dana Angelo, Kathleen Galloway and Spencer Johnson who have businesses off the main streets spoke to the council asking for these signs. Following a lengthy discussion, Mayor Kant indicated that this was not a favorable project but appointed the following Councilmembers to further look into this request: Bob Gentle, Pauline Anders, and Debbie Quinn. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Ford moved to address items not on the printed agenda. Seconded by Councilmember Gentle, motion passed unanimously. Mayor Kant said we needed to do a change order on the sidewalk project for Greeno Road stating that we needed to build a bridge 30-40 feet long , 8 feet wide between Pizza Hut and Sonic Restaurants, and it has to met DOT standards at a cost of $6,760.00. Councilmember Gentle moved to grant change order request # 1 by Sunset Contracting Inc., increasing the contract by $6,760.00 to install said bridge. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Quinn moved to pay bills as presented. Seconded by Councilmember Gentle, motion passed unanimously. 2764 13 November 2001 Steve Seay spoke thanking the Mayor and Council for their support on behalf of the employees in the National Guard. He said that the City has always treated them real good when they had to go to camp and they appreciate it. Mayor Kant mentioned the seminar for erosion control that Eric Cortinas put on for the City departments, builders, and developers. He said it was well attended and we had participants in the hotels and businesses in town. Dot Yeager asked the Mayor if the Council was still seeking written comments on the Environmental Ordinance even though it is not being considered. Mayor Kant said yes, it would be good to get comments from the individuals. Curtis Gordon asked what we could do to promote Fairhope and its downtown businesses. Mayor Kant said we are promoting with video, Grand Hotel and brochures but we need to put heads together and see what we come up with. The Tree Lighting on Thursday night and the Christmas Parade on December 7`h were mentioned. I enbark, Acting City Clerk 2765 NOTICE AND CALL OF SPECIAL MEETING Notice is hereby given of a special meeting of the City Council of the City of Fairhope, Alabama, to be held at the Fairhope Municipal Complex on Monday, 19 November 2001, at 5:30 p.m., for the purpose of a Public Hearing — Request to rezone property owned by the Dyas Family, from R1-Low Density Single Family Residential and R4-Low Density Multi Family Residential to Planned Unit Development (PUD). This property is located at the intersection of North Section Street and U.S. Hwy 98, the property is known as Village North, aka The Triangle. thy M.
