COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
5:30 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 24 September 2001.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and Purchasing Agent, Wayne Smith, gave the
invocation. Councilmember Quinn moved to approve minutes of the 12 September
2001, regular meeting. Seconded by Councilmember Gentle, motion passed
unanimously.
Sergeant Christopher Browning presented Officer Craig Sawyer with the
American Police Hall of Fame Purple Heart. Officer Sawyer received this honor due
to being seriously injured in the line of duty while working with two other officers on
a domestic violenance call on 25 November 2000. Officer Sawyer later suffered a
stroke due to his injuries. Mayor Kant and Mrs. Sawyer were asked to pin the Purple
Heart ribbon on Officer Sawyer. After the presentation Officer Sawyer received a
standing ovation. Mayor Kant stated that we are fortunate to have Officer Sawyer,
and that Officer Sawyer's skills will continually be used by the City of Fairhope.
No one from the South Alabama Regional Planning Commission was present
to present the findings of the Baldwin County Public Transit Coalition.
A Public Hearing was held as advertised on a proposed ordinance to amend
the Zoning Ordinance No. 557. Councilmember Anders introduced in writing an
ordinance to re -zone Dr. Barry Booth's property from RI -Low Density Single Family
Residential to B4-Business and Professional Offices. The property is located on the
North West side of U.S. 98 and Parker Road. Christopher Baker, Planning and
Building Officer, explained that he recommended to the Planning and Zoning
Commission to deny the application because the Trentino access makes a logical
"line" for commercial development and because it protects the integrity not only for
Sibley Square but also for Trentino, and that this request does not fit the
Comprehensive Plan. Mr. Baker further explained that this request came before the
Planning and Zoning Commission on 6 August 2001, and passed with a vote of four
to three in favor of the zoning change.
Mayor Kant opened the floor to hear comments from the citizens:

Jack Burrell, a resident of Fly Creek, addressed the City Council opposing to
the zoning of this property. He asked that the City be given something concrete as to
what is going to be placed on this property.
Richard Lund, a resident of Sibley Square, addressed the City Council also
opposed to the zoning change. Mr. Lund expressed that he understood that the
previous Government promised Dr. Booth that he could re -zone his property at a later
date if Dr. Booth annexed his property into the City as R-1. Mr. Lund expressed that
the property should not be re -zoned on secret promises for secret promises are
unethical. Mr. Lund also expressed that if doctor's offices were placed on this
property than there would be a concern with traffic.
Steve Dampier, a resident of Sibley Square, addressed the City Council
opposing to the re -zoning of Dr. Booth's property. Mr. Dampier reiterated that the
line of demarcation should be the access road to Trentino.
Councilmember Ford and Councilmember Gentle questioned the location and
property line to Dr. Booth's property and Trentino. Mr. Baker tried to point out the
boundaries of the properties in question. After discussion, Councilmember Gentle
moved to table this request until the Council was able to look at the whole issue
including Trentino. Seconded by Councilmember Christenberry, motion to table
passed unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant,
Anders, and Christenberry. NAY -none.
Councilmember Gentle introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Christenberry, motion passed
unanimously.
RESOLUTION NO. 789-01.
WHEREAS, Ms. Debra Lockard has addressed the Planning and Building Department and requested
to name an unnamed Public Alleyway running behind the Elks Club from Pecan Street and Laurel
Street.
WHEREAS, the Planning and Building Department has investigated with 911 if the proposed name is
been used in and around the City of Fairhope.
NOW THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE ALABAMA, that the Public way heretofore unnamed shall henceforth be known as " Bay
Breeze Lane."

Councilmember Quinn moved to grant the request of the Fairhope High
Student Council Association permission to hold a Homecoming parade through the
streets of Fairhope on Thursday, 4 October 2001 at 5:15 p.m. Seconded by
Councilmember Anders. Councilmember Quinn amended her motion to include
permission to have a barn fire. Seconded by Councilmember Gentle, motion passed
unanimously.
Mayor Kant assigned to the Street Committee the request from Shelly Jenkins
requesting a 4-way stop at the intersection of Middle Street and Ingleside Avenue.
Chair Person of the Street Committee, Councilmember Gentle, stated that the Police
Department will conduct a study on this intersection, and the Street Committee will
report back at the next regular City Council meeting.
Mayor Kant assigned to the Street Committee the request from John and
Audrey Stmad, requesting one or two speed bumps on Cottage Drive. Chair person of
the Street Committee, Councilmember Gentle, stated that a petition from Cottage
Drive was received and the Police Department will conduct a study on this
intersection, and the Street Committee will report back at the next regular City
Council meeting.

Councilmember Quinn moved to accept the low bid of Leon Pitts
Construction, Brewton, Alabama, provided all specifications are met. Seconded by
Councilmember Gentle, motion passed unanimously.
Vickie Watterson, Principal of Fairhope K-1 School, addressed the City
Council announcing and encouraging everyone to participate in the "Walk Your
Child to School Day", on Tuesday 2 October 2001 at 7:00 a.m. The project allows
parents and students an opportunity to report needed safety items for the area. Several
improvements are being made throughout the City due to last year reports.
A citizen addressed the City Council to express that the traffic circle at Fig
Street and Liberty Street is not working. The citizen stated that drivers are literally
trying to see how fast they can drive around the traffic circle. She requested a 4-way
stop be installed instead of the traffic circle.
Councilmember Anders moved to hear Emily Severson with Daphne
Ecological Services Field Office. Seconded by Councilmember Quinn, motion
passed unanimously. Ms. Severson inquired about the City Council's decision on
placing Alabama Coastal Birding Trail Signs at the Fairhope Municipal Pier and
Beach. After a brief discussion, Councilmember Gentle stated that the City Council
should wait until a full report was received before making a decision, as stated at the
last City Council meeting.
Spencer Johnson with the Downtown Merchant's Association announced that
the Downtown Merchants have collected $1,140.00 in donations for the victims of the
September 11`h, terrorist attack in New York and at the Pentagon. Mr. Johnson
requested that the City match the donations of the Downtown Merchants. Mayor
Kant turned this request over to the Finance Committee.
Councilmember Anders reminded everyone that the Fire Department needed
an image camera, and asked for support with purchasing this camera.
There being no further business to come before the City Council the
meeting was duly adjourned at 6:38 p.m.
