The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 22 October 2001.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Gemece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Councilmember Cecil Christenberry gave the
invocation. Councilmember Quinn moved to approve minutes of the 08 October
2001, regular meeting. Seconded by Councilmember Gentle, motion passed
unanimously.
Councilmember Anders moved to proclaim 08 November 2001, as World
Planning Day. Seconded by Councilmember Gentle, motion passed unanimously.
Christopher Baker explained that Fairhope Middle School students would make 3-D
models of a little city. Members of the Planning and Zoning Commission will judge
the models. The winners will ride on the City's fire truck during the Christmas
Parade.

PROCLAMATION

Whereas, November 81h, of each year has been celebrated as World Town Planning
Day; and,
Whereas, November 81h of each year has been celebrated as World Town Planning
Day in many countries since its inception in 1949; and,
Whereas, The American Institute of Certified Planners (AICP) acting for the 14, 000
members of the planning profession in American, a component of the 30,000
members American Planning Association, endorses World Town Planning Day as an
opportunity to highlight the contributions sound planning makes to the quality of our
settlements and environment and to celebrate American accomplishments in making
collective decisions concerning our cities and regions that being quality meaning to
our lives; and,
Whereas, the celebration of World Town Planning Day gives us the opportunity to
publicly recognize the participation and dedication of the members of planning
commissions and other citizen planners who have contributed their time and expertise
to the improvement of the City of Fairhope; and,
Whereas, We recognize the many valuable contributions made by professional
community and regional planners of the City of Fairhope of Fairhope, Alabama and
extend our heartfelt thanks for the continued commitment to public services;
NOW, THEREFORE, BE IT RESOLVED THAT, November 8, 2001 is hereby
designated as COMMUNITY AND REGIONAL PLANNING DAY. In the City of
Fairhope of Fairhope, Alabama in conjunction with the worldwide celebration of
World Town Planning Day.

Councilmember Gentle introduced in writing Ordinance No. 1135. An
Ordinance to annex Edward N. Agee's property, located at 7844 Perryman Place,
Fairhope, Alabama, .34 acres more or less. In order to take immediate action,
Councilmember Quinn moved for immediate consideration. Seconded by
Councilmember Gentle, motion for immediate consideration passed unanimously by
the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry.
NAY -none. Councilmember Gentle then moved for final adoption of Ordinance No.
1135. Seconded by Councilmember Christenberry, motion for final adoption passed
unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders and
Christenberry. NAY -none.
Councilmember Quinn introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.
RESOLUTION No. 792-01
WHEREAS, on July 9, 2001, the City Council of the City of Fairhope adopted Ordinance number
1129, to exercise the power to issue building permits within the City of Fairhope police jurisdiction
effective October 1, 2001. In accordance with the Alabama Supreme Court decision in Robertsdale vs.
Baldwin County,
WHEREAS, in order to comply with Baldwin County regulations regarding Baldwin County Zoning
Districts 16 and 26, the Baldwin County Historic Preservation District, Flood Zones as determined by
the Federal Emergency Management Agency (FEMA) National Flood Insurance Program (NFIP), and
any other applicable requirements for these areas as set forth by the governing body of Baldwin
County and it's appointed committees,
NOW THEREFORE, be it resolved that the City of Fairhope, Alabama will work in concert and
coordination with the Baldwin County Commission to verify compliance with any zoning, flood zone
administration, historical preservation, or any other applicable regulations adopted the Baldwin County
Commission within the City of Fairhope police jurisdiction.
EFFECTIVE DATE. This Ordinance shall take effect upon its due adoption and publication by law.

Councilmember Anders introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.
RESOLUTION NO.793.01
BE IT RESOLVED that Mayor Timothy M. Kant is hereby authorized to negotiate
with a company to provide Professional Services for collecting Global Positioning
System Data (GPS) to upgrade the City `s Mapping System.

RESOLUTION NO. 794-01
BE IT RESOLVED that Mayor Timothy M. Kant is hereby authorized to execute a
contract between the CITY and Walcott Adams Verneuille to provide Plans for the
City of Fairhope Facilities.

RESOLUTION NO. 795-01
BE IT RESOLVED that Mayor Timothy M. Kant is hereby authorized to execute a
contract between the CITY and MOORE ENGINEERING COMPANY to provide
Engineering services for a 750 GPM well, and other related treatment facilities
Project No. 0986-036 (Well # 9) and a 750 GPM well treatment facility Upgrade
Project No. 0986-037 (Well # 2).
Adopted This 22nd Day of October , 2001.

Councilmember Anders moved to grant Denise Lores' request to extend a
balcony from a second floor addition at 408 Fairhope Avenue. Mr. Baker explained
that the balcony would be 8ft by 13 ft and will extended onto the sidewalk. The
balcony will not disturb the trees or the pavers along the sidewalk. Seconded by
Councilmember Christenberry, motion passed unanimously.
Councilmember Gentle moved to grant the request of Children of the World
requesting permission to host a traditional Chinese Parade through the streets of
Fairhope, on 16`h February 2002, at 2:00 p.m. Seconded by Councilmember Anders,
motion passed unanimously.
Councilmember Gentle moved to grant the request of the Club of Rock Creek,
requesting permission to host their ls` Annual Fall Harvest Run, on Saturday,
November 101h at 9:15 a.m. The run will take place in the subdivision of Rock Creek.
The run must be coordinated with the Police Department. Seconded by
Councilmember Quinn, motion passed unanimously.
Sonny Brewer and Karin Wilson, with Fairhope Center for the Writing Art's
Literary Program, addressed the City Council requesting permission to block off De
la Mare Avenue at its East and West ends to vehicular traffic on Sunday, 18
November 2001, during the hours of the Christmas Open House, for book signing of
10 authors. A petition of all the neighbors on De la Mare was received.
Councilmember Quinn moved to grant the request. Seconded by Councilmember
Anders, motion passed unanimously.
The City Council received a request from Donna Bekiaris, Director of
Marietta Johnson School of Organic Education, requesting several No Parking signs
to be posted along the roadside on Marietta Drive (Pecan Street). Ms. Bekiaris
explained in the request that on October 91h two cars pulled over and parked along the
road on Marietta Drive (Pecan Street). One of the passengers got out of the car and
used abusive and threatening language to the children on the playground at the
Marietta Johnson School of Organic Education. Ms. Bekiaris is concerned about their
safety, especially in light of the recent terrorist incident.
Mayor Kant asked Lt. Christopher Browning to addressed the City Council to
give the Police Department's recommendations regarding Ms. Dekiaris' request. Lt.
Browning recommended placing No Parking signs along the road side on Marietta
Drive (Pecan Street), and recommends taking this opportunity to look into the safety
of all schools regarding abandon vehicles. After discussion, Councilmember Anders
moved to grant the recommendations of Lt. Browning. Seconded by Councilmember
Gentle, motion passed unanimously.

Vince Valentim addressed the City Council requesting that the City do not
issue permits within the extra territorial jurisdiction. Mr. Valentim explained that his
son owns property in the ETJ, and he is not happy with the way the development
adjoining his son's property has been handled by the County. After a lengthy
discussion Mayor Kant explained that Mr. Valentim's concerns comes under the
Planning and Zoning Commission, and Mayor Kant will ask the Commission to look
into this issue.
Jennifer Fidler, Public Works Director, addressed the City Council on placing
Alabama Coastal Birding Trail Signs at the Fairhope Municipal Pier and Beach
(Came before the City Council September 12 & 24, 2001). Ms. Fidler recommended
installing two (2) signs. (1) A Site Identification Sign at the Northwest area at the
booth entering the "Duck Pond" area, size of the sign 15 X 24 and (2) A sign at the
North end of the "Duck Pond" area identifying what kind of birds can be seen in this
area, size of the sign 36 X 48. Councilmember Gentle moved to grant the
recommendation of Ms. Fidler. Seconded by Councilmember Christenberry, motion
passed unanimously.
Councilmember Gentle, Street Committee Chairperson, reported on the
request of Shelly Jenkins, requesting a 4-way stop at the intersection of Middle Street
and Ingleside Avenue. Councilmember Gentle reported that the Police Department
study shows that some drivers traveling on Ingleside Avenue in this area are traveling
in excessive speeds of 15 mph above the posted speed limit. Councilmember Gentle
recommended and moved to install a 4-way stop at this intersection. Seconded by
Councilmember Ford, motion passed unanimously.
Councilmember Christenberry moved to reschedule the next regular City
Council meeting to Tuesday, 13 November 2001, due to Veterans' Day Holiday.
Seconded by Councilmember Quinn, motion passed unanimously.
There being no further business to come before the City Council the meeting
was duly adjourned at 6:29 p.m.
