HomeMy WebLinkAbout08-27-2001 Regular Meeting2728 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 27 August 2001. Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle, Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. No one was absent. There being a quorum present, Mayor Kant called the meeting to order. The Pledge of Allegiance was recited, and Cecil Christenberry, Councilmember, gave the invocation. Councilmember Quinn moved to approve minutes of the 13 August 2001, regular meeting. Seconded by Councilmember Gentle, motion passed unanimously. Tom Ellis, Chairman of the Fairhope Tree Commission, presented Treasure Tree Awards to the following twelve reciprocates. Seconded by Councilmember Gentle, motion passed unanimously. Resolution No. 784-01 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, BALDWIN COUNTY, ALABAMA that Mayor Timothy M. Kant is hereby authorized to amend the Working of Budget FY 2000-2001. Councilmember Christenberry inquired about the final decision on the location of the Storage Tank. Mayor Kant stated that the final decision on the storage tank's location will come before the City Council, and a public hearing will be held on the Site Plan Review. After further discussion the motion passed unanimously. Resolution No. 785-01 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, BALDWIN COUNTY, ALABAMA that Mayor Timothy M. Kant is hereby authorized to negotiate an agreement on a land lease for the Water Storage Tank at Gulf Coast Research and Extension Center. Seconded by Councilmember Gentle. The City and the Writing Arts Inc. Board agreed that in the event the building needed to be moved the Writing Arts Inc. Board would work with the City. After further discussion the, motion passed unanimously. Resolution No. 786-01 WHEREAS, the Fairhope Center for the Writing Arts Inc Board is interested in leasing the cottage located at 9 North School Street (Nut Processing Property; and, WHEREAS, the annual rent shall be one dollar ($1.00); and, WHEREAS, the term of the lease shall be for 25 years; and, WHEREAS, the members and board of directors promises to provide the funding necessary to renovate and repair the building and also promises to incur the expense of regular maintenance and upkeep in conformance to all city buildings codes and ordinances. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, BALDWIN COUNTY, ALABAMA that Mayor Timothy M. Kant is hereby authorized to enter into a lease agreement between the City of Fairhope and Fairhope Center for the Writing Arts Inc., to lease the cottage located at 9 North School Street (Nut Processing Property). Resolution No. 787-01 BE IT RESOLVED BY THE GOVENING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE ALABAMA that Mayor Timothy M. Kant is hereby authorized to accept the Commercial/Residential study completed by Market Research Inc., (MRI) on the feasibility of Broadband Telecommunication Services, and authorize Mayor Kant to retain Uptown Engineering Inc., to complete a Broadband Implementation cost analysis for City of Fairhope. Seconded by Councilmember Anders. Councilmember Ford expressed concerns as to why there are so many members on this committee, and asked that a limit be placed on how many members could attend annual convention, and that the limit should be placed in the committee's bylaws. Mayor Kant stated that expenditures must go through the Mayor, and that this committee does not have any authority unless given by the City Council. Johnson, Clerk 2733 27 August 2001 City Council reviewed an application for a Restaurant Liquor License by Yanfei Wang, dba China Wok, located at 400 Eastern Shore Shopping Center, Fairhope, Alabama. Councilmember Gentle moved to approve the issuance of the license. Seconded by Councilmember Quinn, motion passed unanimously. Councilmember Quinn moved to approve the charge -off of the following un-collectible accounts: 1. Un-collectible utility account — 1997-1998 - $79,324.09 2. Outstanding returned checks — 1986-1998 - $4,153.57 3. Un-collectible connections — 1989-1998 - $3,954.75. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Quinn moved to authorize the sale of Surplus Property. Seconded by Councilmember Anders, motion passed unanimously. One 3-year term appointment to the Strengthen our Community Committee to replace Ack Moore, Principal, Larry Newton School. Councilmember Anders nominated Trina Hankins, Boys' and Girls' Club Director. Councilmember Ford moved to appoint Mrs. Hankins. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Gentle moved to grant the request of the March of Dimes, to have their March of Dimes WalkAmerica 2001 on Sunday, 28 October 2001, beginning at 2:00 p.m., provided that this is okayed by the Police Department. Seconded by Councilmember Quinn, motion passed unanimously. Councilmember Quinn moved to grant the request of South Baldwin United Way to close off the East half of De La Mare Avenue for a fund-raising event being hosted by Lyons Share Custom Frame & Gallery on the evening of Saturday, 27 October 2001. This event must be over by 10:00 p.m. and okayed by the Police Department. Seconded by Councilmember Gentle, motion passed unanimously. Item number 14 and item number 15 on the printed agenda, (Request - Councilmember Ford, and Request - Councilmember Ford - Recreation Board) were withdrawn by Councilmember Ford. Councilmember Gentle moved to reschedule the next regular City Council meeting to Wednesday, September 12, 2001. Seconded by Councilmember Quinn, motion passed unanimously.
