HomeMy WebLinkAbout06-25-2001 Regular Meeting2691 STATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 5:30 p.m.; Fairhope Municipal Complex Council Chamber; 161 North Section Street, Fairhope, Alabama 36532; on Monday, 25 June 2001. Present were Mayor Pro -temp Debbie W. Quinn, Councilmembers: Robert C. Gentle, Michael A. Ford, Pauline Anders, and Cecil Christenberry; City Attorney Marion E. Wynne, and City Clerk Geniece W. Johnson. Mayor Timothy M. Kant was absent. There being a quorum present, Mayor Pro -Temp Quinn called the meeting to order. The Pledge of Allegiance was recited, and the invocation was given by Councilmember Christenberry. Councilmember Anders moved to approve minutes of the 11 June 2001, regular meeting. Seconded by Councilmember Christenberry, motion passed unanimously. Councilmember Anders introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Gentle, motion passed unanimously. RESOLUTION NO. 769-01 BE IT RESOLVED that Mayor Timothy M. Kant is hereby authorized to execute a contract between the City and Severn Trent Services (STL Mobile), Mobile, Alabama, to provide services for the NPDES Permit (No. ALS000002 Monitoring Requirements). The cost to complete this project will be $2,216.67. DULY ADOPTED THIS 251h DAY OF June , 2001. 4Tim M. ant Mayor Attest 6 / Geniece W. Johnso , City Clerk 2692 25 June 2001 Councilmember Gentle introduced in writing, and moved for the adoption of the following resolution. Seconded by Councilmember Ford, motion passed unanimously. Resolution No. 770-01 WHEREAS, the Owners of Fairfield Phase V desire to have all public streets and rights -of -way dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama on Slide 2047A, and all Fairhope utilities located in easements and in rights -of -ways accepted for maintenance by the City of Fairhope, Alabama, and; WHEREAS, the City of Fairhope, Alabama has received notice from the engineers of the project that the design and capacity of the public improvements have been designed in conformance with City requirements as indicated on the recorded plat, and; WHEREAS, the City of Fairhope, Alabama is not and in no manner will be responsible for the maintenance of common areas in the subdivision as indicated on the recorded plat, and; WHEREAS, the City of Fairhope, Alabama has received from the owners of Fairfield Phase V a maintenance bond for the public improvements constructed for a period of 2 years from the date of the approval of this Resolution, and; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the public improvements indicated herein for Fairfield Phase V are hereby accepted for public maintenance subject to the bond posted. Johnso , Ci y Clerk 2693 25 June 2001 Mr. and Mrs. Woodall with M & M Enterprises, addressed the City Council requesting permission to operate a hot dog cart business in the city limits of Fairhope, preferably at the Municipal Pier. After discussion, Councilmember Gentle moved to approve the operation of a hot dog cart at the Municipal Pier only, and if the Woodall's decided to operate their hot dot cart at another location they must come back before the City Council for approval. Seconded by Councilmember Christenberry, motion passed unanimously. Councilmember Ford moved to grant the request of the American Heart Association, requesting permission to hold their 8`h Annual American Heart Walk on Saturday, October 27, 2001. The 3-mile walk will begin at 8:00 a.m. at the Fairhope Pier. Seconded by Councilmember Gentle, motion passed unanimously. Councilmember Ford addressed the City Council requesting permission to transfer $10,000.00 from Recreation Capital Improvement Fund to the Recreation Operating Fund for pool repairs. Councilmember Anders moved to grant the request. Seconded by Councilmember Ford, motion passed unanimously. Councilmember Anders Chairperson of an assigned committee to look into the Baldwin County Home Builders Association's request. The Baldwin County Home Builders Association requested permission to put up directional signs for their Annual Parade of Homes, scheduled for August 11,12, 18, & 19, 2001. Councilmember Anders and her Committee reported and moved to allow directional signs to be used by the Baldwin County Home Builders Association, but the signs may only be put up on the Saturday morning of each weekend and taken down on Sunday. The Committee comprised of Councilmember Anders, Christenberry, and Ford did not see fit to amend the city ordinance at this time. Seconded by Councilmember Christenberry. The motion passed by the following votes: AYE -Gentle, Ford, Anders, Christenberry. Seconded by Councilmember Anders, motion passed unanimously. Seconded by Councilmember Anders, motion passed unanimously. 2695 25 June 2001 Vince Valentim addressed the City Council requesting that something be done about the private parties being held at Away at the Bay, located at 557 North Mobile Street ( owner Mr. Joe Gravlee). Mr. Valentim stated that this property was Grand Fathered in as an apartment complex. Mr. Valentim further stated that he had two letters from the City regarding Away at the Bay, and would provide a package to the City Council. Mayor Pro -temp Quinn asked that Mr. Valentim provide the package, and she would speak with Mr. Christopher Baker, Planning and Building Official, and Mayor Kant once they returned to the office. Mr. Hop Allen questioned if three buildings are put under one roof, does the Grand Father Clause still stand. Mayor Pro -temp stated that she would look into Mr. Allen's question.
