The City Council, City of Fairhope, met in regular session at
5:30 p.m.; Fairhope Municipal Complex Council Chamber;
161 North Section Street, Fairhope, Alabama 36532; on
Monday. 13 November 2000.
Present were Mayor Timothy M. Kant, Councilmember: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry; City
Attorney Marion E. Wynne and City Clerk Geniece W. Johnson. No one was
absent.
There being a quorum present, Mayor Kant called the meeting to order.
Councilmember Quinn moved to approve minutes of the 23 October 2000, regular
meeting. Seconded by Councilmember Christenberry, motion passed
unanimously.
Councilmember Christenberry introduced Ordinance No. 1097 . An
Ordinance to amend the City Council Procedures. No one present was opposed to
the amendments. In order to take immediate action Councilmember Quinn moved
to suspend the rules. Seconded by Councilmember Anders, motion to suspend the
rules passed unanimously by the following vote: AYE -Gentle, Ford, Quinn, Kant,
Anders, and Christenberry. NAY -none. Councilmember Christenberry then
moved for final adoption of Ordinance No. 1097 . Seconded by Councilmember
Quinn, motion for final adoption passed unanimously by the following vote AYE -
Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none.
Councilmember Ford introduced Ordinance No. 1098 . An Ordinance
to change the Poll Hours of all Municipal Elections. No one present was opposed
to the amendments. In order to take immediate action Councilmember Quinn
moved to suspend the rules. Seconded by Councilmember Ford, motion to
suspend the rules passed unanimously by the following vote: AYE -Gentle, Ford,
Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Anders
then moved for final adoption of Ordinance No. 1098 . Seconded by
Councilmember Quinn, motion for final adoption passed unanimously by the
following vote: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry.
NAY -none.
Councilmember Gentle introduced in writing, and moved for the adoption
of the following resolution. Seconded by Councilmember Ford, motion passed
unanimously.

WHEREAS, the City of Fairhope, Alabama, is eligible to request financial assistance
from the Alabama Department of Economic and Community Affairs under the FY 2001
Recreational Trails Grant Program to develop walking/pedestrian trails with the City, and
WHEREAS, the City is hereby making known its intention to apply for said funds to help
undertake recreational improvement in designated area(s) throughout the City, and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
Fairhope, that:
The City of Fairhope make applications to the State of Alabama
Department of Economic and Community Affairs for FY 2001
Recreational Trails Grant funds not to exceed $50,000.00.
2. The City will provide matching funds in either cash or in -kind services to
construct said improvement in an amount of not less that 20% of the total
project costs.
Timothy M. Kant, in his capacity as Mayor of the City of Fairhope, is
hereby authorized to act as the appropriate City officer on behalf of the
City of Fairhope, in dealing with the State of Alabama and to sign any and
all necessary documents for the grant application.
4. Phillip Roth, of Roth, McHugh & Associates, LLC, will be authorized to
take all actions necessary to prepare the FY 2001 Recreational Trail
Program Grant application for submission on December 1, 2000.

Councilmember Anders introduced in writing, and moved for the adoption
of the following resolution. Seconded by Councilmember Ford, motion passed
unanimously.
Resolution No. 726-00
WHEREAS, the Owners of River Mill Phase 4 desire to have all public streets
and right-of-ways dedicated on the plat filed for record in the Probate Records of
Baldwin County, Alabama found on Slide 2024-F accepted for maintenance by
the City of Fairhope, Alabama, and;
WHEREAS, the City of Fairhope, Alabama accepts all public streets, and utilities
located in easements and right-of-ways, and;
WHEREAS, the City of Fairhope, Alabama has received notice from the
engineers of the project that the design and capacity of the public improvements
have been designed in conformance with City requirements as indicated on the
recorded plat, and;
WHEREAS, the City of Fairhope, Alabama is not and in no manner will be
responsible for the maintenance of common areas in the subdivision as indicated
on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama has received from the owners of
River Mill Phase 4 a maintenance bond for the public improvements constructed
for a period of 2 years from the date of the approval of this Resolution;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRHOPE, ALABAMA that the public improvements for River Mill Phase 4
are hereby accepted for public maintenance subject to the bond posted.

Councilmember Gentle introduced in writing, and moved for the adoption
of the following resolution. Seconded by Councilmember Quinn, motion passed
unanimously.
RESOLUTION NO. 727-000
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, THAT SAID GOVERNING BODY WILL HEAR AND RULE ON ANY
WRITTEN OBJECTIONS PRESENTED AGAINST THE ASSESSMENTS TO BE
ASSESSED FOR THE 1999-2000 PUBLIC IMPROVEMENT PROJECT BY THE
FOLLOWING RULES AND REGULATIONS:
1. Each property owner of record will be sent a notice, by Certified Mail, advising of
the date, time, and place of the Public Hearing, in addition to the required notice
placed in a newspaper of general circulation in the city.
2. Said notice -by -letter shall be mailed not less than 20 days prior to the date of
hearing.
At the Public Hearing, the Governing Body will read and rule upon any and all
objections to the proposed assessments which have been filed in writing prior to
the Hearing.
4. The Governing Body will determine whether or not the objection presents proof
as to whether or not property value has not been increased to the value of the
Assessment and will rule as to any decreased assessment amount.
5. If the Governing Body determines to reduce assessments, they will also resolve
source of revenue to replace the amount of decreased assessment revenue, if this
should be necessary for loan repayment.
6. Once the Governing Body rules upon any and all objections, they will set the
assessments by duly adopting the proper resolution setting forth the assessment
for each lot and parcel of assessed property (by reference to the Assessments Roll
Book) and no lot or parcel will be afterward sub -divided in any way without the
full and remaining balance of its assessment, plus any accrued interest, being first
paid in full.

Councilmember Ford introduced in writing, and moved for the adoption of
the following resolution. Seconded by Councilmember Anders, motion passed
unanimously.
RESOLUTION NO. 728-00
AUTHORIZING A ONE TIME EXPENDITURE OF FUNDS TO
SUPPORT PUBLIC TRANSIT COALITION
WHEREAS, the Public Transit Coalition is comprised of representatives of social
services organizations, business and local government agencies; and
WHEREAS, the group began to meet earlier this year to explore the need for
expanded transportation services in Baldwin County; and
WHEREAS, South Alabama Regional Planning Commission submitted a
proposal in the amount of $19,805.00 for a Needs Assessment Study and the
Baldwin County Commission was requested to fund this project; and
WHEREAS, the City of Fairhope was asked to participate in the funding in the
amount of $2,100.00 based on the estimated population of the city; and
WHEREAS, the Fairhope City Council has deemed it appropriate to assist in a
one time cost of $2,100.00 (TWO THOUSAND ONE HUNDRED AND NO/100
DOLLARS).
NOW, THEREFORE, BE IT RESOLVED by the Fairhope City Council in regular
session November 13, 2000 as follows:
Section 1. That the Fairhope City Council authorize the expenditure of
$2,100.00 (TWO THOUSAND ONE HUNDRED AND NO/100
DOLLARS) on a one-time basis and that the City does not commit
to any other funding toward this project.

Council reviewed an application for a Restaurant Liquor License by Sandra
R. Whitley, dba Sandra's Wash House Restaurant, located at 17111 Scenic Hwy
98, Point Clear, Alabama. Councilmember Ford moved to approve the issuance of
the license. Seconded by Councilmember Anders, motion passed unanimously.
Council reviewed an application for a Restaurant Liquor License by M. R.
Loper, dba The Original Wash House, located at 19270 Scenic Hwy 98, Point
Clear, Alabama. Councilmember Ford moved to approve the issuance of the
license. Seconded by Councilmember Christenberry, motion passed unanimously.
Councilmember Anders moved to un-table the request for clarification of
the PUD for Commercial Parcel at Rock Creek Subdivision, and to allow for
proper publications of another Public Hearing. The required traffic Study for this
area is complete. Seconded by Councilmember Quinn, motion passed
unanimously.
The Baldwin Pops Band has decided to relocate the Band to a new home in
the Fairhope Civic Center, at no cost to the City. The Baldwin Pops physical
requirements needed in order for the Baldwin Pops to function as a concert at the
Fairhope Civic Center:
• One night a week should be reserved for rehearsal (probably
Tuesday from 6:30 p.m. until 9:30 p.m.)
• The members would have to have access to the back door of the
auditorium, either through 3 sets of keys for the Band Director, the
Bank Manager, and the Band President or have someone on call for
rehearsals and concert preparation.
• A storage area for stands, file cabinets, locker, podium, and
miscellaneous equipment.
• A locking storage bine approximately 4x4x25 feet for the percussion
equipment. This should be located at the back of the stage.
• A rental truck would be needed for each concert away from the Civic
Center.
• The loading crew from the Fairhope High School Band will have to
be paid.

Mayor Kant expressed that the City will provide a stage for the band.
Councilmember Ford had reservations about providing three keys to the building.
Mayor Kant stated that gaining access to the back door of the auditorium will be
worked out so no keys will be issued. After further discussion, Councilmember
Quinn moved to grant the Baldwin Pops Band proposal to store instruments in the
Civic Center. Seconded by Councilmember Anders, motion passed unanimously.
Councilmember Quinn moved to grant the request of the Children of the
World to host their Annual Chinese Parade, on Saturday, 27 January 2001, at 2:00
p.m. Seconded by Councilmember Ford, motion passed unanimously.
Councilmember Quinn moved to grant the request of the Mardi Gras MG
Car Club to use the corner of Fairhope Avenue and Bancroft Street to display their
British cars during the Annual Arts and Crafts Event 2001. Seconded by
Councilmember Anders, motion passed unanimously.
Councilmember Ford moved to Update the Police Reserve Roster by adding
Benjamin G. Taylor. Seconded by Councilmember Christenberry, motion passed
unanimously.
Councilmember Gentle reported on the request of the residents of Johnson
Avenue and Call Street requesting two stop signs on Johnson Avenue at the
intersection of Call Street. Mr. Gentle reported to hold off on placing a stop sign
at this intersection for one month in order to allow the Police Department to install
a new speed control program.
Mayor Kant called on Officer Christopher Browning to explain concerns
with speeding and safety issues in Fairhope. Officer Browning reported that in an
effort to increase traffic safety and to decrease vehicle speeds, the Fairhope Police
Department will implement a Zero -Tolerance Traffic Safety Program. The Zero -
tolerance Traffic Safety Program will be a strategic, concerted effort between
officers of the department and other city resources. The program will be initiated
in the following phases:
Phase 1: Based upon citizen concern, officer knowledge, or other
cause, traffic monitoring equipment will be utilized. The
purpose of the monitoring equipment will be to establish a
traffic count for that roadway, and to identify peak times of
traffic flow and /or violations.
Phase 2: The Police Department's speed measurement and notification
trailer will be stationed in the area of concern to give notice of
driver's speed and to detect if enforcement would deter
further violations.

Phase 3: Members of the Fairhope Police Traffic Enforcement Unit
will actively operate Police Doppler Radar and take
appropriate enforcement actions.
Areas of concern will be evaluated by the Chief of Police, and after his
evaluation, will be assigned a starting phase. After evaluating an area of concern,
the Chief of Police may elect to skip a phase of the program in order to quickly
resolve a traffic concern.
Upon being stopped the first time the Fairhope Officers will be able to
issue, at his or her discretion, a written warning for any traffic violation. The
officer's main duty will be to alter the driving habits of any given motorist.
Oftentimes, this alteration can be accomplished by use of a written warning, but if
the officer feels that a traffic citation is needed to correct the behavior of a
motorist, it shall be the officers's responsibility to issue same. Information
generated from warning tickets will be entered into a central database for future
review. The purpose of this database is twofold: (1) To track enforcement
actions in any given problem area. (2) To ensure that motorists are not issued
repetitive warning citations for similar incidents.
Also for the first time, the Police Department will implement a Traffic
Enforcement Unit, which will consist of carefully chosen officers who have shown
efficiency in enforcing traffic laws. The primary duty of the Traffic Enforcement
Unit will be to aggressively seek out traffic violations and adhere to the overall
zero -tolerance efforts of this program. The greatest benefit of implementing the
Traffic Enforcement Unit will be the ability to actively enforce traffic laws without
taking away from or hampering the duties of patrol, which the department must
maintain.
