The City Council, City of Fairhope, met in regular session at
5:30 p.m.; Fairhope Municipal Complex Council Chamber;
161 North Section Street, Fairhope, Alabama 36532; on.
Tuesday. 29 Maw.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Pauline Anders, and Cecil Christenberry; City Attorney Marion E.
Wynne, and City Clerk Geniece W. Johnson. Councilmember Debbie W. Quinn was
absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and the invocation was given by the City Attorney
Marion E. Wynne. Mayor Kant asked the audiences to take a moment of silence for the
bereaved family. The Boyett's lost their son Christopher Boyett in a car accident on
Monday, 28 May 2001 at the intersection of Gayfer Road and County Road 13.
Councilmember Anders moved to approve minutes of the 14 May 2001, regular meeting.
Seconded by Councilmember Gentle, motion passed unanimously.
Councilmember Anders moved for final adoption of Ordinance No. 1124. An
ordinance to zone Fairhope Single Tax Corporation (Lease holders Klummp-Boone,
LLC), located at 10200 Gayfer Road Extension as R-6 Mobile Home Park District
concurrent with annexation. This ordinance was introduced at the last City Council
meeting, 14 May 2001. Seconded by Councilmember Christenberry. The City Council
was advised by the City Attorney that according to Section 19-11 does require all utility
services, which are built or connected after December 12, 1994, to be underground.
However, this section only applies to the corporate limits or to subdivisions subject to
Fairhope's planning jurisdiction. A mobile home park is not a subdivision, therefore the
subdivision regulations do not apply. The motion for final adoption passed unanimously
by the following votes: AYE -Gentle, Ford, Kant, Anders, and Christenberry. NAY -none.
Councilmember Gentle introduced in writing, and moved for the adoption of the
following resolution. Seconded by Councilmember Anders, motion passed unanimously.

RESOLUTION NO. 762-01
BE IT RESOLVED BY THE GOVERNING BODY OF THE

CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is
hereby authorized to execute a lease agreement between the CITY and
CATERPILLAR FINANCIAL SERVICES CORPORATION of
Nashville, TN, for the lease of a Caterpillar Backhoe Loader. The term of
the lease shall be for four (4) years at $8,658.60 each year.
Adopted this 29"' Day of Maw, 2001.

Councilmember Anders moved to establish an Environmental Advisory Board.
Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Anders introduced in writing, and moved for the adoption
of the following resolution. Seconded by Councilmember Gentle, motion passed
unanimously.

WHEREAS, the City of Fairhope recognizes the importance of good stewardship of its
environment and natural resources; and,
WHEREAS, the City seeks to encourage citizen input and involvement through the
formation of an advisory board dedicated to study and make recommendations on matters
relating to the environment; and,
WHEREAS, citizens of Fairhope have expressed an interest in serving the City as
volunteers in this endeavor.
BE IT THEREFORE RESOLVED, that the City form the City of Fairhope
Environmental Advisory Board (the "Board");
BE IT FURTHER RESOLVED, that the following citizens of Fairhope are appointed
to serve as members of the board:
Harry Phillips - Chair Person
Maria Gwynn
Garland Sims
Pete Wiese
Ron Heveran
Charlie Newcomer
Catherine Golden
BE IT FURTHER RESOLVED, that the following City Council Members are
appointed to serve as members of the board:
Cecil Christenberry
Debbie W. Quinn
BE IT FURTHER RESOLVED, that the By -Laws of the Board, be forwarded to the
City Attorney and approved by the City Council at a later date.

Mayor Kant requested that the By-laws for the Fairhope Environmental Advisory
Board be reviewed by the City Attorney, Marion E. Wynne, and approved by the City
Council at the next regular City Council meeting. Councilmember Anders moved to
grant the request. Seconded by Councilmember Gentle, motion passed unanimously.
Council reviewed an application for a Restaurant Liquor License by Thomas
(Tom) M. Pennington, dba The Hamlet, located at 214 Windsor Drive North, Fairhope,
Alabama. Councilmember Anders moved to approve the issuance of the license.
Seconded by Councilmember Gentle, motion passed unanimously.
The Eastern Shore Art Center requested permission to reserve parking for their
for their potential exhibitors' vans and RVs in the parking area North of the rose garden
circle during the fall art show, October 21, and 22, 2001, on the grounds South of the
Fairhope Municipal Pier, around the Tiki area. (Approved Art show February 12, 2001).
Councilmember Gentle moved to grant the request. Seconded by Councilmember
Anders, motion passed unanimously.
Councilmember Gentle moved to grant the request of Eastern Shore Chamber of
Commerce, requesting permission to reserve streets to hold their 50`h Annual Arts &
Crafts Festival, scheduled for March 15, 16, & 17, 2002. Seconded by Councilmember
Ford, motion passed unanimously.
Councilmember Gentle moved to grant the request of the Downtown Fairhope
Merchants Association, requesting permission to have a Sidewalk Sale, on July 6`h & 7`h,
2001, from 10:00 a.m. to 5:00 p.m. There will be approximately 71 merchants. The
following streets will be used Fairhope Avenue, Church Street, Section Street, and De La
Mare Avenue. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Christenberry moved to grant the request of the Volunteer Fire
Department, requesting permission to sell the 1978 Ford F-350 truck as surplus property.
Seconded by Councilmember Gentle, motion passed unanimously.
Councilmember Gentle, Street Committee Chair Person, motioned that Mayor
Kant write a letter to the County about placing some type of signal at Gayfer Road and
County Road 13. Seconded by Councilmember Anders, motion passed unanimously.
There being no further business to come before the City Council the meeting was
